THE ISLAMIC CLAUSE IN THE
CONSTITUTION OF PAKISTAN 1956

As Pakistan was founded on the basis of Islamic philosophy due to which the
constitution of Pakistan contains a numbers of Islamic provisions. Before 1956
constitution the objective resolution which was a framework for a upcoming
constitution of Pakistan was based on Islam or sharia. In the same way the
constitution of 1956 , 1962 and 1973 are also based on Islam injunctions. But
today we concern with the Islamic provisions of 1956 constitution
• The constitution of 1956 which is the 1st constitution of
pakistan is having a number of islamic provision for exmple ;
• THE NAME OF STATE
• SOVEREIGNTY OF GOD
• PROMOTION OF ISLAMIC WAY OF LIFE
• PROMOTION OF ISLAMIC TEACHING AND ISLAMIC VALUES
• QUALIFICATION FOR PRESIDENT AND PRIME MINISTER OF
COUNTRY
• NO DISCREMINATION AMONG THE CITIZEN ON THE
GROUND OF RELIGION , COLOR, NATIONALITY ETC
• THE PRINCIPLE OF FREEDOM , EQUALITY , TOLERANCE
AND SOCIAL JUSTICE AS LAID DOWN IN ISLAM SHALL BE
FULLY OBSERVED
• SAFEGUARD THE INTEREST OF NON-MUSLIMS
MINORITIES SO THAT THEY CAN FREELY FOLLOW THEIR
RELIGION AND CULTURE
• ENFORCEMENT OF ISLAMIC LAW

Background of 1962 Constitution

• Background
• Military took over on 7 October 1958 and consequently Ayoub Khan became Chief
Martial Law Administrator.
• One major task was to frame a new constitution.
• The Administration was critical of Parliamentary system because it caused instability in
the past.
• The sought stability of the nation in the gradual development of democracy.
Making The 1962 Constitution

Making Constitution:
 The government introduce basic democracies in October 1959. Under this system forty
thousands basic democrats (local councilors) were to be elected in each province. They
have to perform functions as local government and their role in developmental work .They
acted as an electoral college for the election of president and the national assembly .

 It was held in December 1959 and January 1960. Then presidential referendum was held
by the elected (BD) members on February 17,1960. A constitutional commission was
established in February 1960 under the Chairmanship of Justice Shah a buddin former
chief justice .
Making The 1962 Constitution

The task assigned to the commission were


1) The causes of failure of parliamentary system
2) Recommend a new system keeping view
a) Genius people b) Standard of education
c) Internal conditions of the country d) Need of development
Commission presented its report in May 1961.
Ayoub announced the constitution on March 1 , 1962 . Elections to the National Assembly and Provincial
Assembly were held in April and May 1962 respectively .

ISLAMIC PROVISION OF 1973 CONSTITUTION

• In 1973 constitution the main object was to establish a real


an islamic system in the provision. This constitution was
made in the lights of previous constitution. So some
object are as follow:
• 1:Islam would be the state religion.
• 2:President and prime minister should be muslims.
• 3: laws of islam should be followed.
• 4:Imparting education of holy quran and islamiat by
government.
• 5:President and prime minister should take oath to express
their faith in holy quran and prophetood
• 6:Interest free banking system
• 7:Islamic advisory council will be set to bring the existing laws
with islamic principle
• After setting some constitution object of 1973 in 5th July the
chief of Pakistan army staff GENERAL MUHAMMAD ZIA –
UL-HAK imposed martial law .1973 constitute forcely
remained for four hours. But did not end the constitution he
ran the country with the constitution of 1973 and martial law.
