Question No.1: Who do you think was at fault and why?

Answer No.1

Client (shipbuilder) – Primary fault

- The client knew welding sets could leak oxygen in confined spaces.

- They had safety rules requiring disconnection of welding sets.

- These rules were communicated only to their own employees.

- They failed to pass critical safety information to contractors.

- Under ILO C155 & R164, employers must provide information, instruction and safe
systems for all workers, including contractors.

- Failure to manage contractors and communicate hazards created unsafe conditions.

Contractor – Secondary fault

- Welding sets were left connected inside confined spaces.

- Workers failed to recognise and report a dangerous situation.

- Under R164, employees must take reasonable care and report hazards.

Therefore:

Main responsibility lies with the client due to failure in contractor communication and
safety management. Contractor shares partial responsibility for unsafe practice.
Question No.2: What are the two main ILO standards for health and safety? What do
countries do with these standards?

Answer No.2

Two main ILO standards:

- ILO Convention C155 – Occupational Safety and Health Convention (1981).

- ILO Recommendation R164 – Occupational Safety and Health Recommendation (1981).

What countries do with them:

- Provide an international framework for workplace health and safety.

- Countries ratifying them incorporate their requirements into national legislation.

- National laws are developed to meet or exceed these standards.

- Enforcement agencies ensure compliance with these laws.

Question No.3: What are employers’ responsibilities under R164?

Answer No.3

- Provide safe workplaces, work equipment and work methods.

- Provide appropriate health and safety instruction and training.

- Provide adequate supervision.

- Establish suitable health and safety arrangements.

- Provide personal protective equipment free of charge.

- Ensure working hours do not endanger health and safety.

- Take measures to prevent physical and mental fatigue.

- Keep up to date with health and safety knowledge.


Question No.4: What are employees’ responsibilities under R164?

- Take reasonable care of their own health and safety.

- Take reasonable care of others affected by their work.

- Follow safety instructions and procedures.

- Correctly use PPE and safety equipment.

- Not tamper with or misuse safety equipment.

- Report hazards they cannot control.

- Report work-related accidents and ill health.

- Co-operate with their employer on health and safety matters.
