Human rights are fundamental rights and freedoms which humans are entitled to by the fact
of being human beings. These rights are not created or abrigated by any person and all human are
entitled to claim such rights. Thus these rights are inherent and therefore should be recognised,
respected, and enforced by the law. As we see In the case of Rev. Mtikila v. Attorney General [1995)
T.L.R 31 it was held that Fundamental rights are not gifts from the State. They inherent in a person by
reason of his birth and are therefore prior to the State and the Law. There are different instrument or
statutes which recognize human rights in the world, example The universal Declaration of Human
Rights was adopted by the general Assembly in 10, December 1948. This declaration it contributes
much on significance in the development of human rights in the world as following:
The universal declaration it recognize the nature of human rights; Through preamble of the
declaration state that "whereas recognition of the inherent dignity and of the equal and Inalienable
rights of all members of the human family is the foundation of freedom, justice and peace in the world".
So through the preamble recognize the nature of human rights that are inherent which means that
human rights are acquired naturally for everyone by reason his birth, so all human rights a person is
born withem and are not the gifts from the State and can not be given by anyone According to article 1
of the declaration state that "All human beings are born free and equal in dignity and rights. They are
res endowed with reason and conscience that human rights are inalienable which means that can not be
taken away or can not be granted by any person.
lt recognize the equality and dignity. this is the one of the significance because every people
has right to be protected of his dignity because all people are equal in the world this is provided under
Article 1 of The niversal Declaration of Human Rights 1948 since the discrmination is not needed to
criticize the reason either through his color, sex or religion so under that stuationn since those countries
Which ratify this Instrument they are aware to be recognize that they are needed to protect their people
against any kind of discrimination and they must make sure that all people are treated equally and this
helped on the developmnent of human rights in the world where diferent countries they are not
inconsistent with this laws when they enact their laws so they're supposed to refer some rights which
are provided by this international instrument or this Declaration and among of those declaration is the
universal declaration of 1948.
The universal declaration is articulation and recognition that human rights and freedoms; so
there too many recognition under the declaration which contribute to articulation and recognition of
different human rights and freedoms against human beings in foundation of justice, freedom, social
progress and better standards of life and peace in the world. So the declaration it has provided the
articles for those human rights and freedoms which are recognized such as right to life; liberty and
security of person, in article 3, prohibition of torture and of cruel, unhuman, and degrading treatment or
punishment, in article 5, prohibition of arbitrary arrest, in article 9, right to a fair trial, in article 10, right
to be presumed innocent until proved otherwise, in article 11, right to equality before the law,
recognition and respect for human dignity as per article 1, but these are few of them and the declaration
it has provided 30 articles dealing with human rights. So any person interfere with human rights will be
liable to punishment as the constitution states that all people we are born free, means that we are all
equal. That is why also the constitution states that no body is above the law which could make us to not
enterfere with person human right.
The universal declaration has contribute on establishing international legal document; The
declaration it facilitated in establishing international legal document such as the international Covenant
on Economic, Social and Cultural Rights which was of 1966, this covenant it aimed at protecting among
other rights, like the right to work, reasonable conditions of employment, trade union, social security
and insurance, protection of families and children, an adequate standard living, health, education and
Cultural life. Another is the International Covenant on Civil and political Rights, 1966: this covenant
contains the details of the basic political and civil rights of the individual. It also provides for the
prohibition of imprisonment for failure to fulfill a contractual obligation which it could lead to
infringement of human rights due such aim the procedures should be followed against a person who
fails to fulfill the contractual obligations.
Generally, the universal declaration of human rights in development of human rights it
contributed so much on the promotion and developing of human rights in the world. so it is very
important to the development of the rights of human being and to those countries Which does not
ratify they should ratify because they will archive different rights which will help their country in
different aspects of human rights.
