Reso Demolition

The Sangguniang Barangay of Barangay Rizal, Jovellar, Albay passed Resolution No. 17 S-2025 authorizing Punong Barangay Hernando O. Enciso to remove or demolish the existing reading center due to a directive from Mayor Jorem L. Arcangel for a municipal project. The reading center, originally a public toilet, was repurposed in compliance with R.A. 7743. RESOLUTION NO. 17 S-2025

A RESOLUTION AUTHORIZING PUNONG BARANGAY HERNANDO O.


ENCISO TO CAUSE THE REMOVAL OR DEMOLITION OF THE READING
CENTER IN BARANGAY RIZAL, JOVELLAR, ALBAY PURSUANT TO HON.
JOREM, L. ARCANGEL’S ORDER:

WHEREAS; the present reading center of Barangay Rizal, Jovellar, Albay was
originally constructed as a public toilet sometimes in 2012 and was later
developed and established as Barangay Reading Center by the previous Punong
Barangay in compliance to R.A 7743,

WHEREAS; on June 30, 2025 a letter from Mayor Jorem Arcangel, of Jovellar,
Albay addressed to Punong Barangay of Rizal, Jovellar, Albay ordering the latter
to remove or demolish the said structure due to the forthcoming implementation
of a proposed municipal project requiring site preparation and ground works
where the said reading center is located;

WHEREAS; subsequently PB Hernando O. Enciso called a meeting with the


Barangay Council and discussed about the removal/demolition of the structure,
wherein after a thorough deliberation, members of the council conceded;

WHEREAS; pursuant to Sec. 444 of the Local Government Code of 1991, which
grants the Punong Barangay the power to “enforce all laws and ordinances
relative to the exercise of its corporate power;
NOW THEREFORE, BE IT RESOLVED, as it hereby resolved by the
Sangguniang Barangay of Barangay Rizal, Jovellar,Albay in session assembled
to authorized Punong Barangay, of Barangay Rizal, Jovellar, Albay to cause the
removal or demolition of the structure located in Barangay Rizal, Jovellar, Albay,
pursuant to the order of Mayor Jorem L. Arcangel , and in accordance with
applicable law and ordinances.
RESOLVED FURTHER, that the Sangguniang barangay directs the Barangay
Secretary to furnish a copy of this resolution to the office of the Mayor and other
relevant offices.

ADOPTED.
July 01, 2025
