Sub:- Representation regarding recognition of postgraduate qualification affected by prolonged non-
decision by State Medical Councils
Respected Sir/Madam,
I am Dr. Harikrushn Laheri, a Foreign Medical Graduate. I completed my MBBS course from the
Philippines and graduated in August 2020. Thereafter, I appeared for and passed the Foreign Medical
Graduate Examination (FMGE) on 4th December 2020.
At the relevant time, an advisory bearing No. MCI-203(1)(Gen.)/2020-Regn./112442 (file attached)
dated 30th July 2020, was issued by the competent authority, which clearly stated that Foreign Medical
Graduates who had completed their internship abroad as part of their primary medical qualification,
including graduates from the Philippines, were not required to undergo mandatory twelve months’
internship again in India. Subsequently, the Delhi Medical Council, through a notice dated 2nd
September 2020, signed by Dr. Girish Tyagi, then Registrar, Delhi Medical Council, adopted and
implemented the same advisory and allowed FMGs coming from the Philippines and other countries to
be registered with the Delhi Medical Council without insisting on completion of internship in India.
After qualifying FMGE, I was residing in Gujarat and accordingly applied for registration with the Gujarat
Medical Council. Based on the above advisories dated 30th July 2020 and 2nd September 2020, and in
accordance with the rules prevailing at that time, I was granted registration by the Gujarat Medical
Council on 9th February 2021. After obtaining this registration, I continued my medical practice and
pursued further studies in good faith.
In 2022, I appeared in NEET-PG 2022 and was allotted a DNB seat through NBEMS at Deen Dayal
Upadhyay Hospital, New Delhi. After joining my postgraduate course, I was asked to obtain registration
with the Delhi Medical Council. Accordingly, I applied to the Delhi Medical Council in November 2022
with all requisite documents. However, I was informed that in view of an advisory FMGL REGULATIONS,
2021 dated 18th November 2021, which mandated compulsory internship for FMGs and also mentioned
a requirement of 54 months’ course duration, and my course duration was 50 months and so my
registration could not be processed. I respectfully submitted that the same advisory also stated that
these provisions were not applicable retrospectively to candidates who had already completed their
course and obtained registration earlier, but despite this, my application was neither approved nor
formally rejected.
I was informed verbally that my case would be decided later, but no written order was passed. Since
November 2022, my application has remained pending without any final decision. During this period, I
also met Dr. Girish Tyagi, former Registrar, Delhi Medical Council, and explained my entire case;
however, I was again informed verbally that registration would not be granted and the matter continued
to be delayed without any written communication.
After completing my postgraduate training, I returned to Gujarat for registration of my postgraduate
qualification. The Gujarat Medical Council has informed me that an NOC from the Delhi Medical
Council, certifying that there are no disciplinary, vigilance, or malpractice proceedings against me during
my postgraduate training period, is required for processing my postgraduate registration. However, the
Delhi Medical Council has declined to issue both registration as well as NOC, stating that the same
cannot be issued unless I am registered with them. As a result, despite having completed my
postgraduate training without any complaint, inquiry, or allegation of misconduct, my postgraduate
qualification is not being recognized, and I am presently being considered only as an MBBS doctor.
I respectfully submit that I have acted strictly in accordance with the advisories and regulations
applicable at the relevant times, have not suppressed any information, and have never been involved in
any disciplinary or malpractice issue. The difficulty I am facing has arisen solely due to prolonged non-
decision and administrative deadlock between authorities, which has continued for nearly three years
and is causing severe professional hardship.
I humbly request the Hon’ble National Medical Commission to kindly intervene and resolve this matter
by issuing appropriate directions to the concerned authorities. I respectfully request that either the
Delhi Medical Council may be directed to grant me registration and issue the requisite NOC, or
alternatively, the Gujarat Medical Council may be permitted to process and register my postgraduate
qualification without insisting upon an NOC from the Delhi Medical Council, considering that there is no
disciplinary, vigilance, or malpractice issue against me. This would enable regularization of my
professional status and prevent further hardship arising solely due to prolonged administrative non-
decision.
