CAPSMUN-2025

BACKGROUND GUIDE

Committee Name: SUITS

Agenda: Deliberation on the Arrest of Michael James Ross: Should
Mike Ross Be Regarded as a Legitimate Attorney or a Convicted Felon?
LETTER FROM THE EXECUTIVE BOARD

Esteemed Delegates,

It is with great anticipation that we welcome you to the SUITS Committee —

a courtroom simulation inspired by high-stakes legal drama and grounded in
the jurisprudential traditions of real-world litigation. This simulation seeks to
explore not only legal technicalities but also ethical implications, institutional
accountability, and the perennial tension between merit and legality.

As members of this committee, you are expected to step into the roles of
advocates, legal advisors, and witnesses. You will be required to draft
motions, present arguments, interrogate witnesses, and examine the factual
and legal framework underpinning this matter. The Executive Board will
preside over the proceedings in a judicial capacity, ensuring procedural
integrity and adherence to courtroom decorum.

We look forward to adjudicating a thoughtful, rigorous, and ethically sound

discourse that challenges conventional perspectives and redefines justice.

With best regards,

Sarthak Pandit Garv Chawla

I. Introduction to the Committee
The SUITS Committee is a unique legal forum designed as a courtroom
simulation, where participants are assigned distinct roles and responsibilities
in the framework of a mock judicial proceeding. Unlike traditional MUN
structures, this committee draws inspiration from adversarial legal systems,
particularly that of the United States.

Delegates will assume the roles of prosecutors, defense attorneys, legal

consultants, or witnesses, participating in structured litigation modeled after
real court trials. The proceedings will follow formal legal conventions,
inclusive of evidence presentation, sworn testimony, legal objections,
motions, and structured argumentation. Delegates are expected to approach
this committee with precision, discipline, and a sound understanding of legal
reasoning.

II. Case Background

Michael James Ross, a college dropout endowed with a photographic
memory, illicitly entered the legal profession by falsifying his academic
credentials and securing employment at Pearson Hardman — a prestigious
law firm based in New York City. Despite his lack of formal legal education
or a bar license, Ross demonstrated extraordinary aptitude in litigation,
amassing an enviable record of courtroom victories and favorable
settlements.

Upon discovery of his deception, Ross was charged with multiple felonies,
imprisoned, and disbarred. His actions have left the legal fraternity polarized.
Some argue he is a fraud whose conduct irreparably damaged institutional
integrity; others contend that his legal prowess and the absence of client harm
justify reconsideration of his legacy.
This committee is summoned to answer a singular, nuanced question:
Should Mike Ross be regarded as a legitimate legal professional by virtue of
his contributions, or as a convicted felon who undermined the rule of law?

III. Legal Framework and Key Charges

Delegates must base their arguments within the legal structure governing the
State of New York and United States federal law. The charges leveled against
Michael Ross include:

● Fraudulent Misrepresentation – Willfully misrepresenting oneself as

a Harvard Law graduate.
● Unauthorized Practice of Law – A Class E felony under New York
Penal Code Article 485.
● Obstruction of Justice and Forgery – Manipulation of documents and
interference in legal proceedings.

In addition to legal analysis, delegates must consider:

● Whether the outcomes of cases handled by Mike Ross should remain

valid.
● The moral and ethical obligations of attorneys.
● The culpability of the law firm and senior partners in facilitating the
fraud.
● The precedent such a case sets for the licensing and admission process
across the legal profession.

IV. Committee Composition and Role Allocation

The committee is divided into two principal benches:
1. The Prosecution Bench

● Argues that Mike Ross engaged in criminal conduct warranting

permanent disbarment and conviction.
● Must establish malicious intent, institutional harm, and the erosion of
judicial integrity.
● May introduce witnesses and evidence demonstrating Ross's fraudulent
intent and its systemic impact.

2. The Defense Bench

● Argues that Mike Ross’s contribution to justice validates his conduct

retroactively or mitigates criminal liability.
● Will aim to justify Ross's actions as the result of a flawed system and
lack of formalized mentorship.
● May attempt to demonstrate that his legal acumen served, rather than
subverted, justice.

V. Committee Procedure and Flow

The committee proceedings will follow a structured legal protocol, as
outlined below:

1. Opening of Court and Swearing-In

The Executive Board will open the session, and all participants will be
sworn in under oath.
2. Opening Statements
Each bench shall deliver its formal case introduction.
3. Presentation of Evidence and Witnesses
Each side will present their documents and introduce witnesses for
direct examination.
4. Cross-Examination Rounds
Opposing delegates will question the introduced witnesses, subject to
procedural objections.
5. Motions and Submissions
Delegates may submit motions to suppress evidence, redirect witnesses,
or raise procedural objections (e.g., leading, hearsay, speculation).
6. Closing Statements
Each bench will be allotted 90 seconds to summarize their case and
offer concluding remarks.
7. Judicial Deliberation and Verdict
The Executive Board will deliberate in closed session and issue a final
judgment based on merit, legal coherence, and documentation.

VII. Rules of Evidence and Conduct

This committee adheres to the decorum and conventions of a formal
courtroom. The following regulations will apply:

● All speech and submissions must remain in-character and legally valid.
● Objections must be clearly stated and rooted in recognizable legal
standards (e.g., hearsay, leading, argumentative, relevance).
● All evidence must be formally submitted and approved by the bench
before discussion.
● Cross-examination must remain respectful, professional, and within
bounds of ethical inquiry.
● Any disruptive conduct will lead to procedural sanctions or
disqualification.
VIII. Legal Concepts for Reference
Delegates are strongly encouraged to research and familiarize themselves
with the following legal doctrines and principles:

● Mens Rea and Actus Reus – The mental state and act necessary to
constitute a crime.
● Unauthorized Practice of Law (UPL) – Definition, implications, and
sentencing.
● Bar Admission Ethics and Precedents – Historical cases involving
forged credentials or retroactive licensing.
● Judicial Discretion and Moral Culpability – The extent to which
intent and contribution can mitigate criminal action.
● Whistleblower Protections and Legal Immunity – Relevant in
assessing third-party complicity.

IX. Suggested Readings

● New York Penal Code – Article 485: Unauthorized Practice of Law
● ABA Journal – Case Studies on Bar Admission Ethics and Professional
Misconduct
● Legal Opinions and Case Law – Precedents involving disbarred or
fraudulent attorneys
● Selected Episodes of Suits – Season 5, 6 for contextual reference of
Mike Ross’s trial and imprisonment

X. Guiding Questions for Deliberation

1. Does legal brilliance justify the circumvention of formal licensure?
2. Can an individual who violated legal protocol be retroactively
legitimized if the outcomes were just?
3. Should the legal system emphasize procedural adherence over
substantive justice?
4. To what extent should Pearson Hardman be held accountable for
concealing Mike Ross’s deception?
5. Is moral intent an acceptable defense against legal technicality?

XI. Final Note

This committee is not convened to glorify a character nor condemn one
blindly. It exists to examine the legal and ethical implications of deception
within the legal system, and whether results — even virtuous ones — can be
used to justify fundamentally unlawful actions.

We expect all delegates to engage with intellectual honesty, structured

reasoning, and respect for the legal traditions they are simulating.

Let justice be argued, and let truth be heard.

Court is now in session.
