NR 35 Compliance in Workplace Safety

The document presents a multidisciplinary project on the introduction to occupational safety management. It discusses concepts of workplace accidents and analyzes the results of a survey on compliance with NR 35 in a gutter installation company, pointing out the need for more training and proper use of personal protective equipment (PPE) to minimize risks in working at heights.

SUMMARY

The present work of a qualitative and exploratory nature had as its main objective,
investigate if a small gutter and downspout installation company located in
the municipality of Palhoça, SC is implementing the recommendations of NR 35 in order to

ensure suitable working conditions and the physical integrity of its

workers. The results of the research were obtained through on-site analyses and
a checklist pointing out the main topics of NR 35. The exposed work sought

minimization of accidents and protect the health integrity of workers. From this
In this way, the study showed that it is necessary to always be seeking new things, solutions and

knowledge in the area of PPE and EPC, so that they are easy, simple and quick to
install, and that they do not stop being used in a 'quick' job or
less dangerous

1 INTRODUCTION

As for the accidents involving the fall of workers, these

they can occur in various branches of activity, such as in maintenance services and
building facade cleaning; installation of telephone, energy, and TV antenna towers
cable, lightning rods and billboards; operation of cranes and hoists; assembly of structures
various; loading and unloading in trucks and trains; storage of materials and silos; washing
and bus painting, among others. Thus, one must intervene in risky situations,
regularizing the process in general and making tasks and environments more
insurance for the worker.
The sharp growth of the construction industry, observed in recent years in
the entire country has been accompanied by an increase in the number of workplace accidents and

of worker deaths, mainly due to landslides, falls, or electric shock

which demands systematic planning of all processes and resources of a project,
from the qualification of the worker to the maintenance of the equipment.
Meanwhile, having elements that guarantee the quality of the construction is not
sufficient to ensure the quality of the execution of the work. This is only possible if
also consider the quality of receiving materials and equipment and the
quality in the execution of the services at each stage of the work. (SOUZA, 1995).
Performing good analyses of adverse events allows for an understanding of the risks.
solve problems and protect people. Thus, investigate the risks involved in
the execution of work at height and proposing preventive measures for this is
fundamental for the minimization of accidents and consequently for preservation
of the integrity of workers' health.
2 WORK ACCIDENTS

2.1 - Concepts:

Article 19 of Law 8,213, from July 1991, defines a work-related accident as:
that which occurs through the exercise of work in the service of the company or through the exercise of

work of special insured individuals, causing, directly or indirectly, bodily harm,

disease or functional disorder that causes death, or permanent loss or reduction
or temporary, of capacity for work." The incidence of work accidents
It occurs in three situations: • When bodily injury occurs; • When disturbance occurs.
functional or; • When illness occurs. They are also considered as accidents of
work-related diseases and occupational diseases, namely (MINISTRY
FROM SOCIAL SECURITY, 2011): • Occupational Disease - It is triggered by
exercise of work peculiar to a certain activity and constant in the relationship established
by the Ministry of Labor and Social Security; • Occupational Disease - It is
triggered due to special conditions in which the work is carried out and with it
related directly, constant of the relationship elaborated by the Ministry of Labor and
from the Social Security. Are not considered as work-related illness

that does not produce work incapacity; • The endemic disease acquired by the insured
inhabitant of the region where it develops, unless proof is provided that it results from
exposure or direct contact determined by the nature of the work. 17 They are equated
still, to the work accident (FUNDACENTRO, 2011): • The accident related to
work that, although it was not the sole cause, may have directly contributed to the
death of the insured, for reduction or loss of their work capacity, or
produced an injury that requires medical attention for its recovery; • The accident suffered
injury sustained at the workplace and during working hours, as a result of: - Act of aggression,
sabotage or terrorism practiced by a third party or coworker; - Offense
intentional physical harm, including to third parties, due to a work-related dispute;
Act of imprudence, negligence, or lack of skill by a third party or colleague
work; - Act of a person deprived of the use of reason; - Collapse, flooding, fire
and other unforeseen events or resulting from force majeure. • The disease resulting from
accidental contamination of the employee while performing their activity; • The accident
suffering by the insured even if outside the place and time of work: - In the execution of
order or in the performance of service under the authority of the company; - In the provision

spontaneous service to the company to avoid losses or provide

benefit; - On a business trip for the company, including for studies when funded
it is within your plans for better training of the workforce,
regardless of the means of transportation used, including a privately owned vehicle
of the insured; - On the route from home to the workplace or from there to home,
any means of transportation, including vehicles owned by the insured.
During the periods designated for meals or rest, or on the occasion of satisfying other
physiological needs, at the workplace or during it, the employee is
considered in the exercise of work. (FUNDACENTRO, 2011).

3 RESULTS AND DISCUSSION

Norm 35 establishes the minimum requirements and protective measures for

work at heights, involving the planning, organization, and execution, in order to
to ensure the safety and health of workers involved directly or indirectly with
This activity is considered work at height any activity performed above 2.00.

the standard may reduce the statistical rates of fall accidents in the market
Brazilian, leaving behind the search for regulations that were scattered across
several NR's such as 10, 12, 18, 33, 34. Aware of the lack of information in the sector and
also from the variety of work carried out at height, NR 35 in its item 35.1.3
enables the support of work through international technical standards when not
there will be equivalent national standards. NR 35 establishes the responsibilities of
employers and employees 35.2.1.
It is the employer's responsibility: a) to ensure the implementation of protective measures

established in this Norm; b) ensure the completion of the Risk Analysis - RA and,
when applicable, the issuance of the Work Permit - WP; c) develop
operational procedure for routine work activities at height;
ensure the carrying out of a prior assessment of the conditions at the work site at height,
for the study, planning, and implementation of actions and complementary measures of
applicable security measures; e) take the necessary steps to monitor the
compliance with the protective measures established in this Standard by companies
hired; f) ensure that workers are provided with updated information about the risks and the
control measures; g) ensure that any work at height only begins after
adopted the protective measures defined in this Standard; h) ensure the suspension of
work at height when checking for an unanticipated risk situation or condition, whose
immediate elimination or neutralization is not possible; i) establish a system
of workers' authorization for work at height; j) ensure that all work

according to the peculiarities of the activity; k) ensure the organization and the
filing of the documentation provided for in this standard.

4 CONCLUSION
Over the years, the quest for worker protection has been becoming a priority.
in the construction industry, considering the constant concern with the
worker safety, due to the segment not having a culture and not being
to address this very important issue. This work then sought to demonstrate measures
of prevention for work at heights that allow for the minimization of accidents
of work and preserve the integrity of the health of workers. Thus, it is perceived that
the need to use knowledge in the relentless pursuit of solutions, through
improvement of safety and the use of PPE, whether they are individual or collective,
however, what is observed is that even providing safe working conditions and
safety equipment, it is still necessary to train the employee for the execution of
your activities, as well as inspect it. This protection needs to be applied to everyone.
