Anti-Defection Laws: Subverting Democracy or Safeguarding Stability?

The central problem is whether Anti-defection laws limit the elected member’s ability to vote
and making it Anti-democratic law.

The objectives of this research work is, to assess the history of political defections after
Independence, to know about the historical background of the Anti-Defection Law,
Constitutional Provisions relating to Anti-Defection Law, Application of the Law by the
presiding officers or Deciding authority and its impact on the democratic set up, to find out
the lacunae , loop holes in the existing Anti-Defection Law in India and looking into the
foreign jurisdiction.

Through this research , I aim to justify my opinion that this law restricts intra party debate
and raising of genuine concerns or any reformation needed to any acts which should be the
characteristics of a legislation. And look into possible suggestions to make the law achieve its
objective.
