SERVICE RECRUITMENT RULES, 2013
PREAMBLE
In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India the Governor
of Madhya Pradesh hereby makes the following rules relating to the recruitment and promotion in the
"Madhya Pradesh Police Library Service, namely:

Rule - 1. Short title and Commencement.


(1) These rules may be called the Madhya Pradesh Police Library (Class III Non-Ministerial) Service
Recruitment Rules, 2013.

(2) They shall come into force from the date of their publication in the Madhya Pradesh Gazette.

Rule - 2. Definitions.
In these rules unless the context otherwise requires,

(a) "Appointing Authority" in respect of the Service, means the authority as specified in Schedule-1;

(b) "Committee" means the selection Committee/Departmental Promotion Committee;

(c) "Examination" means the competitive examination conducted under rule 11 of these rules;

(d) "Government" means the Government of Madhya Pradesh;

(e) "Governor" means the Governor of Madhya Pradesh;

(f) "Schedule" means the Schedules appended to these rules;

(g) "Scheduled Castes" means any caste, race or tribe or part of or group within a caste, race, tribe
specified as Scheduled Castes with respect to the State of Madhya Pradesh under Article 341 of the
Constitution of India;

(h) "Scheduled Tribes" means any tribe, tribal community or part of or group within a tribe, tribal
community specified as Scheduled Tribes with respect to the State of Madhya Pradesh under Article 342 of
the Constitution of India;

(i) "Other Backward Classes" means the Other Backward Classes of citizens as specified by the State
Government vide Notification number-F-8-5-XXV-4-84, dated 26th December, 1984 as amended from time to
time.

(j) "Service" means the Madhya Pradesh Police Library (Class III Non-Ministerial Service.

(k) "State" means the State of Madhya Pradesh.

Rule - 3. Scope and Application.


Without prejudice to the generality of the provisions contained in the Madhya Pradesh Civil Services
(General Conditions of Services) Rules, 1961, these rules shall apply to every member of the service.

Rule - 4. Constitution of the Service.

The Service shall consist of the following persons, namely:

(1) Persons, who at the commencement of these rules are holding in an officiating capacity or
substantively the post specified in Schedule-I;

(2) Persons recruited to the service before the commencement of these rules; and

(3) Persons recruited to the service in accordance with the provisions of these rules.

Rule - 5. Classification, Scale of pay etc.


The classification of Service, the number of the posts included in the Service and the scale of pay
attached thereto shall be as specified in Schedule I:

Provided that the Government may, from time to time, add or reduce the number of the posts included in
the Service either on a permanent or temporary basis.

Rule - 6. Method of Recruitment.


(1) Recruitment to the Service, after the commencement of these rules, shall be made by the following
methods, namely:

(a) By direct recruitment, by selection through competitive examination, by interview or both;

(b) By promotion of such members of Service, as shown in column (2) of Schedule-IV;

(c) By transfer or Deputation or absorption of persons appointed to the Specified posts in Specified
Services.

(2) The number of persons recruited under clause (b) or clause (c) of sub-rule (1) shall not at any time
exceed the percentage mentioned in Schedule-II of the number of posts as specified in Schedule-I.

(3) Subject to the provisions of these rules, the method or methods for the purpose of filling any vacancy
or vacancies in the service as may be required to be filled during any particular period of recrutment and
the number of persons to be recruited by each method, shall be determined by the appointing authority in
consultation with the Government.

(4) Notwithstanding anything contained in sub-rule (1), if in the opinion of the appointing authority, the
exigencies of the Service so require, the appointing authority may, after approval of the Government in
the General Administrative Department, adopt such methods recruitment to the service, other than those
specified in the said sub-rule, as it may, by order issued in this behalf, prescribe.

Rule - 7. Appointment to the Service.


All appointments to the Service after coming into force of these rules shall be made by appointing
authority and no such appointment shall be made except after by one the methods of recruitment
specified in Rule 6.

Rule - 8. Conditions of eligibility for direct recruitments.


In order to be eligible for direct recruitment, a candidate must satisfy the following conditions, namely:

(1) Age.

(a) He must have attained the age as specified in column (4) of Schedule III and not have attained the
age as specified in column (5) of the said Schedule on the first day of January, next following the date of
commencement of the examination.

(b) The upper age limit shall be relaxable up to a maximum of 5 years if a candidate belonging to
Scheduled Caste, Scheduled Tribe.

(c) The upper age limit shall also be relaxable in respect of candidates who are or have been employees
of the Madhya Pradesh Government, to the extent and subject to the conditions specified below:

(i) A candidate, who is permanent Government Servant, should not be more than 45 years of age;

(ii) A candidate holding a post temporarily and applying for another post should not be more than 45
years of age. This concession shall also be admissible to the contingency paid employees, work charged
emplyees, and employees working in Project Implementation Committe;

(iii) A Candidate, who is retrenched Government servant shall be allowed to deduct from his age the
period of all temporary service previously rendered by him to a maximum limit of 7 years, even if it
represents more than one spell, provided that the resultant age does not exceed the upper age limit by
more than five years.

Explanation. The term "Retrenched Government Servant" denote a person, who was in temporary service
of the State or any of the constituent units for a continuous period of not less than 6 months and who
was discharged because of reduction in establishment not more than three years prior to the date of his
registration at the employment exchange or application made otherwise for employment in Government
Service.

(iv) A candidate who is an Ex-Serviceman shall be allowed to deduct from his age the period of all
defence services previously rendered by him:

Provided that the resultant age does not exceed the upper age limit by more than 3 years.

Explanation. The term "Ex-Serviceman" denotes a person, who belongs to any of the following categories
and who was employee under the Government of India, for a continuous period of not less than six
months and who was retrenched or declared surplus as a result of the recommendation of the economy
unit or due to normal reduction in establishment not more than three years before the date of his
registration at any employment exchange or application made otherwise for employment in Government
Service.

(1) Ex-Serviceman released under mustering out concessions.

(2) Ex-Serviceman recruited for the second time and who were discharged on

(a) Completion of short term engagement;

(b) Fulfilling the condition of enrolment;

(3) Ex-personnel of Madras Civil Unit;

(4) Officers (Military and Civil) discharged on completion of their contract including Short Service Regular
Commissioned Officers;

(5) Officers discharged after working for more than six months continuously against leave vacancies;

(6) Ex-Servicemen invalidated out of service;

(7) Ex-Servicemen discharged on the ground that they are unlikely to become efficient soldiers;

(8) Ex-servicemen who are medically boarded out on account of gun-shot, wounds, etc.

(d) The upper age shall be relaxable in case of women candidate in accordance with the provisions of
Madhya Pradesh Civil Services (Special provisions for appointment of Women) Rules, 1997;

(e) The general upper age limit shall be relaxable upto five years in respect of the widow, destitute and
divorced women candidates;

(f) The upper age limit shall also be relaxable upto a two years in respect of green card holder under the
Family Welfare Programme;

(g) The General upper age limit shall be relaxable upto five years is respect of awarded superior caste
partners of a couple under the inter caste marriage inceptive Programme of the Tribal, Scheduled Castes
and Backward Classes Welfare Department;

(h) The upper age limit shall be relaxed up to five years in respect of candidates holding "Vikram Award";

(i) The upper age limit shall be relaxable up to 45 years of age in respect of candidates who are
employees of Madhya Pradesh State Corporations/Boards;

(j) The upper age limit shall be relaxable up to 45 years for Home Guards and Non-commissioned officers;

(k) The upper age limit shall be relaxable to the disabled candidates, as per the orders/direction issued by
the State Government from time to time.

Note.(1) (a) Candidates who are found eligible for selection under the age concessions mentioned in rule
8(1)(c)(i) and (ii) above will not be eligible for appointment, if after submitting the application, they resign
form the service either before or after examination/selection. They will, however, continue to be eligible. If
they are retrenched from the service or post after submitting the application. In no other case will these
age limits be relaxed.

(b) Departmental candidates must obtain previous permission of their Appointing Authority to appear for
the examination/selection.

Note.(2) The total relaxed period for every category shall be such which shall not exceed the upper age
limit of 45 years. The maximum age shall be calculated in accordance with the circular No. C-3-11/12/1/3
dated 03-11-2012 and 20-11-2012.

(2) Educational Qualifications.

The candidate must possess the educational qualifications prescribed for the service as shown in Schedule-
Ill column-6.

(3) Physical Qualifications.

Candidate must have the following physical qualification:

(a) Height: 162 cms or more (for male only)

(b) 152 cms or more (for female only)

(c) Candidate should not be mentally or physically handicapped.

(d) Candidate should not have "Knock-Knee", "Flat Foot" and should not have any vision defect and should
be medically fit.

(4) Fees.

The candidates must pay the fees prescribed by the Appointing Authority.

Rule - 9. Disqualification.
(1) Any attempt on the part of candidate to obtain support for his/her candidature by means may be
treated as disqualification by the Appointing Authority for appearing in the examination/interview.

(2) No person shall be eligible for appointment to service or post, who has more than two living children,
one of whom is born on or after 26"1 January, 2001:

Provided that no candidate shall be disqualified for appointment to a Service or post, who has already one
"living child and next" delivery takes place on or after 26th January, 2001, in which two or more than two
children are born.

(3) Giving wrong information or hiding of any factual information in application form by the applicant shall
be deemed to be a disqualification, On such act the candidate shall have no right of appointment or
continue in service under the Government and his service shall be terminated forthwith by the Appointing
Authority without giving any notice.

(4) No candidates shall be eligible for appointment to a service or post, who has married before the
minimum age fixed for marriage.

(5) No candidates shall be eligible for appointment to any service or post, who has been convicted for an
offence against the women:

Provided that if case is pending in a court against him, his case, of appointment shall be kept pending till
the final decision of the Court.

Rule - 10. Appointing Authority's decision about the eligibility of candidates


should be final.
(1) The decision of the Appointing Authority regarding the eligibility of otherwise of a candidate for
admission to the examination/interview shall be final and no candidate to whom a certificate of admission
has not been issued by the Appointing Authority shall be admitted to the examination/selection/interview.

Rule - 11. Direct recruitment by competitive examination.


(1) The Competitive examination for recruitment to the service shall be held at such intervals as
Appointing Authority may, from time to time, determine.

(2) The competitive examination shall be held by the Appointing Authority in consultation with Government
from time to time.

(3) There shall be 16 percent and 20 percent reserved posts for the candidates belonging to Scheduled
Castes, Scheduled Tribes and 14 percent for Other Backward Classes at the stage of the direct recruitment
in accordance with the provisions contained in the Madhya Pradesh Lok Seva (Anusuchit Jatiyon, Anusuchit
Janjatiyon, Aur Anya Pichhda Vargon Ke Liye Arakshan) Adhiniyam, 1994 (No. 21 of 1994) and as per
orders issued by the State Government from time to time.

(4) There shall be reserved posts for women candidates, in accordance with the provision of the Madhya
Pradesh Civil Services (Special Provision for Appointment of Women) Rules, 1997.

(5) In filling the vacancies so reserved candidates who are member of the Scheduled Castes, Scheduled
Tribes and Other Backward Classes shall be considered for appointment in the order in which their names
appear in the list referred to in rule 12, irrespective of their relative rank as compared with other
candidates.

(6) Candidates belonging to the Scheduled Castes, Scheduled Tribes and Other Backward Classes
considered by the committee to be suitable for appointment to the service with due regard to the
maintenance of efficiency of administration, may be appointed to the vacancies reserved to the candidates
of the Scheduled Castes, Scheduled Tribes and Other Backward Classes, as the case may be, under sub-
rule (2).

(7) There shall be reserved posts for ex-serviceman in accordance with the direction of General
Administration Department.

(8) If sufficient number of candidates belonging to Scheduled Castes, Scheduled Tribes, and Other
Backward Classes are not available for filling all the vacancies reserved for them; without obtaining
previous approval of the Government, the remaining vacancies shall not be filled from other candidates
and the vacancies shall be reserved for candidates belonging to the Scheduled Castes, Scheduled Tribes
and Other Backward Classes for next selection.

Rule - 12. List of candidates recommended by the Appointing Authority.


(1) The Appointing Authority shall prepare and forward a list to the Government arranged in order of merit
of the candidates, who have qualified by such standard as determined by the Appointing Authority and the
candidates belonging to the Scheduled Castes, Scheduled Tribes and Other Backward Classes, who though
not qualified by that standard, and are declared by the Appointing Authority, to be suitable for
appointment to the service with due regard to the maintenance of efficiency in administration. The list
shall also be published for general information.

(2) Subject to the provisions of these rules and of the Madhya Pradesh Civil Services (General Conditions
of Service) Rules, 1961, candidates shall be considered for appointment to the available vacancies from
the list in the order in which their names appear in the list.

(3) The inclusion of the candidate's name in the select list confers no right to appointment unless the
appointing authority is satisfied after such enquiry, as may be considered necessary, that the candidate is
suitable in all respects for appointment to the service.

(4) The select list issued by the Appointing Authority shall remain valid for a period of one year from the
date of issue.

Rule - 13. Probation.


Every person directly recruited to the service shall be appointed on the probation for a period of two
years.

Rule - 14. Appointment by Promotion.


(1) There shall be constituted a Committee consisting of members mentioned in column (5) of Schedule-IV
for making a preliminary selection for promotion of eligible candidates:

Provided that if the nominated members other than the members presiding the Departmental Promotion
Committee/Screening Committee in respect of the post to be filled up by promotion do not represent the
category of Scheduled Castes or Scheduled Tribes, then one member belonging to Scheduled Caste or
Scheduled Tribes category of the same status shall be included in the promotion/screening committee.

(2) For promotion of the members of the service specified in column (2) of Schedule-IV, to the post as
specified in column (3) thereof, the eligibility of candidate, selection process and appointment by
promotion shall be in accordance with provision as specified Madhya Pradesh Public Services (Promotion)
Rules, 2002.

(3) Certification by the appointing authority.- Appointing Authority shall endorse on the promotion orders to

be issued by him a certificate to the effect that he has complied with the provisions of the Madhya
Pradesh Lok Seva (Anusuchit Jatiyon, Anusuchit Janjatiyon Aur Anya Pichhde Vargon Ke Liye Arakshan)
Adhiniyam, 1994 (No. 21 of 1994) and the Madhya Pradesh Public Services (Promotion) Rules, 2002 and
instructions issued in the light of the provisions of the said Act and rules made by the State Government
and that he has full cognizance of provisions of the said Act.

(4) The Committee shall meet at such intervals as the Appointing Authority may direct but ordinarily not
exceeding one year.

Rule - 15. Condition of eligibility for promotion.


(1) Without prejudice to the generality of the provisions of Madhya Pradesh Civil Service (General
conditions of service) rules, 1961 and Madhya Pradesh Public Services (Promotion) Rules, 2002, the
procedure for making promotions shall be in accordance with these rules only.

(2) Subject to the provisions of sub-rule (1), the Committee shall consider the cases of all persons who on
the 1st day of January of that year had completed not less than Five years of service whether
substantively or in officiating capacity on the post from which promotion is to be made as specified in
column (3) of Schedule-IV and are within the zone of consideration in accordance with the provisions of
rule 14.

Rule - 16. Preparation of list of suitable candidates.


(1) The Departmental Promotion Committee shall prepare a list of such persons who satisfy the conditions
prescribed in rule 15 and as are held by the Committee to be suitable for promotion to the service. The
list shall be sufficient to cover the vacancies anticipated on account of retirement/promotion during the
course of one year from the date of preparation of the select list.

(2) The criteria for preparation of select list shall be based on "seniority subject to fitness" as per
provisions of the Madhya Pradesh Public Services (Promotion) rules, 2002.

(3) The names of the persons included in the list shall be arranged in order of seniority in the service or
posts as specified in column (2) of Schedule-IV, at the time of preparation of each select list.

Explanation.(1) The person, whose name is included in a select list but who is not promoted during the
validity of the list, shall have no claim to seniority over those persons considered in a subsequent
selection merely by the fact of his earlier selection.

(2) The list so prepared shall be reviewed and revised every year.

(3) If in the process of selection, review or revision, it is proposed to supersede any member of the
service, the committee shall record its reasons for the proposed suppression.

Rule - 17. Select List.


(1) The Appointing Authority shall consider the list prepared by Committee along with other documents
received from the Committee and unless it considers any change necessary, approve the list.

(2) If the Appointing Authority considers it necessary to make any change in the list received from the
Committee, he shall inform the Committee of the changes proposed and after taking into account the
comments, if any, of the committee, may approve the list finally with such modifications, if any, as may
in its opinion be just and proper.

(3) The list as finally approved by the Appointing Authority shall form the select list for promotion of the
members of the service from the posts mentioned in column (2) of the Schedule-IV to the posts
mentioned in column (3) of said Schedule.

(4) The select list shall be valid for a period of 12 months from the date of approval as provided under
sub rule (3) of rule-16, but its validity shall not be extended beyond a total period of 18 months from the
date of its preparation;

Provided that in the event of a grave lapse in the conduct or performance of duties on the part of any
person included in the select list, a special review in the select list may be made at the instance of the
appointing authority and the Departmental Promotion committee may, if it thinks fit, remove the name of
such person from the select list.

Rule - 18. Appointment to the Service from Select List.


(1) Appointment of the persons included in the select list to the posts shall follow the order, in which the
names of such persons appear in the select list.

(2) It shall not ordinarily be necessary to consult the committee before the appointment of a person
whose name is included in the select list, in the service unless during the period intervening between the
inclusion of his name in the select list and the date of the proposed appointment, there occurs any
deterioration in his work which, in the opinion of the Appointing Authority is such as to render him
unsuitable for appointment to the service.

Rule - 19. Probation.


Every person appointed to the service by promotion shall be appointed on probation for a period of two
years.

Rule - 20. Interpretation.


If any question arises relating to the interpretation of these rules, it shall be referred to Government,
whose decision, thereon shall be final.

Rule - 21. Relaxation.


Nothing in these rules shall be construed to limit or abridge the powers of the Governor to deal with the
case of any person to whom these rules apply, in such manner, as may appear to it to be just and
equitable:

Provided that no case shall be dealt with in any manner less favourable to him than that provided in
these rules.

Rule - 22. Saving.


Nothing in these rules shall adversely affect the reservations and other conditions required to be made
available under the orders issued by the Government with respect to Scheduled Castes and Scheduled
Tribes and Other Backward Classes.

Rule - 23. Repeal and Saving.


All rules corresponding to these rules inforce immediately before commencement of these rules are hereby
repealed and in respect of matters covered by these rules:

Provided that any order made or action taken under rules so repealed shall be deemed to have been
made or taken under the corresponding provisions of these rules.
