Further to quotation subsequent discussion and negotiation we had with you for subject work on 13/10/2025 & 24/10/2025 at our Malad west
office we are pleased to award the CIVIL work with excavation, construction materials, water proofing and Labor with shuttering supporting
with maintaining complete safety & Quality for project name Shiv Aashray Construction works i.e. G+10 Floor residential building, with
Ground floor Shop line, and up to 8th Floor Parking Tower, UGWT & Pump room, LMR, OHWT etc. Project located at Tarun Bharat Road,
Beside Aster Oriental Hotel, Marol Naka, JB nagar, Andheri East, Mumbai. The scope includes all grey structural work with material with
shuttering and labours as per the approved GFC drawings and specifications, terms and conditioned mentioned hereunder,

Your Approved Rate is 1440/-Rs. per [Link]. on Built-up area.


Above Rate is for purely with excavation, construction material, -ve & +ve side water proofing, Shuttering, supporting & labours, including
materials like RMC, Cement, Sand, Aggregate, Steel, Brick / Siporex blocks & Chemical required for concrete and water proofing etc., and all
tools, tackles, machinery, Formwork, Shuttering & supporting Materials, Steel cutting, bending machineries, Vibrators (20, 40, 60), cutter,
grinder, chipper, breaker etc. required for completion of civil works.
During the said discussion you have with any and all conditions stipulated in your all past correspondence & discussion/ quotation, and have
confirmed your compliance with the following mutually agreed terms and conditions.

1) Scope Of Work:-
The Contractor shall carry out and complete the Excavation, Anti termite, Soling, Plain cement concrete, retaining wall, waterproofing, Plum
Concrete, Reinforced Cement Concrete, Backfilling, Shuttering & Staging- Conventional & Mivan (Aluminum) Reinforcement, Couplers,
Masonry work, cement plaster, Drilling & Making cut out, Sleeves, Breaking of Concrete, RCC & Masonry members, Structural steel work &
Expansion Joints all complete work under this contract in every respect in conformity with the Bill of quantities, Drawings, Technical
Specifications, and with the direction of and to the satisfaction of the Developer/Engineer,

i. Excavation:
 Excavation in soil and Rock till desired depth as per drawings, and disposal of excavated soil / particulars is under contractor scope,
 Dewatering with dewatering pump and respective long hose pipe to drain ground water during excavation if any is under contractors scope,
 Foundation should rest on Hard rock as per SBC i.e. Excavator Ex-200 Bucket Refusal, level of excavation to be as per drawings or hard
strata level whichever is more, (Approximate depth of excavation can vary from 4.5 mtr to 7.5 mtr)
 Excavation should carry with proper safety measures, all loosed soil and loosed particles at the edge of excavation area to be removed,
maintain safe side slope so as to avoid any danger / land slide,
 Safety net / hard barricading to be provided to excavated edge for safety purpose to prevent and protect working area & labours from land
slide if any,
 Its contractor’s responsibility to ensure proper Royaltee challan with every dumper goes outside the premises, failing in giving proper
Royaltee challan along with dumper causes any penalty will be contractor’s responsibility to bare and pay penalty.
 Client / Developer will not be responsible for any RTO / Police obstruct dumper for any reason,
 During excavation if black stone need to excavate, that rock pieces / black stone can be used in site for soling after lab testing & proper
structural consultant and client approval only,
 Soling & PCC should lay only after checking of strata and proper Structural / Geotechnical consultants & Clients Engg approval, Soilng &
PCC should commence with filling proper checklist,
 Excavated surface should be neat & clean with removing all loosed particles, dirt and dust with washing to proceed with any structural works
ii. Anti termite:
Pre-construction anti-termite treatment as per IS 6313 (Part II) using Chlorpyriphos 20% E.C. @ 1% concentration, forming a chemical
barrier under raft, plinth filling, , external perimeter, vertical & Horizontal member etc., with 15-20-year guarantee, conforming to IS 8944.
As per approved methodology by Project in charge.

iii. Soling:
 Dry rubble stone soling up to 230mm thick with approved trap basalt stone, including Providing Rubble and base preparation, mechanical
compaction, murrum binding, watering and compaction complete as specified and as directed by project manager
 The work includes providing, laying, packing, and finishing soling below foundations, Plinth and compound , landscape areas and floors
using either single/double-layer flat soling or rubble/boulder soling as shown in drawings and directed by the Engineer.
 Rubble/boulder soling stones shall be hard, durable rock; typical practice uses hard stone with average piece sizes suitable to achieve
specified thickness and dense packing, Materials shall be approved prior to use conforming to IS 383 and tested per IS 2386 as referenced in
national specifications for materials in structures.
 Excavated Surface / The subgrade or improved subgrade shall be trimmed to line and level, compacted to the specified density, and inspected
and approved by the Engineer before soling is laid, no soling shall be laid on loose or un-compacted earth
 Rubble/boulder soling (execution) Provide rubble soling in a single layer of the thickness shown on drawings, typically 150 mm or 230 mm,
using stones of at least about 100 mm height for 150 mm layers and about 150 mm height for 230 mm layers to ensure stable seating,
 Place stones with the broadest face down, pack them closely, fill interstices with chips/smaller stones, and hammer to achieve tight packing
with complete filling of voids to the required grade and camber.
 Stone for soling to be tested from approved Lab of approved quality, conforming to IS 383 and tested per IS 2386 as referenced in national
specifications for materials in structures.

iv. PCC Works:


 PCC should commence only after the formation / subgrade is prepared and checked and recorded as acceptable, with level pad and Level
record as per drawing,
 Proper Checklist to be signed from client before casting
 Receiving & laying of plain cement concrete M20 & or any for foundation, basement, plinth or at any location and approved depth with
RMC confirming to relevant IS standard of required grade including mechanical conveying, placing in position mechanical compaction,
finishing, curing, centering, shuttering, de-watering, etc. complete as specified and as directed by project manager.
 PCC grade, mix proportion or design mix, aggregate quality, water addition control, and slump / workability shall comply with the approved
mix design with machine mix (Mixer mix) or RMC as approved by client Engg. no hand mix,
 Add approved water proofing chemical to make PCC water proofed
 PCC should cure with portable water for 15 days,
 PCC surface should be rough
 Proper compaction with needle vibrator to ensure no voids present in concrete, it gets proper compacted so as fill all gaps under the soling.

v. Water Proofing works:


 All Types of Water proofing along with necessary materials, chemicals, tools, tackles, labours along with proper safety and guarantee
minimum 20 years is under Contractor scope,
 Its Contractor responsibility to submit Water proofing methodology and method statement to client for their approval,
 Approved method statement can be used for water proofing of Raft, UGWT, Column Inside U.G. Tank, All floors Sanitary units, Terrace,
Part Terrace etc,
 Conventional water proofing to be applied i.e. Shabad tiles / Box type Water proofing to be adopted at Base of UGTank/ Raft / tower
Parking/ Retaining wall,
 Additional Skin wall of 100mm thk RCC wall periphery to Column to be provided to the columns under Water tanks
 All Reinforcement of Columns & Foundation to be painted with anti-corrosion Epoxy paint homogeneously.
 Water proofing IPS with PU Membrane water proofing to be done inside of Water Tanks, Lift Pits, Parking tower Pits,
 All external walls should be plaster as waterproofed plaster
 All slabs concreting to be done as no water should to pass through slab, if it passed then its contractor responsibility to do SUNANDA WPS
IPS to all floors over Slab concrete,
 All sanitary units, Terrace, Part terrace conventional system water proofing to be adopted i.e. IPS, Brick bat Coba, china chips, etc
respectively whereas applicable as per clients instructions and approval
 All water proofing works guarantee up to 20 years
 Proper DPC to be provided to all internal & external Wall so as no water seepages to wall
 Water proofed RCC DPC to be provided above / over 1st layer of Bricks/ Siporex (AAC Block) to all internal External, Sanitary units wall,
 Plaster to all Sanitary units wall both side will be water proofed plaster
vi. Plum Concrete:
 Receiving and laying plum concrete (M10 mix with 60% concrete & 40% rubble) at all required locations for foundation, plinth and soil
retention surfaces, using selected rubble (160mm and down size), including surface dressing, subgrade preparation, formwork, placement,
compaction, curing, finishing, dewatering, all leads and lifts complete as specified in GFC drawings, and as directed by project manager.

vii. RCC works:


 Its Contractor responsibility to complete RCC framed Structure with ply board / mione (Aluminum Shuttering) / MS board finish in line,
level, plumb & good finish, maintaining its sizes, Plumb And Level as per drawings and schedules,
 RCC works include Placing, compacting and finishing RMC of all grades (Concrete and steel only Client-supplied) for all RCC members
including raft, footings, walls, columns, beams, slabs, chajjas, staircases, pump room, tanks, lift, tower parking, OHWT, LMR etc and
architectural features, at all levels.
 Materials required for RCC works i.e shuttering, supporting, RMC, Concrete Raw Materials for site mix, GP2, Steel, Binding wire, raw
materials, Door frames, hold fast, sleeves, Water proofing chemicals, Admixtures, Curing Compound etc. is under contractors scope, its
contractors responsibility to make order of required materials on time so as no delay on site due to non-availability of materials,
 All materials should be approved from clients, no any materials will allow to use / execute on site if not approved from client
 Aluminum shuttering will be used for each columns and share wall shuttering,
 Supporting materials should be Proper well-conditioned MS supports like coupler, Scaffolding, Jack props, Spanners, Tie rod, Shikanja etc
 Any shuttering at any stage is not proper will be replace immediately with new or porper shuttering materials
 No sever honey combing, any honey combing to RCC structure should be repaired with proper specifications in confirmation to client engg.
 Construction of Pit, Parking pit, Underground & Overhead Water Tank, Fire Tank, Domestic Tank, Flushing Tank, Commercial Tank,
Mumty Room, LMR, Parking tower Share Wall, etc with pump room as per drawing & schedule is under contractor scope of works
 RCC Foundation, Footing, Raft, Retaining wall, Share wall, Columns, Tie Beam, Plinth Beam, PCC, Soling, Grid Slab, paving, Lift Shaft,
Parking tower Shaft, Slabs etc. at any floor level or any related to civil work is under Contractor Scope of works.
 Rate includes, protection of work, construction joints treatment, hacking for bonding, labour, machinery, vibrators, curing, dewatering,
surface finishing, cover blocks (2 higher grade precast with test certifcates), Checklist, pour cards, documentation, curing arrangements,
[Link] wire and site testing equipment as per IS/NABL.
 Construction joints to be prepared, roughened, grouted and bonded as specified.
 No extra payment for joint treatment or closing contractor-made openings. All as directed by Project Manager.
 All the materials should first checked as per quality standards before unloading of any materials,
 Backfilling, dewatering, compacting, levelling for the plinth & compound area / landscape as per standard and client satisfaction approval is
under contractor scope
 Proper Checklist of Reinforcement, Shuttering, and concreting works to be filled and checked before proceeding to next works and get
approved and signed from Client engg in charge,
 All elevations (Civil) works at any floor is under Contractor Scope of works,
 Any Structure member footings/ raft/ Columns/beams/walls/share walls/ retaining walls/Slab etc all to be in proper line level plumb and
maintaining sizes as per drawings and schedule in its original position, if any defect / deviation in works beyond 10mm will results to break
& recast of that particular structure without claiming any cost , client will impose debit for the same,
 All casting of concrete should be well in quality, well compacted, water tight, with no cracks, surface cracks, and free from any defects, with
no water leakages,
 Contractor should submit proper water proofing method and get approved from client before proceeding to water proofing activities
 Waterproofing should be done from both side (negative and positive side) to the tanks and columns and footing under tanks, with all
materials and equipment’s is under scope of works
 All elevational features in RCC , brick masanory, siporex block masanory is under contractors scope with its all materials and labours,
 Proper RCC band of 4” / 6” thk with material with proper line and level to be provided in each internal and external walls @ sill level, Lintel
level wherever required is under contractors scope of works,
 Contractor should keep 21 sets of cube mould for concrete cube test, sieves, cones for Slump Testing, and other required regular use of
quality apparatus, ready in well-oiled conditions every time proceeding to any concrete works,
 All agencies, materials, (Such as RMC, Lab for testing, Construction & Shuttering materials, water proofing chemical, admixtures, plaster
sand, raw materials, AAC blocks etc.) should be first approved from client,
 All RCC members should cure with portable water for minimum 15 days
 Curing Compound shall apply in proper manner as per its proper applications manule to vertical members like Coulmns, Share wall,
Retaining wall for curing of said members in case of unavailability of curing Portable water or as required.
 Required Hashen Clothes to be spread properly to ensure proper curing , keeping it wet for 24 hours for curing,
 Concreting should be done in proper sequences with proper adequate compaction, no Surface cracks, Minor or major cracks allowed,
 Post pour checking with signed checklist to be done before proceeding to next activities
 Deshuttering to be done as per Rules / Standards and Consultant General drawing,
 During Execution all materials (Constructions materials as well as shuttering materials and others) should be stacked properly , with
maintaining proper hygiene, housekeeping,
 Slab to slab cycle should be minimum 7 days to maximum 13 days , maintaining proper quality standards, and deshuttering rules, back
propping to beams and slab till stipulated days as per constructions quality Standards
 Supply and instalation Conventional / Aluminium formwork with 12mm aprooved commercial plywood / Aluminium (Mione) and steel
props upto 4.5 m height for all RCC members including raft, footings, retaining walls, columns, beams, slabs, tanks, pardis, OHT, and above
terrace walls.
 Rate includes strutting, propping, bracing, bolting, wedging, casing, removal, re-propping with adjustable CT/steel props, tie-rod hole
packing, PVC sleeves, spacers, adhesive tape, release agent, walking platforms, screen/skin walls at basement, and producing finished
concrete surfaces as per specifications.
 Steel Reinforcement for RCC (FE 500/FE 500D/FE 550): The work includes fabrication, cutting, straightening, bending, spirally hooping,
welding (after consultant approval only), and placing of reinforcement for all RCC members such as raft, footings, columns, shear walls,
beams, slabs, chajjas, staircases, tanks, pardis, fins, brackets, and architectural features of any size or shape.
 It covers internal shifting, leads, lifts, binding with 18 gauge GI wire, providing chairs, spacers, pins, PVC/concrete cover blocks, corrosion
protection for exposed bars using cement wash, preparing bar bending schedules, and bar splicing as per drawings and IS codes.
 Measurement will follow IS 1200, and wastage beyond permissible limits shall be borne by the contractor.
 Contractor responsible for plumbness, location, secure fixing to tank structure, and water tightness, all kind of sleeves like Plumbing ,
firefighting , Electric , HVAC and for Safety as directed by the Project Manager. If sleeves are misplaced from position or not present,
contractor shall do core cut without any extra cost to client.
 Supply and instalation All type of Manhole Cover like - SWD , Drainage , STP , UGT, OHT TMC approved & Tank Accessories:C.I.
manhole covers and frames conforming to IS 1726-1991: Medium Duty (MD-10, 50 mm ID, total weight ≥116 kg) and Heavy Duty (HD-20,
560 mm ID, total weight ≥208 kg), including vent pipe (25 mm dia.) with mosquito-proof mesh. Supply, install, fix, and test inlet, outlet,
vent, and overflow pipes with MS frame and cover (16 G sheet), Hot Dip Galvanized puddle flanges (1 m length) as per
drawings/specifications, including accessories: MS manhole frame & cover with locking (600×600 mm), inlet/outlet puddle flanges (65–
150 mm dia.), vent pipes (100 mm dia.) with mesh, overflow pipes (50 mm dia.), aluminum step ladders (450 mm wide), PVC rungs, drain
pipe puddle flange (50 mm dia.), and sleeves for level controllers (50 mm dia.). All work complete as per drawings, specifications, and
Project Manager’s instructions. Manhole cover will be under client scope only. Other sleeves puddle flanges & other will be under
contractor scope.
 Dismantling of Concrete/RCC and Masonry: Breaking or dismantling of concrete/RCC members and brick/block masonry at any level by
manual or mechanical means, including cutting reinforcement, removal of debris outside the premises, and making good any accidental
damage to adjoining structures at contractor’s cost. Excludes defective work due to contractor’s faulty construction or temporary structures
for his convenience. No extra claim shall be allowed for the method of dismantling.
 Base preparation of Garden/ Amenity area; STP, OWH, RWH, DG Set, Substation, Security cabin, Gate, Soling, PCC, Compound wall(RCC
& Blockwork) of all civil work will be under contractor scope.

viii. B/W Works (Brick /Siporex Blocks/ AAC Block Masanory works:
 All AAC Blocks, its Jointing chemical / mortar and necessary tools is under contractors scope, Contractors should first get approved its
quality/ brand / make before ordering to avoid returning of materials due top improper quality standards,
 All the materials should first checked as per quality standards before unloading of any materials,
 Internal & External Brick / AAC block / Siporex block works thickness as per Drawings
 Fixing / installation of any type of door frames, with Hold fast or Coach screws is under contractors scope
 All elevations (Civil) works at any floor is under Contractor Scope of works,
 Blocks shall be fixed using Fixo Block or equivalent chemical jointing as per manufacturer’s specifications, Masanory should be done with
proper sealing of all joints at any level of works, with no gaps in joints,
 There will be 4 to 6” thk RCC band at Sill level of Wall in proper line and level
 At any stage or level wall found not in line/ Plumb and as per room sizes should be breaked and rebuilt to maintain proper room sizes as per
GFC drawings, line and level,
 Its contractors scope to install door frames in wall as per GFC drawings and maintaining sizes, line, plumb as per door schedules with proper
Clamps, hold fast and packings,
 All Door frames should be as per fire norms, fir rated.
 Its contractors scope to provide proper opening in internal & external walls for doors and windows opening as per latest GFC Architectural
doors and window schedule
 All walls should be cured properly with portable water till stipulated / sufficient time period after completion of respective masonry as well
as before proceeding to plaster works
 Bricks / AAC blocks should first soaked in water before its applications / use,
 The rate includes drilling in columns and fixing 50×4 mm flat anchors, 200 mm long, bent to shape at every fifth course,
 Providing 150mm high RCC horizontal bands with 2 nos. 8 mm dia TOR bars @ top & bottom ,with 8 mm dia links at 250 mm c/c in M20
grade cement concrete including necessary formwork.
 Vertical stiffeners of 100×100 mm or 150x150 mm according to width of wall, at corners/ mid of long wall as per engg instruction in the
wall where there is no RCC Columns for Anchor available,, with 4 nos. 10 mm dia TOR bars and 8 mm dia links at 250 mm c/c in M15
cement concrete including necessary formwork.
 The work also covers raking out joints, curing, double-legged “H” frame scaffolding, work at all heights, depths, and leads
 Providing and laying damp proof courses as specified in drawings.
 All work shall be executed to the satisfaction of the Project Manager. Plumbing line , Groove Making, Ledge wall will be under contractor
scope. (Plumbing line marking will be given by plumbing contractor). All the jamb Plaster to be done by contractor - Door, Window, any
Opening.

ix. Plaster works


 Internal 12mm thick plaster Single/double coat 1:4 in all walls & RCC surfaces excluding ceiling (ceiling to be foam finish with no
undulation/ joints marked more than 1mm, If ceiling of any slab / floor/ flat is not upto the mark or quality standars then as per clients
respective engg instruction need to plaster or any remedies on it in free of cost)
 External avg. 15mm thk Double coat water proofed plaster 1:4 with Scaffolding,
 All RCC surface to be properly hacked as per standards
 Internal & External Cement Plaster (Single /Double Coat, 12mm–20 mm): Providing and applying 12–20 mm thick Single /double coat
cement plaster with approved polypropylene fibers and approved waterproofing chemical , base coat 10–12 mm in 1:4 cement:sand, top coat
8–10 mm in 1:3 cement:sand, finished to sand face or specified architectural finish.
 Includes hacking concrete surfaces, applying chemical bonding agent, scratch/dash coat, curing, racking out junctions, pointing/grouting with
non-shrink mortar, pressing square-cut stones, fixing PVC fiber mesh 150 mm wide at junctions, sills, grooves, drip moulds, pattas, wattas,
rounding corners, and finishing smooth.
 Rate includes sand screening/washing, scaffolding (H-frame or movable platform) at all heights/levels/leads, mixer use, green fiber cloth
around perimeter for protection, and all related work as per drawings, specifications, and Project Manager’s directions.
 With proper-approval and method statement Readymade plaster can be used,
 Double coat Water proofed plaster in all ducts and outer face of the buildings with water proofing compound
 Gypsum Plaster: Providing and applying 6 mm thick gypsum plaster on Ceiling/ RCC surface using gypsum of approved make, finished
smooth in line & levels including hacking of RCC surfaces and curing, application of bonding agents on RCC surface, all lead and lifts
including scaffolding as specified,
 All complete to the satisfaction of the Owner or Owner's Representative. (At all floor Levels)-Make: - Sait Gobain- Gyproc or equivalent.

x. Safety (HSE):
 All Statutory compliance shall be followed on site as per the statutory rules and regulations i.e. attendance register, drinking water facility
area, Doctor Visit register, Pest control, toilets, etc.
 In General, in respect of all labour directly or indirectly employed in the work for the performance of contractor's part of the contract, the
contractor shall comply with all the rules framed by the Government authorities concerned from time to time for protection of the health and
welfare of the workers.
 All safety precautions shall be taken by the contractor including fixing of Brackets, verticle and horizontal safety nets with walkway
platforms at each floor levels.
 You shall provide safety measures to your workmen, Client staff, visitors and passerby.
 Personal protective Equipment’s should be supplied and maintained by the contractor and should be as per the approved PPE specification to
be approved by site i.e Wearing helmets, safety shoes, safety jackets, life belts are compulsory for your workmen.
 Safety Horizontal catch (Garware Triple Layered Safety Net EN Grade) net will be installed at every 4 slab where block work, plastering and
other external activities in progress.
 All materials required for installation of safety equipment and fixing of same will be bought by you & all safety precautions shall be taken by
contractor.
 You shall be responsible for any endanger to the extent of death caused to your workmen, staff and others due to falling of materials of your
work from higher level and also fall of workmen & staff from a height due to negligence or by accident.
 We shall not be held responsible for any claims arising out of damage/loss/injury of whatsoever nature to any workmen of yours during
execution of works at site.
 MS Pipe Hard Barrication on every opening as per instruction from project in charge.
 Installation of M.S. Shade with required M.S. supporting materials will be installed all open ducts, lift wells Barricated Pathways etc at every
Slab.
 Daily Safety TBT, Safety trainings, mock drills etc will be carried out from time to time.
 Safety Signages will be installed wherever required.
 ID cards along with contact details and police verification of each labour will be maintained in hard copy at client’s office in proper security.
 If an issues legal, political, criminal, fraud etc is found regarding the labours you will be held responsible for same.
 In addition to the liability imposed by law upon the contractor for any injury (including death) to persons or damage to property by reason of
negligence of the contractor or his agents, which liability is not impaired otherwise affected hereby, the contractor assumes liability for and
agrees to save the Developer and engineer, including their employees, officers, servants, agents and any other person moving in the premises
harmless and indemnifies them from every expese, liability or adjustment by reason of any injury (including death) to persons or damage to
property suffered through any act or omission of the contractor, his employees, agents, servants, workmen, suppliers or any of his sub-
contractors, or persons directly or indirectly employed by any of them or from the conditions of the site or any part of the site which is in the
control of the contractor or his employees of any of his sub- contractors, or any one directly or indirectly employed by either of them and or
arising in way from the contract between the Developer and the contractor. The contract is in on principle - to principle basis.
 All required tools and tackles must be arranged by you. Fitness certificate & TPI of all mechanical equipment’s will be submitted by you
from time to time. The contractor shall provide and install all necessary ladders, scaffolding, tools, tackles, all transport for labour materials,
Plant and machinery necessary for the proper carrying on execution and completion of the work to the satisfaction of the architect.

xi. Hygiene:
Contractor must keep their work place clean and maintain all the times. Contractor shall dispose the waste, debris etc on daily basis, failing
Developer will arrange on contractor behalf & cost will be debited to contractor. Debris chute/location shall be erected by contractor to
remove all debris from the Building.
 Covering surface of building with green Net for escaping dust in air as per BMC norms.
 Regular body checkup of labours and working staff on site shall be done, doctor shall be appointed & weekly site visit made by him, proper
record to be maintained by contractor. Maleria precautions as well as pest control treatment shall be done by contractor, Daily mosquitoes
fogging, removing of stagnant water to be removed, daily dewatering of basement and pit areas will be carried out. If any notice is issued
from PCO for same, you will be held responsible for same. Any Penalty will be recovered from your bill.
 All rules related to BMC for controlling of pollution & dust will be followed as per current circular & updated from time to time e.g covering
of material vehicles, cleaning of tyres, cleaning of roads, Fixing of green agro nets on windows and all open areas, operation of mist Fans,
sprinklers etc.
 No space will be provided for labour camps as per availabe site conditions, making of labour hutments, drinking water facility, sanitation,
canteen, pest control etc will be in the scope of the contractor. All materials with labour required for erection, dismantling of labour camp
including all types of surface prepariation shall be in contractor's scope with cost including all internal safety provision, electrical connection,
daily housekeeping with its consumables, camp boss for maintaince etc is included in scope of work.
 The proposed location of all huts i.e. labour camp and other temporary structures shall be submitted by the Contractor and
approved by the Site Incharge. All sheds are to be located within the compound. All Statutory facilities like sanitation, canteen, drinking
water, bathing, cooking, entertainment etc will be arranged and maintained by you-
 The site and labour camp must be kept clean, tidy and in an orderly condition at all times. The Contractor on a daily basis shall thoroughly
clean all surfaces, eradicate stains and splashes.
 It is expected to provide Labour Toilet / Urinals at every 3rd floor level of the residential under construction buildings by providing proper
sanitary drain line, cleaning & Maintenance of same will be carried out by contractor including its consumables. No any labour should
spread unhygienic at any floor any level stage of buildings,
xii. Compliances:
 Rate to be inclusive of PF, ESIC, insurance, Workmen compensation policy, Labour licence, BOCW, MLWF, labour welfare and all
applicable statutory compliances & taxes but excluding GST which shall be payable extra as applicable .(All related documents current +
renewed shall be submitted to the client as per the staturoty compliances). Any new statutory taxes imposed during the pendency of the
contract shall be deducted from the bills of the contractor.
 The contractor shall be wholly and solely responsible for full compliance with the provisions under all labour laws and /or regulations such
as Payment of Wages Act 1948, Employees Liability Act 1938, Workmen's compensation Act 1923, Employees State Insurance Act 1948,
Employees Provident Fund Act 1952, Industrial Disputes Act 1947, the Maternity Benefit Act 1961, the Contract Labour (Regulation and
Abolition) Act 1970 and the Factories Act 1948 or any modifications thereof or any other law relating thereto and rules there under
introduced from time to time.
 The contractor shall at his own cost obtain a valid license for himself and the Client / Principal Developer under the Contract Labour
(Regulation and Abolition) Act 1970 and the Contract labour (Regulation and Abolition) Central Rules 1971 and under any other applicable
rules before the commencement of the work and continue to have a valid license until the completion of the work.
 The contractor shall pay to labour employed by him either directly or through Contractors wages not less than fair wages as defined in the
relevant Central / Local Labour Regulations or as per the provisions of the Contract Labour (Regulation and Abolition) Act 1970 and the
Contract Labour Regulation and Abolition of Central Rules 1971, wherever applicable.

2) Area Statement / Mode of measurement:


 100% area for every floor including staircase, passages, lobby, entrance lobby etc at any floor,
 50% area for any Chajja, Flower Bed, Pergola, Balcony etc. at any floors if its width more than 1.5mtr, no any area considered in
built up area calculation if width of said is less than or equal to 1.5 mtr.
 No extra area for Chajja, Flower Bed, Pergola, Balcony width up to 1.5mtr
 No extra area for any elevational features
 No any extra area or percentage for floor any floor rise / height,
 No any additional / extra area for ground preparation or area surrounding ground levelling, paving, etc. up to 5mtr surrounding
buildings periphery/ till compound wall and at entrance lobby, Porch.
 Floor area (Horizontal) for both lift and Tower Parking will count 100% in built-up area, Contractor has to construct it’s all sides
RCC Share wall / retaining wall as per GFC drawings and schedule free of cost no additional extra cost for its RCC wall,
 No area consideration / count in Builtup area calculation for underground water tank, pump room, lift pit, parking tower pit etc.
 Terrace area will not counted in Built-up area calculation.
 All Opening, Ducts for LT, HT, LV, sanitary / service duct , fire duct etc will not count in area calculation / will not consider in Built-
up area calculation excluding openings for Tower parking, and both lifts

3) Billing Terms:-
 Till the completion of First Floor Client will provide & Supply Steel and RMC, cost of the required Steel & RMC up to the first floor
completion will be deducted from contractor’s running bill, Till the completion of 1 st floor No any payment will be made to contractor , its
contractor responsibility to manage labour cost and other miscellaneous cost excluding cost of Steel & RMC concrete, (As discussed in 1 st
meeting Developer will manage RMC, And Steel till the first floor slab completion and Developer will Pay “Eleven lakhs Rupees” (11 lakhs)
in between Start of works to completion of first floor, its contractors responsibility to manage all works like excavation, execution of RCC,
labours and materials and other works till completion of first slab , after first slab contractor will raise regular bill as per billing cycle.

 Monthly bill submission shall be done as per progressive work completion with relevant certification from site engineer & quality
department.
 All RA bills shall be submitted along with site certificates and measurement sheets certified by Developers site incharge / billing Engineer /
QC Department with relevant documentations, check lists and work scope.
 The Contractor would be bound to execute such additional item / items which may be essential & necessary (even though not listed in
schedule of items / scope of work) for the effective execution of the work, Shall be executed only after written confirmation from client
respective Project manager, Rates for such items of work shall be rationally analysed / derived & would be binding on the Contractor. Extra
items subjected to approval, if any shall be charged at actual + 10% which includes overheads and profits.
 Final bill shall be cleared after steel, Binding wire, concrete and other free issue materials quantity and total quality audit and reconciliation.
Reconciliation shall be submitted along with each bills for Steel & Concrete.
 No Idle charges for machinery & labour shall be paid
 Any extra work done due to minor changes in the drawings & also due to requirement of any statutory body shall be carried out without any
disputes or claims
 Material indent if any shall be raised well in advance before starting of the activity considering the lead time.
 A Penalty of 0.5% of the Contract Value per week for each delayed week will be imposed if the work is found delayed from Contractor’s
side, limited up to a maximum of 5% of the total Work Order Value. In addition, any liability under RERA on account of delay in
completion of the project shall be entirely upon the Contractor.
 The contractor is responsible for arranging a sub-meter for their own work, while electricity and water will be provided by Client free of
cost. The client will provide water and bore water. However, if there is a shortfall in water supply or additional water is needed, the
contractor must arrange for tanker water at their own expense without any extra claims. Additionally, the maintenance of the bore pump and
the distribution of the plumbing lines fall under the contractor's scope. The contractor is also responsible for the distribution of electricity and
the maintenance of the electricity meter
4) Taxes Duties etc.
Rate is Exclusive of any Taxes and duties, All taxes, GST will be applicable additional as per law,

5) Bonus & Penalty Clause:


 If the work is delayed then a penalty of Rs. 25,000/- per day shall be levied subjected to maximum of 5% of Contract Value.
Work should be considered as delay beyond 9 month from the date of start of Excavation (Excluding no’s of days hold from clients due to
particular reasons, and non-availability of any valid approval, Days hold due to contractors issues will not be counted / considered)
 Bonus on successful completion of work before agreed time frame: On Successful completion of work within the agreed program a bonus of
Rs 9 per [Link] of Built-up Area shall be awarded The Period for early completion shall be calculated with reference to the date of actual
completion of the entire Construction schedule.
 Project Completion Period in All aspect will be 7months from the date of start of Excavation (Excluding no’s of days hold from clients
due to particular reasons, and non-availability of any valid approval, No’s Days hold due to contractors issues will not be counted /
considered)
Penalty for not following Safety & Quality,
In Case default of below all incidents, The Project-In-Charge shall give three (3) warnings to the contractor; in case any of the above points
are violated, after which the below-mentioned penalties shall be imposed.
 Failure to wear Personal Protective Equipment (PPE) e.g. Safety helmets, googles etc, safety belt, safety shoes, jackets Penalty of- Rs 5,000
( Each time ) per person dis obeying Following of PPE per day
 Deployment of Child Labour: Penalty of- Rs. 10,000 ( Each time )
 Deployment of Deaf or Dumb: Penalty of- Rs 2,000 ( Each time )
 Housekeeping not maintained at site to the satisfaction of Project-In-Charge: Penalty of- Rs 5,000 per day till completion of Housekeeping
(Each time) Penalty will impose after 2 warning.
 Damage or misuse of the clients Property Penalty of Rs 10,000 ( Each time )
 Any Fatal Accident during working time: As a Penalty ₹50000 per incident/ accident or more as per conditions or Contract get
Termination.
 Quality Deviation beyond 12mm : Penalty Cost of re-work + 5000/Rs

6) Defect Liability Period:-


 Defect Liability period shall be period between the virtual completion and the final completion of the works and during which period, the
Contractor shall be bound to replace and or rectify and make good all defective materials/ workmanship, it will be 24 month after the date
of handover.

7) Main Scope Of Works:-


 This Contract is Contract with all labors, Shutterings, supportings, excavations, waterproofing and all required constructions materials, (Like
Steel, RMC, tools tackles and machineries required for Civil execution works,
 Full Paving / ground finishes (As per drawings)
 All Civil Works including RCC, Brick / Siporex (Light weight / AAC) block works, Plaster, elevation is under Contractor Scope of works,
 Construction of Underground & Overhead water TANK, Fire Tank as per drawing or client instruction is under Contractor Scope of works
 Contractor has to keep sufficient manpower with responsible senior staff /engineer to achieve target as per requirement of the client.
 Any Miss-use of water and electricity will be charged.
 All elevations (Civil) works at any floor is under Contractor Scope of works,
 Steel and Cement wastage beyond allowable limit shall be debited from Bill,
 Contractor has to unload material in premises only with necessary housekeeping and cleaning, all materials should stacked properly without
blocking access / pathway,
 Daily housekeeping to be maintained and all construction area should be neat and cleaned,
 All workmen’s should be in proper safety with basic PPE like safety helmet, shoes, jacket and full body harness for height more than 1.2mtr
works, Proper Electrician for electric related work, Industrial Male female plug top and Industrial Distribution board for usage and
connection of Electrical equipment,
 Site should be neat and clean at any stage of works,
 Requirements for materials order to be place before 10days prior to execution of works,
 All Safety precautions for surrounding premises and working area for labour is under Contractor Scope
 It is Contractors responsibility to execute the work as per Architectural and RCC Drawings and good workmanship and alignment of the
works
 Poor workmanship and alignment undulations, honeycomb concrete, bulging of concrete, dis line, dis-plumb of any member shall not be
accepted, Contractor has to repair/remove such type of work at his own cost (Material required for same above allowable limit will be
debited from your bill amount)
 Contractor has to deploy Labour for unloading of materials wherever required in free of cost.
 All civil related debris and scrap should be removed from buildings and stacked at a particular stated place so as to remove same from site,
 All Steel Scrap (Rezas), Steel bangles etc should properly stacked separately dia vise,
 All construction materials like shuttering, ply board, sand, crushed sand, cements, steel, aggregates, RMC, waterproofing chemicals, door
frames, jali, chicken mesh, safety net, etc all to be first approved from client, every time if brand and specifications get changed need to
approved from client then only respective material will be ordered and execute in site, if any material without prior approval brought in site
or used in site will be return back any damage or cost and expense born due to same will be bared by contractor only

8) Contract obligation towards material supplied by developer

Any materials supplied by the Developer for incorporation in the works shall be properly taken care of by the Contractor.
 It shall be the responsibility of the Contractor to accurately schedule such material in terms of quantities and time / periods of requirement.
 The contractor shall do everything required to check and inspect the materials for quality, size, and other requirements
 The contractor shall receive the materials at site, unload and stack properly and separately in his stores.
 Any damage caused to the material during unloading and storing operation shall be to contractors account.
 It shall be the responsibility of the contractor to inspect verify all the items supplied by the Developer and satisfy himself as to the
acceptability of the materials and certify that the materials have been received in good condition.

9) Co-ordination with Other contractor & Agencies:


 The Contractor during the execution of the works shall co-ordinate with other contractors and other agencies associated with the project and
shall work in harmony with them without causing any hindrance or obstruction to the progress of their work in any way.
 In respect of the work of other contractors and agencies, where the commencement or progress of such work of any other contractor, or
agency, is dependent upon the completion of particular portions of the contractor work or generally upon the contractor maintaining progress
in accordance with the approved coordinate construction Programmed, it shall be the responsibility of the Contractor to complete with such
portions and maintain such progress.

10) Protection of Works:


The Contractor shall take total responsibility for the proper care and protection of the works. The Contractor shall at his cost protect and
preserve the works in every way from any damage, theft or accident by taking adequate measures as required by the Engineer-in-charge.
11) Labour Policies :
 The Contractor shall comply with all rules, regulations and laws including but not limited to Contract Labour Abolition Act, Minimum
Wages Act, ESI, P.F.,
 Medical and safety of workmen for labour directly or indirectly engaged by the Contractor, his representative and sub
Contractors.
 The Contractor at his own cost shall register himself with wherever and whom so ever required in this connection at local and state level.
 For extra items contractor shall get the instruction confirmed in writing from Engineer-in Charge before executing the work and keep proper
record of same.
 The contractor shall get confirmed in writing, any verbal instruction by Engineer-in Charge for executing the work or any extra items before
execution.
 The decision of Developer / Project manager regarding rate of extra items shall be final and binding on contractor.

12) Retention Amount:


5% of gross certificate amount will be deducted from each running bill and 50% retention amount will be paid after virtual completion of
work & balance 50% after the defect liability period of 24 months. The retention money amount shall not bear any interest. If Contractor
fail to comply with their duties / obligation during period of Defect Liability Period, Engineer-in Charge has power to depute any other
agencies to replace and/or rectify and make good any defective materials, items, part or accessory and/or workmanship and cost incurred
towards same shall be adjusted as per actual plus 10% towards Developer overhead /supervision charges from contractors.

13) Virtual Completion Of works:


The work shall be considered as virtually complete only after the works have been completed in every respect in conformity with the
contract documents, after all rectification called for have been satisfactory attended to and when the Engineer-in-charge shall certified in
writing that the works are virtually completed. The Defect Liability Period shall commence from the date of such certificate.

14) Contractor’s Staff & responsibilty:-


 The Contractor at his own cost and expense provide and ensure effective supervision of their works with the help of qualified , experienced
and competent engineer/staff , Surveyor assisted by adequate technical staff, to the satisfaction of the Engineer-in-charge, for the entire
duration of the works,
 The Contractor at his own cost and expenses provide Surveyor for proper marking, alignment, setting out of Buldings, marking, Casting
Columns in its proper positions, Slab & Beams levels to be perfect as per mentioned in dwgs, with manual conventional method as well as
cross check with Surveying by Total Station, Its Contractor’s responsibility to construct complete building as per Setting Out Plan,
Maintain Proper Open Spaces as mentioned in Drawings, Maintain Height etc. so as to pass and get Approval; from Architect & Govt.
agencies.
 Any Deviation due to which get rejected in any approval or not as per up to the mark of Architect / Developers will leads to re-construction
of works free of Cost without any Charge or material cost,
 If Contractor had doubt or query in stage of works should bring under notice of developer to avoid delay & repair of said works,
 The contractor shall at his entire cost be solely liable and responsible for the safety and security of the materials/ items, including those
supplied by the Developer, to the satisfaction of the Engineer-in-charge,
 The contractor shall at all times be solely and fully responsible for the security of all the material sand items, accessory on site, whether his
own or those supplied by the Developer
 Proper Entry and end Exit Gate pass of any materials either your own or Clients to be signed by Client representative and all records should
be maintained with date and time mentioned in it,

15) General conditions of works:-


 Any changes in Architect drawings, RCC drawings in future no extra charge shall be paid
 Concrete cube to be cast for every minor or major casting on site, testing of same to be done in approved Lab free of cost by contractor,
 Dewatering is in contractors scope for his works,
 Recharge pit / RWH Tank of whatever capacity if required will be constructed by Contractor free of cost,
 All Shuttering materials should be in well conditions, Shuttering ply / Mione shuttering plates / MS Boards to be used for any kind of
shuttering of columns, share walls, retaining walls, Approved quality Shuttering ply board shall be used for beams & Slabs etc, All Props
should be in MS , MS Span, H Frames required, no 100% wooden Props,
 Providing Plumbing or electrical sleeves in column/ beams or slab is under contractors scope, (Electrical conduiting work for slab will be
done by electrical contractor)
 Proper Cutout and its repairing if any under contractors scope
 Chicken Mash at every masonary and RCC Joints, on Electrical/ plumbing conduit area is under contractor’s scope, (Contractor should
purchase Approved quality of Chicken mash in his own cost)
 Required materials to be ordered and stocked in advance to avoid any delay of work due to material shortages,

16) Workmen Compensation Policy:


Contractor shall provide for adequate cover to his employees as per provisions of Workmen's Compensation Act.

17) Quantity:
 Contractor need to submit detailed BBS before cutting and bending of reinforcement of particular activity, After checking and approval start
cutting & bending of Reinforcement.
 Before casting any structural member such as Column, Beams, Slab, tie beam, plinth beam, share wall, Retaining wall, Contractor need to
submit Pour card along with Checklist of Reinforcement, Shuttering and concreting with mentioning qty of respective item and
reconciliation,
 Post Pour checklist and checking to be done before proceeding to next work , such as Casted Columns to be Checked before Beam’s bottom
shuttering, Slab’s levels, beams measurements, line and levels to be checked after de-shuttering of previous slab,

18) Technical Specifications:


 Concrete: Site-mix as per IS 456-2000 (Grades as per Structural drawings).
 Formwork: Conventional shuttering (Standard approved new Ply board, Mione, MS Shutterings, supportings) with zero tolerance for
deviations (>12mm rework at contractor’s cost).
 Safety: Compliance with NBC 2016; PPE mandatory for all workers.
 Quality Control: Pre- and post-pour checklists signed by the developer’s representative.
 Material testing reports for aggregates, sand, Crushed Sand, Cement, Cubes, Steel, cover blocks, water, Brick / Siporex block s, Blocks,
Siporex/AAC blocks, Concrete Mix design, RMC etc

19) Clients Scope:


 Bringing of Necessary Approval like CC, Debris Management, Storm water Drain and other Necessary Approval is under Client Scope
 RMC & Steel till the completion of Plinth will be bring by the Client Amount of the Same will be Deducted from the Bill
 Electric Connection And Water for Drinking & Construction at one point of Site is Under Client Scope
 Finishing works like tiling, Painting etc Electrical works, Plumbing works etc
 Invite Architect , RCC Consultant, Govt Agencies for Setting out checking, Checking of any part of the buildings, Slab, All floor slabs
reinforcement checking etc is Client scope
 GFC Dwg & Supervision will be provided by client.

20) Base Rate:


Work contract is with Material Contract with following base rates of the materials excluding GST, due to Market fluctuation if rate increases
by 10% + & - then accordingly escalation of rate beyond +& - 10 % will be bared & provided by client & vice versa,

21) Termination Clause (From Developer Side)


 Right to Terminate: The Developer reserves the right to terminate this Contract, in whole or in part, at any stage of the project by giving 30
days’ written notice to the Contractor, without assigning any reason.
 Termination for Default: The Developer may terminate the Contract immediately if the Contractor:
 a) Fails to mobilize adequate manpower, machinery, or materials as per the approved schedule;
 b) Delays the progress of work beyond acceptable limits;
 c) Executes substandard or non-conforming work;
 d) Violates safety, quality, statutory, or site regulations;
 e) Fails to rectify defects within the stipulated time despite notice;
 f) Engages in misconduct, fraudulent practices, or breach of contract terms.
 In such case, the Contractor will be entitled only to payment for:
 Work completed up to the date of termination,
 Approved materials at site (MAS),
 No claim shall be entertained towards loss of profit, demobilization cost, idle labour, machinery, or any consequential damages.
 Final Measurement & Settlement: Upon termination, joint measurement will be carried out within 7 days, and final payment will be released
after deducting: Advances, Penalties, Damages, and Cost for rectification or completion of balance work through alternate agency.
 Handing Over & Documentation: The Contractor shall immediately demobilize labour and machinery, clear debris, remove temporary
structures, and hand over site, drawings, materials, tools, and records to the Developer in good condition.
 Developer’s Right to Get Work Done: In case of termination due to Contractor’s default, the Developer is entitled to execute the remaining
work through another agency at the risk and cost of the Contractor. Any excess cost shall be recovered from the Contractor’s bills, retention
money, or security deposit.
 Similarly if Contractor’s Right to Terminate:
 The Contractor shall have the right to terminate this Contract by giving 30 days’ prior written notice to the Developer, Developers Decision
will be the final decision.
 Arbitration Clause (Compliant with Indian Arbitration & Conciliation Act, 1996 and Amendments- Mumbai, Maharashtra State )
 Dispute Resolution: Any dispute, claim, or disagreement arising out of or relating to this Contract, including interpretation or termination,
shall first be attempted to be resolved mutually within 30 days from written notice
 If the dispute remains unresolved, the same shall be referred to sole arbitration of an independent arbitrator mutually appointed by both
Parties. Venue: Mumbai (or project location)
 Arbitration Type: Fast-track procedure (if mutually agreed)
 The Arbitrator’s decision shall be final and binding on both Parties.
