Judicial Interpretation in Whistleblowing Protection Act :
An examination of the Lokpal’s Role
The WhistleBlowers Protection Act, 2014, aims to safeguard individuals exposing corruption
and misconduct in public offices. However, judicial interpretation plays a crucial role in shaping
its effectiveness. “How has judicial interpretation influenced the effectiveness of the
WhistleBlowers Protection Act, 2014, in shaping the Lokpal’s role in safeguarding
whistleblowers and addressing corruption in India?” This study seeks to examine how courts
have interpreted key provisions of the Act, particularly in cases involving the Lokpal, India’s
apex anti-corruption body.
The research will analyze landmark judgments to assess the judiciary’s approach toward
balancing whistleblowers’ rights with concerns of national security and misuse. It will also
evaluate the extent of Lokpal’s powers in handling complaints and ensuring protection. By
exploring legal ambiguities and judicial precedents, the study aims to determine whether the
Lokpal’s role has been strengthened or limited through judicial interpretation. The findings will
contribute to understanding the Act’s efficacy in fostering transparency and accountability while
addressing the challenges faced by whistleblowers in India.
