Cyber law
Cyber law is the term used to
describe a law that deals with issues
to the internet, technological and
electronic elements, communication
technology, including computers,
software, hardware and information
systems.

Need for cyber law in India
• Cyber law is concerned with every individual these days.
This is primarily because we all use internet in same or
other form daily. Internet is used when we create any
account online, while performing e-commerce transactions,
net-banking, fore-mails etc.
• It touches almost all aspect of transaction and activities on
and concerning the internet, the world wide web and cyber
space.
• Cyber law protects every individuals from getting trapped
in any cyber violations.

Information Technology Act,
2000
It is a primary law of INDIA dealing with cybercrime and electronic
commerce.
This law is applicable across India.
This Act provides legal framework for electronic governance by giving
recognition to Digital Signature and Electronic Records.
It also establish a Cyber Appellate Tribunal to resolve disputes rising from
this new law.
It also defines cyber crimes and prescribed penalties for them.

Information Technology Act,
2000
Objectives:
• To provide legal recognition for transactions.
• To facilitate electronic filing of documents with the Government
agencies.
• To amend the Indian Penal Code, The Indian Evidence Act,1872 , The
Banker’s Book Evidence Act,1891 and the Reserve Bank of India
Act,1934.
• Aims to provide the legal framework to all electronic devices.

Added several new sections on offences
including Cyber Terrorism and data
Protection.

Salient Features of ITA-2008
• The term 'digital signature' has been replaced with 'electronic signature' to
make the Act more technology neutral.
• A new section has been inserted to define 'communication device 'to mean
cell phones, personal digital assistance or combination of both or any other
device used to communicate, send or transmit any text video, audio or image.
• Section 67 of the old Act is amended.
• Section 66A and 66F prescribe punishment for obscene electronic message
transmissions and cyber terrorism.
• Section 66A of the Information Technology Act, 2000 made it a punishable offence for any person to send
'grossly offensive' or 'menacing' information using a computer resource or communication device.
• Section 66F. Punishment for cyber terrorism.
