1.1. LEGAL BASES OF PHYSICAL EDUCATION
The inclusion of Physical Education (PE) in the collegiate curriculum is not merely
a tradition but a mandate rooted in high-level legal frameworks. These mandates ensure
that the state provides opportunities for students to develop a healthy and alert citizenry.
• 1987 Philippine Constitution (Article XIV, Section 19): This is the "Mother of all
Laws" for PE. It explicitly states that the State shall promote physical education
and encourage sports programs, league competitions, and amateur sports. The
goal is clear: to foster self-discipline, teamwork, and excellence for the
development of a healthy and alert citizenry.
• Republic Act No. 5708 (The Schools Physical Education and Sports
Development Act of 1969): This law serves as the structural backbone for PE in
our country. It mandates an integrated physical education and sports development
program for all schools in the Philippines. It ensures that PE is not treated as an
"extra" but as a core part of the educational experience to promote the total
development of the student.
• Republic Act No. 7722 (Higher Education Act of 1994): Specifically for college
students, this law created the Commission on Higher Education (CHED). Through
various CHED Memoranda (like CMO No. 39), the government requires the
completion of 8 units of PE for all baccalaureate degree programs. This ensures
that even as you specialize in your chosen career, your physical well-being is not
neglected.
• The UNESCO International Charter of Physical Education and Sport: On a
global scale, the Philippines adheres to this charter, which declares that "the
practice of physical education and sport is a fundamental right for all." It
emphasizes that PE is essential for the full development of a person's personality
and should be guaranteed by the educational system.

Summary of mandates:
Legal Base Key Contribution to PE
1987 Constitution Sets the national goal of creating an "alert citizenry."
RA 5708 Mandates a unified sports program across all schools.
RA 7722 (CHED) Requires 8 units of PE for all college degree programs.
Establishes physical activity as a fundamental human
UNESCO Charter
right.

1.2. CHED MEMORANDUM ORDER NO. 39 S. 2021 (CMO NO. 39 S. 2021)

CHED Memorandum Order (CMO) No. 39, s. 2021 is the official policy that
governs the "Policies, Standards, and Guidelines for the Tertiary Physical Education
Program." It introduced the PATHFit (Physical Activity Towards Health and Fitness)
curriculum, moving away from traditional "sports-only" PE and focusing on lifelong fitness.

THE CORE PHILOSOPHY

The implementation of this mandate ensures that tertiary PE is not just about
playing games, but about Physical Literacy. This means developing the confidence,
competence, and motivation to be active for the rest of your life. It views PE as a vital
component of the "Path" toward a "Fit" lifestyle.

THE FOUR-COURSE SEQUENCE (THE 8-UNIT REQUIREMENT)
Under CMO 39, every college student must complete four (4) PE courses, totaling
8 units. These are carefully sequenced to build your fitness levels:
1. PATHFit 1: Movement Competency Training
• The foundation. You learn how to move your body correctly (posture, core
stability, and basic movement patterns) to avoid injury.
2. PATHFit 2: Exercise-based Fitness Activities
• This focuses on workout programs like aerobics, strength training, and
flexibility to improve your overall physical capacity.
3. PATHFit 3 & 4: Choice of Physical Activities
• In these levels, you get to choose from various "menus" of activities based
on your interests. These are divided into:
▪ Individual/Dual Sports & Combative: (Arnis, Badminton, Martial
Arts)
▪ Team Sports: (Basketball, Volleyball, Football)
▪ Dance: (Social dance, Folk dance, Hip-hop)
▪ Outdoor/Adventure: (Hiking, Swimming, Orienteering)

IMPLEMENTATION GUIDELINES
How is this law actually applied in your university? CMO 39 sets strict standards
for implementation:
• Fitness Testing: Every student must undergo Pre-test and Post-test physical
fitness assessments to track actual improvement.
• Time Allocation: Each PATHFit course requires a minimum of 2 hours per week.
• Inclusive Education: The law mandates that PE must be accessible to everyone.
Students with "Special Needs" (Differently-Abled) or medical conditions are
provided with Modified PE programs rather than being exempted.
• Teacher Qualifications: Only licensed professionals or specialists with
recognized certifications are allowed to teach the curriculum to ensure safety and
quality.

Summary of PATHFit Implementation:

Course Level Focus Area Goal
PATHFit 1 Fundamental Movement Correcting "how" you move.
PATHFit 2 Exercise Programs Building "strength" and "stamina."
Developing "skill" in a specific
PATHFit 3 Choice (Sports/Dance)
area.
Sustaining "lifelong" interest in
PATHFit 4 Choice (Sports/Outdoor)
activity.

POST ASSESSMENT:

Activity Title: The "Legal-to-Life" Digital Storyboard

The Mission: Your class is creating a "New Student Onboarding Guide" for the
university. Each group will create one digital slide or poster representing their
assigned "Zone." When combined, these will form a complete "Survival Map" for
PE.

Group 1: The "Why" Zone (The 1987 Constitution)

• Your Focus: Article XIV, Section 19.
• Task: Create a "Hype Poster." Explain that the Constitution gives students
the right to be "Healthy and Alert."
• Key Question to answer on your slide: “How does PE help you build self-
discipline and teamwork for your future career?”
Group 2: The "Law" Zone (RA 5708 & RA 7722)
• Your Focus: The Schools Physical Education Act and the CHED Mandate.
• Task: Create a "Terms & Conditions" Infographic. Show that PE is a core
requirement (8 units total) to graduate.
• Key Question to answer on your slide: “Why does the government insist you
take 8 units of PE instead of just one?”
PATHFit 4: SPORTS ACTIVITIES MODULE ROY O. JARLEGO, LPT, MAPE

Author
Group 3: The "Level-Up" Zone (CMO 39: Course Sequence)
• Your Focus: The 4-course PATHFit structure.
• Task: Create a "Game Level Map." Visualize the journey from PATHFit 1 to
PATHFit 4.
• Key Question to answer on your slide: “What is the difference between
learning how to move (Level 1) and choosing a sport (Level 4)?”
Group 4: The "Inclusion" Zone (CMO 39: Implementation)
• Your Focus: Safety, Time, and Inclusion.
• Task: Create a "Facts vs. Myths" list. Focus on the 2-hour-per-week rule
and how students with medical conditions are given Modified PE instead of
being left out.
• Key Question to answer on your slide: “How does the law make sure
EVERY student gets to participate, regardless of their physical condition?”

Common questions

PATHFit integrates legal and ethical considerations primarily through adherence to the 1987 Philippine Constitution and Republic Act No. 7722, ensuring the educational system supports physical well-being . Additionally, the program observes the Data Privacy Act of 2012 by ensuring confidentiality of student information collected through the Student-Athlete Profile Chart . It also provides modified PE programs for students with special needs, adhering to inclusivity and accessibility mandates, which are ethical requirements in educational standards .

The primary legal foundation for the inclusion of PE in Philippine higher education is the 1987 Philippine Constitution (Article XIV, Section 19). It mandates that the state shall promote physical education and encourage sports programs, league competitions, and amateur sports to foster self-discipline, teamwork, and the development of a healthy and alert citizenry . This legal mandate ensures that physical education is integrated into the educational framework as an essential component for the holistic development of students, not merely an extracurricular activity .

The PATHFit curriculum, as governed by CHED Memorandum Order No. 39, s. 2021, shifts away from traditional 'sports-only' PE to focus on lifelong fitness through Physical Literacy. This approach emphasizes developing the confidence, competence, and motivation necessary for being active throughout life . The curriculum includes foundational courses on movement competency and exercise-based fitness, followed by elective sports activities, offering students the flexibility to choose from various sports and fitness activities .

Student assessments in PATHFit are integrated through comprehensive fitness testing and self-reflection activities, such as documenting progress through Strava during cardio sessions, and completing personal reflections on endurance and health goals . Reflection activities encourage students to connect their physical experiences with health integrity, promoting a deeper understanding of their fitness journey. The evaluation includes rubrics that assess student participation, attire, safety practices, and accuracy in data reporting, providing structured insights into their physical development .

The PATHFit program contributes to broader public health goals by promoting physical literacy and lifelong fitness among students, which aligns with the national mandate to develop a healthy citizenry . By emphasizing physical education as a right and essential part of personal development, the program supports initiatives for reducing lifestyle-related diseases and enhancing overall well-being. The inclusion of various physical activities tailored to interests ensures wide participation and fosters healthy habits that have long-term public health benefits .

The role of Pre-test and Post-test Physical Fitness Testing in the PATHFit program is to assess student fitness levels at the start and end of the course to track improvement and tailor fitness goals appropriately . This testing framework not only focuses on enhancing physical abilities but also emphasizes self-awareness and personal development, aligning with the program's goal of fostering lifelong fitness and health .

The PATHFit course sequence requires every college student to complete four PE courses, totaling 8 units, as mandated by CMO 39. The sequence is structured as follows: PATHFit 1 focuses on movement competency training, PATHFit 2 on exercise-based fitness, and PATHFit 3 and 4 offer a choice of activities such as sports and dance . Implementation guidelines include mandatory fitness testing, a minimum time allocation of 2 hours per week, and accessibility for students with special needs through modified programs .

The PATHFit 4 module aims to develop teamwork and self-discipline by engaging students in structured sports activities that require collaboration and strategic planning. These activities are designed to go beyond basic physical training and encourage high-energy movement. The course facilitates skills such as communication, leadership, and cooperative problem-solving, which are integral to successful team dynamics. Moreover, the sports framework provides opportunities to demonstrate and reinforce self-discipline through regular training, goal setting, and adherence to rules and fair play .

The 'Jog & Track' session in PATHFit 4 assesses students' cardio-respiratory endurance by having them participate in a 3K or 5K run, tracking their performance with Strava. This activity helps students set a baseline for their endurance levels and identify areas for improvement. The structured warm-up, pacing guidance, and cool-down phases ensure safe execution while equipment and attire requirements emphasize correct practice. Through this activity, students can monitor their heart rate and physical responses to extended activity, using the data to guide future training and improvements .

The PATHFit program accommodates students with disabilities by offering Modified PE programs tailored to individual needs rather than exempting them from physical education. This approach is in line with the inclusive education policy, ensuring that all students have equal opportunities to benefit from the program. PATHFit's commitment to accessibility involves adjusting activities to match the abilities and health requirements of students while still aiming to develop their physical literacy and encourage lifelong fitness .
