1. Rescission of letter directive Nr. 14, General Headquarters,


Armed Forces of the Philippines (GHQ,AFP) Dated 16 December 2022.
Subject: Entitlement of Commutation of Leave Credits by
Military Personnel Discharge without Honor/Separated through their own Fault.

Para 1-1 The GHQ, AFP published Letter Directive Nr 14 dated 19


March 2023, Subject: Entitlement to Commutation of Leave Credits by Military
Personnel Discharged Without Honor/Separated through their Own Fault with the
end view of addressing the issue on entitlement to unused leave credits. of military
personnel separated for cause or discharged without honor.

Para 1-2 The said Letter Directive prescribed that those who are
separated from the military service by reason of their own fault are not entitled to
accrued leave credits considering that the same are deemed forfeited as provided by
the A~P laws and policies.
Para 1-3. However, the Supreme Court in a long line of cases held that
dismissed government personnel or official are entitled to their earned/accrued leave
credits notwithstanding the nature of their dismissal as a matter of fairness and law
since it is considered eamed · during the period of employment.

Para 1-4 Likewise, the Office of the Ombudsman through Circular Nr


09, series of 1994 reiterated that retirement benefits do not include accrued leave
credits, which are considered earned salaries and, therefore, could not be forfeited
as an accessory penalty. More so, the Department of National Defense (DND)
promulgated Department Circular Nr 11, series of 2022 allowing any Enlisted
Personnel (EP) who is separated with less than 20 years in the military service to
receive his/her accumulated unused leave balances~.

Para 1-5 In light of the foregoing, Letter Directive Number 14 dated 19


March 2023, Subject: Entitlement to Commutation · of Leave Credits by Military
Personnel Discharged Without Honor/Separated through their Own Fault is hereby
rescinded, Further it shall be the responsibility of the Major Service Commanders
and Technical Administrative Services (TAS) Chiefs to request for the required fund
in the Department of Budget and Management (DBM),
