Title- President:
Impeachment
 Presented by: [Link]
 Subject: Indian Constitution
 Div- B
 Roll No - 71
Introduction
 The President of India is the highest
constitutional authority and head of the
Republic.

 Impeachment is a formal process to

remove the President for violation of the
Constitution.

 It ensures accountability, responsibility,

and protection of democratic values.

 Mentioned in Article 61 of the Indian

Constitution.
Meaning of Impeachment

 Impeachment is a constitutional mechanism

for removing the President.

 It is a quasi-judicial process—not political in

nature.

 It guarantees that even the highest office is

not above the law.
Constitutional Basis
 Article 61: Provides the complete impeachment procedure.

 The only ground for impeachment is “Violation of the Constitution.”

 The term violation is not clearly defined, giving Parliament interpretative

power.
Who Can Start the Process
 The process can begin in either the Lok Sabha or the
Rajya Sabha.

 The motion must be signed by at least one-fourth of the

total members of that House.

 Fourteen days’ notice must be given before introducing

the motion.
[Link] of Motion
 The motion is introduced in the initiating House.

 It must be passed by a two-thirds majority of the total

membership.

 If passed, it is sent to the other House for investigation.

 The other House investigates the charges against
the President.

 The President has the right to appear and defend

themselves.

 If the second House also passes the motion by a

two-thirds majority, the President is removed
from office immediately.
Role of Parliament
 Ensures the President’s accountability to the Constitution.

 Reflects the sovereignty of Parliament and the supremacy of the Constitution.

 Prevents misuse of executive powers.

Historical Background
 Inspired by the U.S. Constitution’s impeachment process.

 Debated thoroughly in the Constituent Assembly to avoid misuse.

 Designed to maintain a balance between respect and responsibility of the

office.
Comparison with the U.S.
Significance of the Provision
 Reinforces constitutional supremacy over individuals.

 Ensures checks and balances within the system.

 Protects the integrity of the highest office.

 Symbol of democratic maturity and fairness.

Challenges and Limitations

 Difficult to define “violation of the Constitution.”

 Requires a two-thirds majority in both Houses — rarely achievable.

 Highly lengthy and complex process.

 Can be politically sensitive.

Present Scenario
 No impeachment motion has ever reached the final stage.

 Presidents have always resigned before any serious action was taken.

 The provision remains a constitutional safeguard rather than a practical

tool.
Conclusion
 The impeachment provision under Article 61 is not meant for regular use but
for rare constitutional emergencies.

 It upholds the principle that “Power must always be accountable.”

 India’s carefully balanced impeachment process reflects the wisdom of the

Constituent Assembly, which prioritized stability and integrity over political
revenge.

 Thus, the impeachment clause remains a silent guardian of constitutional

discipline
