Limitations of the
Agreement
1 Property law attempts to reconcile competing rights and interests by
means of default rules, contractual rules, and public regulations.
2 Those who support upward harmonization argue that it will have
positive effects on trade ,FDI, and global innovation .
3 Opponents contend that such harmonization could ossify the
imperfect IP system of the North and impede development.

Suggestions for ensuring the compliance of the Agreement
1.
The developed countries should also need to utilise the
TRIPS agreement’s IP right protection criteria as a
benchmarked, to develop a much higher IP rights
protection agenda through the introduction of TRIPS plus
provisions in bilateral and other multilateral agreements
entered into developing countries.
Suggestions for ensuring the compliance of the Agreement
Governments can work to maximize the
potential long-run gains (or minimize the
losses) from IPRs by embedding their regimes
within a comprehensive set of complementary
policies.
