CHRISTIAN SUCCESSION
Every law of succession defines the rules of
distribution of property in case a person dies
without making a will.
The Christian law of succession is governed by
the provisions in the Indian Succession Act,
1925.
Chapter II of the Indian Succession Act, 1925
deals with intestate succession and this
chapter apply to Indian Christians only.
Sections 31 to 49 of this act deals with rules
which lay down the schemes for allotment of
shares of the next of kin of the deceased in
cases of intestate.
General principles of Intestate
Succession
1. Under section 31, this chapter
shall not apply to parsi.
2. Under section 32, for devolution
of property, the property of an
intestate devolves upon the wife or
husband as the case may be, or
upon those who are of the kindred of
the deceased, in the order and
according to the rules, which are
specified in the chapter II of this act.
The chapter II of the Indian succession Act,
1925 deals with the following types of
devolutions
1. Rules of devolution of property for
widow (Section 33)
2. Rules of devolution of property for lineal
descendants (section 33 and 34 to 40)
3. Rules of devolution of property for
father (Section 41 and 42)
4. Rules of devolution of property for
mother, sisters or brothers and children of
deceased brothers or sisters (Section 41
and 43 to 47)
5. Rules of devolution of property for other
kindred other than above (Sec. 48, 49)
1. An Indian Christian died leaving his wife,
father and son. Divide the properties.
2. A Christian female died leaving her
husband, two sons and two daughters of pre-
deceased daughter. Distribute the estate.
3. A Christian male dies intestate leaving his
father, mother, wife and son. Divide his
property.
4. A Christian female dies leaving her mother,
husband, son of a predeceased son and four
daughters of a predeceased daughter.
Distribute her estate.
5. A Christian female dies leaving her two
children of predeceased son and three
children of predeceased daughter. Distribute
her property.
6. A female Christian died intestate leaving
behind her husband, three grandsons through
1st predeceased son, 2 granddaughters
through 2nd predeceased son and one
grandson through 3rd predeceased son.
Distribute her estate among them.
7. A male Christian died intestate leaving
behind his widow, one son, one daughter and
two grandsons through predeceased son.
Distribute his estate among them.
8. A male Christian died intestate leaving
behind his father, mother, sister, four grand
children through 1st predeceased son and one
grandson through 2nd predeceased son.
Distribute his estate among themselves.
9. A Christian male dies intestate leaving his
wife, father, mother, brother, and sister.
Distribute his property.
