Day 1 (1-Oct-2024):
On the first day I was introduced to the team by the junior advocate and was briefed
on the tasks I need to perform. Also, was briefed on the types of cases that are dealt in
the office. I was shown the list of cases that were coming up for hearing in the next 3
weeks.
Advocate [Link] spoke to me briefly on the professional ethics that are to be
followed and its importance.
Day 2 (2-Oct-2024):
On the second day, I was given the task of typing the petition to be filed in relation to
a divorce case. The petition was to be filed by the husband under Hindu Marriage Act
u/s 13(1) (i-a). The wife had previously filed cases on the husband u/s IPC 498A and
Dowry prohibition act u/s 3 and 4. The husband got acquitted and wanted to file a
divorce case on grounds of cruelty.
The case law on which the petitioner depended was the Rani Narasimha Sastry vs
Rani Suneela Rani, where the SC observed that if the husband is acquitted in 498-A
case then cruelty has been meted out to the husband in the hands of wife.
The petition was drafted basing on the facts elicited by the husband and the
corresponding evidence was attached along with the petition. In the team discussion
the above case law was discussed and also few other cases were discussed, [Link]
VS [Link] and Ghosh vs Ghosh.
Day 3 (3-Oct-2024):
On day 3, the petition for the case discussed on day 2 completed and sent for review
with the senior advocate and also sent to the client for his review comments. Apart
from this, I was invited to join a discussion on the current status of other cases that
were due for hearing in the following week.
Apart, from the above activity I was tasked with the activity of scheduling meeting
with the clients according the calendar of senior advocate.
Day 4 (4-Oct-2024):
On the 4th day, I accompanied the senior advocate to city civil court Hyderabad for a
hearing in divorce case. The court was II additional family court, Kalpataru, and the
judge was Mrs. Christian Ann Rose. There we needed to file chief evidence on behalf
of the petitioner. In the court, I got an opportunity to observe the call sheet for the
cases and also how the court proceedings are conducted and the proceedings during
the call work.
There was also a send cause list, where the cases still in the preliminary stages are
called separately. Only cases which are ready for hearing are forwarded to the bench.
Day 5 (5-Oct-2024):
On day5, I was called in early to start reviewing the documents needed for the cases
in the coming week. The documents for each case need to be checked and placed in
order date wise, here other junior advocates also reviewed the documents. Next,
there was discussion on a case where the client wanted to find procedure regarding
filing patents. I myself being a patent agent, guided the client on filing procedure. The
senior wanted me to pursue the case further.
Day 6 (6-Oct-2024):
On day 6, I started preparing non-disclosure agreement and agreement for the client
who wanted to file an application for patent filing and got it reviewed by the senior
advocate. After making changed, sent the documents to the client. Later in the day, the
team started discussing the need for software to manage the documents and client
details.
Day 7 (7-Oct-2024):
On day 7, I accompanied the senior advocate to Medchal-Malkajgiri court complex for
a hearing in 498a and DVC case. We submitted accused statements as per CRPC 313
and the Magistrate accepted the statements. These statements are mandatory as per
the CRPC, also accuses denied all the allegations against them in the case.
The case against the accused was filed in the year 2021, as a result BNS and BNSS are
not applicable as IPC and CRPC are still applicable. In the case mentioned above the
prosecution failed to file any kind of evidence against the accused. The Magistrate
gave next date for further prosecution.
Next, we went into the administrative section of the Medchal-Malkangiri Family court
and applied for the decree copy of a previous divorce case.
Day 8 (8-Oct-2024):
On day 8, there was dictation work on a GWOP child custody case appeal to H’ble
Telangana High Court. This case was particularly interesting, because the interim
custody was granted to the father on direction form to H’ble Telangana High Court.
The family court had given orders grating custody to the father. The mother filed a set
aside petition and the Faily court closed the petition after hearing her arguments. The
father filed execution petition and contempt of court petition as the mother refused to
hand over the children.
In the meantime, the Family court judge changed and new judge assumed
responsibilities. The Judge did not execute the interim order and also denied the
custody of the children in the final decree. Now, this is a violation of the CPC and
violation of the constitutional rights of the father.
In the above case the appeal was drafted and sent to the senior for review. In, the
discussion with the team, Kundu vs Kundu case was discussed in relation to the
custody of the child given to the father. After carefully, reading all the related case
documents and evidence adduced by the parties the appeal was drafted.
Day 9 (9-Oct-2024):
On day 9, the client who wanted to file a patent with the patent office reverted back
with the signed NDA copy and agreement. We started discussing on the innovation
and technical aspects of the invention and the detailed description of the technical
aspects. Then we discussed on the filing strategy to be followed and how to handle
the questions from patent office.
Also, the client wanted to know about the international filing and the process to be
followed including the fees.
After the meeting with the client, I briefed the senior about the outcome of the
meeting.
Day 10 (10-Oct-2024):
On day 10, there was review work on a GWOP child custody case appeal to H’ble
Telangana High Court with the senior advocate. Senior gave comments on the changes
to be made to the appeal document and were duly noted by the team. Also, there was
a discussion on how to present the case in an appeal and how it would defer from the
proceeding in the trial courts. Also, I learnt that the High court and Supreme courts
were constitutional courts and a re-trial of the case will not be conducted under
ordinary circumstances and only review of the documents will be conducted.
Also, additional evidence may not be accepted by the High court under ordinary
circumstances. And the original petition cannot be amended.
Day 11 (11-Oct-2024):
On day 11, there was a discussion on the trust law and how to create a trust for
charitable purpose. Also, there was a discussion on the board members of the trust
and how to register the trust. A client had approached in order to create a trust for
the purpose of charity and wanted guidance to draft and register the trust deed.
Here, I came to know the details of the Indian Trusts Act, 1882 and how it governs
the creation and administration of the trusts in India.
Day 12 (12-Oct-2024):
On day 12, there was a dictation on an appeal to be filed in DVC case where the
interim maintenance awarded was relatively on the higher side. The petitioner was
the husband who wanted a reduction on the amount awarded in the Protection of
Women from Domestic Violence Act, 2005.
The senior had a discussion with the client on what will be prayer in the appeal and
also the evidence adduced in the lower court.
As it was a festival day, we left early for the day.
Day 13 (13-Oct-2024):
On day 13, there was a I was called in early to start reviewing the documents needed
for the cases in the coming week. The documents for each case need to be checked
and placed in order date wise, here other junior advocates also reviewed the
documents.
We discussed on the upcoming cases and the possible arguments to be presented in
court.
Day 14 (14-Oct-2024):
On day 14, I accompanied one of the junior advocates to Medchal-Malkajgiri courts.
The purpose was to file a petition for the return of the money paid for the bail bonds.
The junior advocate filed the petition and magistrate authorized the return of the bail
money. The mutually- aided society returned the money on production of bail bonds
and order from the magistrate.
Then we filed for certified copies of the FIR, Remand case diary and chargesheet in
another case and submitted in the administrative section of the senior Magistrate
court in Malkangiri.
Day 15 (15-Oct-2024):
On day 15, there was a dictation on the cross-examination questions to be asked in a
498a case. There was intense discussion on the type of questions and the anticipated
answers that can be given by the witness. The preparation was from the accused side.
There was also discussion on the leading questions that can be asked.
In the above case, there was no evidence produced by prosecution and case was filed
only by the statements made by the complainant.
Day 16 (16-Oct-2024):
On day 16, there was a steady flow of clients who wanted to meet the senior advocate
for discussion of their legal problems. I was tasked, along with junior advocates, with
talking to them and managing the crowd.
Post lunch, there was a discussion on the upcoming GWOP case in L.B Nagar court and
who will appear on behalf of the client.
Day 17 (17-Oct-2024):
On day 17, I was given the task of typing the petition to be filed in relation to a divorce
case. The petition was to be filed by the wife under Hindu Marriage Act u/s 13(1) (i-
a). This was a new case and the wife wanted to divorce the husband.
I along with a junior advocate were tasked to talk to the client and make notes and
type whatever was the version given by the client.
Day 18 (18-Oct-2024):
On day 18, I was tasked with taking print outs of the case that was due to be filed the
next day. There were four sets of copies that needed to be prepared. One for the court,
second was for the respondent, third was for the client for future reference and the
fourth was for the record purposes with in the office.
The evidence adduced was to be presented in the order mentioned in the annexure of
the petition.
