Fact of the case:

The marriage between the parties was solemnized on dtd.03/04/2020 within the
permissible relationship as per Mohammedan law. The husband has a business of tractors in
Bargarh and the wife is unemployed and is a housewife. After the solemnization of the
marriage, the wife did not reside in the matrimonial house for the next 4 to 6 months but
resided in her parental house. After 4-6 months, she went to her matrimonial house and lived
there with her husband. During her stay with her husband, she was mentally harassed and was
called "Psycho" by her in-laws who also instigated her husband against her. When she
retaliated by arguing with her in-laws, she was slapped by her mother-in-law and the husband
did not attempt to provide protection to his wife. She was forced to go back to her paternal
house and her in-laws communicated to her parents regarding her conduct during her stay at
her matrimonial house.

The husband and his family state that as soon as the petitioner came to their house,
she began throwing tantrums and did not get along with the husband's relatives. She
mistreated her husband and in-laws and always demanded to stay separate from her in-laws.
The husband was mentally harassed. The husband denies to have witnessed any physical
abuse upon his wife by his family members. The wife voluntarily went away to her paternal
house. After a month or two, the husband sent the first notice of talaq and further in the
duration of 90 days sent more two talaq notices along with return of the dower amount which
the wife refused to receive.

Now the petitioner/wife has filed a petition claiming maintenance and litigation
expenses from her husband under section 125 of CrPC.

Issues:
1. Whether the marriage within the parties was solemnized and dissolved?

2. Whether the wife is entitled for compensation?

3. Whether the dower amount sent by the husband was enough for the maintenance of the
wife?
