Note: -

1. Bidders (authorized signatory) shall submit their offer on-line in Electronic formats both for
technical and financial proposal.

2. Bid Security/Earnest Money Deposit (EMD) of the amount specified for the Project/Work(s) in
the table above shall be paid online only as prescribed and applicable above to avail the
participation rights in Bidding.

3. The cost of the bidding documents (non-refundable) shall be paid online through Net
Banking/NEFT/RTGS at portal [Link]

4. Any subsequent addendum/corrigendum shall be published only at the website


[Link] and will not be published in newspapers. In case there is a holiday on
the day of opening of bids, activities assigned on that date shall be carried out on the next working
day.

5. Before electronically submitting the bids, it should be ensured that all the bid documents
including conditions of contract are digitally signed by the Bidder with Digital Signature
Certificate (DSC).

6. Department will not be responsible for delay in online submission due to any reason. For this,
Bidders are requested to upload the complete bid well advance in time so as to avoid technical
and last-minute issues like slow speed; chocking of website due to heavy load or any other
unforeseen problems.

7. All the prospective Bidders are encouraged to participate in the pre-bid meeting and it is advised
that the work sites are visited and bid documents are studied thoroughly.

8. The procuring entity reserves the sole right to cancel the bid process and reject any or all of the
Bids without assigning any reason.

9. Procurement entity disclaims any factual/ or other errors in the bidding document (The onus is
purely on the individual Bidders to verify such information) and the information provided therein
are intended only to help the Bidders to prepare a bid-proposal.

10. No conditional bids shall be accepted and such bids shall be summarily rejected forthwith.

1. Manpower Requirement

The manpower as shown below is tentatively required for BSCDCL, Bhopal, Madhya Pradesh: -

3. Rate contract does not guarantee any specific labor numbers.
4. BSCDCL may reserve the right to increase or decrease the number of Manpower as per the actual
work requirement in any Category i.e. Unskilled, Semi-Skilled, Skilled and Highly Skilled vis-a-vis
resource type, as and when required.
5. BSCDCL on its discretion. has right to instruct the service provider to replace any individual
deployed By service provider.
6. In case the validity of any certificate which is mandatory to provide the services under this contract,
due to expire any time during the term of contract. The service provider shall be bound to
renew/obtain the same before it expire.

3. A bidder would be disqualified if any of the above criteria is not complied.
4. The BSCDCL has right to verify the document(s) submitted by the bidder along with bid proposal for its authenticity.
5. If two or more bidder quotes same rate of service charge then the bidder whose revenue/turn over during the last three financial
year (FY 2022-23,2023-24, 2024-25) plus revenue earned up to 30th September 2025 from manpower outsourcing &
security service business is higher shall be considered for award of contract

3.1.2 Tender Evaluation Process


The Evaluation Committee shall evaluate the bids as per the following process:

i. The BSCDCL will evaluate and compare the bids that have been determined to be substantially responsive.

ii. Technical Evaluation Committee shall review the Proposal along with Eligibility/ Qualification/Technical criteria.
To assist in the examination, evaluation, and comparison of the bids, and qualification of the Bidders, Technical
Committee may, at its discretion, ask any bidder for a clarification of its bid, if required.
iii. Compliance of Eligibility Qualification criteria is must for all bidders. In case of noncompliance bidder would be
declared as disqualified.
iv. Technically qualified bidder would be shortlisted for financial bid opening.
v. Financial Proposal of only those bidders shall be opened, who are declared as
‘Technically Qualified Bidder’.

Financial Bid

As per the daily rates Norms issued by the collector (Bhopal) for Labour and subsequent revisions
Note-
1- Service charge towards Selection/Training/ Deployment/ Monitoring/Uniform gears and Equipment
provisioning/Insurance/Leave replacement to be quote by the service provider in % as per financial bid format.
2- EPF Employer contribution and ESIC Employer contribution on minimum labor rate shall be paid by BSCDCL
to service provider over and above
3- GST Shall be paid extra on entire bill amount.

Instructions for quoting financial bid-


1. Bidder has to quote only service charges in percentage (in figure and words) on minimum rates issued by collector in
financial bid format provided on portal.
2. The service charges will be up to two decimal places only.
3. Bidder should quote minimum 1% Service charge. The service charges less than 1% shall be rejected.
Note: - The minimum 1% service charge rate is arrived based on the consideration of selected bidder’s charges towards
hiring & deployment of manpower, payment of salaries, billing, SLA compliances, other administrative and overhead
charges. Therefore, it is derived actual payment as service charges of 1 % minimum to be provisioned for this assignment
considering the risk and stability involved.

4. The service charges shall be computed on the collector rate manpower cost.

5. The insurance coverage against the risks shall include Party liability insurance, with a minimum coverage of in accordance

6. The service charges shall be quoted taking into account of all overhead expenses envisaged by the bidder for efficient
functioning /execution of Contract.

7. If there is a discrepancy between words and figures of quoted service charges as per the value mentioned in words will be

FINANCIAL PROPOSAL
(Envelope C)

1. Bidders who are found Eligible in Mandatory & Technical Proposals, the financial proposals of
only those bidders will be opened.
2. The rate contract will be executed with the Bidder quoted lowest service charge.
3. If two or more bidder quotes same rate of service charge then the bidder whose revenue/turn over
during the last three financial year (FY 2022-23,2023-24,2024-25) plus revenue earned up to 30th
September 2025 from manpower outsourcing & security service business is higher shall be
considered for award of contract.

Terms & Conditions:

1. Bids shall be submitted online at M.P. E-Procurement website [Link] No


hardcopy of financial bid is to be submitted.
2. The complete bidding process is online. Bidders should be in possession of valid digital
Signature Certificate (DSC) of appropriate class for online submission of bids. Prior to bidding
DSC need to be registered on the website mentioned above.
3. Bidder/Service provider are advised to follow the instructions provided in the ‘Instructions to the
Service providers/Bidder for the e-submission of the bids online through the M.P. E-Procurement
Portal ([Link])
4. Not more than one tender shall be submitted by one entity having business relationship. Under no
circumstance will father and his son(s) or other close relations who have business relationship
with one another (i.e. when one or more partner(s)/director(s) are common) be allowed to tender
for the same contract as separate competitors. A breach of this condition will render the tenders of
both parties liable to rejection.

5. The bids submitted in physical copy or by Telegram/Fax/email shall not be considered. No


correspondence will be entertained in this matter.

General Instructions:

1. A pre bid meeting shall be held at Office of the Chief Executive Officer, Bhopal Smart City
Development Corporation Limited 3rd Floor, Smart City Building, Near Tatpar Petrol Pump,
Zone-14 Nagar Nigam Office, Bhopal Madhya Pradesh-462023 to clarify any queries of the
Bidder. The date and time of pre bid meeting is given in NIT.

2. Period of Contract: The initial period of contract shall be for 1 year which may be further
extendable for One Year at a time, depending on Performance of the Agency and at discretion
of CEO, Bhopal Smart City Limited.

3. All the Technical Bid will be scrutinized, by the evaluation committee constituted by the
authority to check all relevant documents for their authenticity and the Bidder whose Technical
tenders are accepted will be informed about the date and time for opening the Financial Bid.

4. No Bidder will be allowed to withdraw after submission of the tenders within the bid validity
period. Otherwise his bid should be cancelled.

5. In case the successful Bidder declines the offer of contract, for whatsoever reason(s), bid
should be cancelled. In this case the EMD shall be forfeited and further action of debarment
and/or blacklisting proceeding shall be initiated.

6. The Bidder is expected to work out their own rates based on the detailed description of items,
the specifications and conditions and finally arrive at the cost of the Work/Service.

7. The Bidder shall be deemed to have satisfied itself before bidding as to correctness and
sufficiency of its Tender. The rates and prices quoted shall, except as otherwise provided, cover
all its obligations under the contract and all matters and things necessary for proper completion
and maintenance of the Works/Services. Where necessary, before submitting its Commercial Bid
the Bidder should inspect and examine the site and its surroundings and shall satisfy itself about
form and nature of the Site, the quantities and nature of the Work/Service and materials necessary for the
completion of the Works/Services, means of access to the site, the accommodation it may require, and in
general, obtain all necessary information as to risk, contingencies and other circumstances which may

influence or affect its Tender.

8. No extra charges consequent on any misunderstanding or otherwise shall be allowed.

9. A formal rate contract shall be entered into with the successful Bidder. In this contract, the
successful Bidder shall be defined as service provider.
10. The successful Bidder will have to deposit E-Bank Guarantee or FDR Rs. 5,00,000/- of issued by
scheduled bank in favor of Chief Executive Officer, Bhopal Smart City payable at Bhopal valid
for 90 days beyond the expiry period of contract.

11. The successful Bidder will have to deposit the E-Bank Guarantee/FDR and execute the contract
and commence the work within 10 days of acceptance of tender otherwise the award of contract
may be cancelled and the work will be awarded to the next bidder.

12. In event of successful bidder fails to deposit the E-Bank Guarantee/FDR and execute the rate
contract in given time his EMD shall be forfeited and the firm shall be placed in a list of
debarment/blacklisted.

13. Each page of the tender documents and papers submitted along with number and must be
Digitally Signed by the authorized signatory in acceptance of the terms and conditions laid down
by the BSCDCL

14. The BSCDCL reserves the right to withdraw/relax/modify any of the terms and conditions
mentioned in the tender document if it is felt necessary in the benefit of the Institute.

15. The BSCDCL reserves the right to reject all or any tender in whole, or in part, without assigning
any reasons thereof.
Note:

i. Work referred above should be in the name of a firm as a single entity and not aggregates of
Joint Venture firms/associates or cartels.
ii. Concluded or should have been more than one-year-old live contracts with extension/s, if
any. In case of running contract, value of payment received till date of issue of certificate
shall be the qualifying amount.

16. Bidders have to produce supporting documents/certificates in the form of Completion


certificates from the clients and copies of work orders for the subject work

17. Bidder should not have been blacklisted by any Central/State/Govt. agency and submit an
affidavit in this respect.
18. Bidder should enclose Certified Copy of registration certificate under Employees State
Insurance Act, and under Employee Provident Fund Act.
19. The authority will award the contract to the successful bidder/Service provider whose bid has
been determined to be in full conformity to the bid document and the lowest evaluated bid.

INSTRUCTIONS FOR SERVICE PROVIDER:


1. Requirement of labor shall be based on actual requirement to BSCDCL as and when basis.
2. Separate instructions shall be issued for every requirement, service provider shall avail
manpower within 3 days after the issuance of instructions.
3. The persons deployed by the service provider should carefully selected (Based on the scope of
work provided by BSCDCL) be properly trained, have requisite experience and having the
skills.

4. The service provider shall ensure Character/ Police verification of each manpower deployed.

5. The service provider must employ the manpower of appropriate age as per law.

6. BSCDCL on its discretion. has right to instruct the service provider to replace any individual
deployed By service provider.

7. BSCDCL however, reserves the right to terminate the contract by serving one months’ notice, in writing if
the Company is not satisfied about the services of the service provider. The service provider may also ask
for the same by giving three months’ notice.

8. In case of breach of any terms and conditions attached to the contract, the Performance Guarantee
of the service provider will be liable to be forfeited by BSCDCL besides annulment of the
contract.

9. The service provider has to provide standard liveries to its staff. The staff shall be in proper
uniform provided by the service provider but approved by Bhopal Smart City with their identity
properly displayed, samples of liveries will have to be submitted by the Service provider for the
approval of competent authority.

CLAUSES OF CONTRACT

1. Performance Guarantee:
As a guarantee towards due performance and compliance of the contract work, the successful
bidder (agency) will deposit an amount Rs. 5,00,000/- (Five Lakh) fixed value towards Security
Deposit by way of E- Bank Guarantee/ FDR in favor of Chief Executive Officer, Bhopal
Smart City. Drawn on any Nationalized Bank/Scheduled Bank and payable at Bhopal. Bank
Guarantee Bond of a nationalize bank in the prescribed format is also acceptable in this
regard.

2. Work Order/Request to Deploy:


This is rate contract for Un-skilled, Semi-skilled, Skilled and Highly-skilled Manpower. Separate
work order shall be given as per requirement of manpower with category and detailed scope of work
as and when basis for each assignment.
Service provider is expected to maintain a trained pool of manpower and deploy them within 3 days
of issue of work order. If agency is failed to provide the manpower within 7 days a penalty equal to
daily wage rates shall be imposed for delayed period. Further If service provider failed to provide the
manpower within 15 days contract may be terminated.

3. Quality of Services:
All Services to be supplied by the service provider shall be in conformity with the specifications
laid down in the Contract. The services supplied under the Contract must be of the highest
quality and standard.
If the manpower deployed by service provider found Non performer/ Under performer then
service provider shall replace the same within 24 hours of intimation from BSCDCL.

4. Inspection of Services:
The Competent Authority will carry out continuous inspection of the Services supplied to
confirm their conformity to the Contract specifications. The supervisor deployed by the service
provider will be sole responsible for attendance of the manpower at desired duty station and
task assigned the scope of work.
Attendance – Shall be maintained in the format as Annexure - A
Competent Authority shall be entitled at any time to inspect the services.

5. Daily Attendance:
The Competent Authority will carry out attendance in the below mentioned format: -

6. Billing Format: -
Service provider may submit the GST Invoice supported by the following

7. Payments: -
Service provider is expected to maintain below mentioned schedule-

The rates quoted shall be inclusive of all statutory obligations, all types of taxes or any taxes levied by
the Central or State Govt. or Local Body but excluding GST which shall be paid extra. The rates shall
be firm and fixed and shall not be subject to any change on any condition of whatsoever nature, and
shall hold well till completion of supply of the Services. Bills for Services supplied under this contract
shall be prepared in triplicate by the Service provider at the end of every month. The payment of bills
and other claims arising out of the Contract will be made by Account Payee Cheque drawn in the
name of the Service provider or through E.C.S. It may be noted that under the provision of the Income
Tax Act. The Successful agency should ensure that all components of minimum wages (ESI, PF,
Bonus etc.) are to be paid to the staff engaged as per the Min. Wages Act, 1948.

8. Forfeiture and /or Deduction amount of Performance Security Deposit:


If during the term of this Contract the Service provider is in default of the due and faithful
performance of its obligations under this Contract, or any other outstanding dues by the ways of
fines, penalties and recovery of any other amounts due to it, the Bhopal Smart City shall, without
prejudice to its other rights and remedies hereunder or at the Applicable Law, be entitled to call in,
retain and appropriate the Performance Security. Nothing herein mentioned shall debar the Bhopal
Smart City from recovering from Service provider by a suit or any other means any such losses,
damages, costs, charges and expenses as aforesaid, in case the same shall exceed the amount of the
Performance Security.

9. Price Variation: -
The Service provider shall be responsible for compliance of all statutory provisions relating to
Minimum wages, Provident Fund, and Employees State Insurance etc. in respect of the persons
deployed by it in the Institute.

Rates quoted by the firm will include all statutory obligations of the service provider under Minimum
Wages Act. Minimum wages for all purposes of tendering and execution thereof shall be rates as
notified by Labor Commissioner (State of MP). Revision of rates will be acceptable against

submission of order/notification from time to time with authentic proof of having paid the same.
Only Minimum wages for number of persons deployed will be revised as and when Minimum wages
revision is notified by Labor Commissioner (State of MP). Apart from this no other escalation on any
component on any component is payable whatsoever.” This clause shall be operational for decrease
in quoted/awarded amount on same analogy as above in case there is decrease in labor rates.

10. Disputes & Arbitration:


The Bhopal Smart City and the Service provider shall make every effort to resolve amicably by
direct informal negotiation, any disagreement or dispute arising between them under or in connection
with the Contract. If a dispute of any kind whatsoever that cannot be resolves the same shall be
referred to the sole arbitration of the Executive Director, Bhopal Smart City it is also a term of this
Contract that no person other than a person appointed by the Executive Director, Bhopal Smart City
it as foresaid should act as an Arbitrator. As aforesaid the provisions of the Arbitration and
conciliation Act 1996 or any statutory modification or re- enactment thereof and the rules made there
under and for the time being in force shall apply to the arbitration proceedings under this clause.

11. Legal Jurisdiction:


No Legal suit or other proceedings relating to performance or breach of Contract shall be filed or taken
by the Service provider in any Court of Law except principal court of Ordinary Civil Jurisdiction at
Bhopal which shall have exclusive jurisdiction to the exclusion of any outside court.

12. Rights of the Bhopal Smart City.

Bhopal Smart City it reserves the right to suitably increase/ reduce the scope of work put to this
Tender. In case item rate contract, the Bhopal Smart City it does not in any way guarantee the
quantity for which an order may be placed and the Tender quantity may only be treated as indicative.
In case of any ambiguity in the interpretation of any of the clauses in Tender Document or the Contract
Document, interpretation of the Clauses by the Bhopal Smart City it shall be final and bindings on
all Parties.

13. Service provider’s Responsibilities

a) Service provider shall provide uniform, belt, shoe, cap, baton (Danda), Torch, Photo ID
Card, Umbrella (for rainy session) to their Security guard.
b) Service provider shall provide its staff, a minimum of two sets of uniforms. The
employees shall also display a photo identity card on their person clipped to the shirt at
all times.
c) Service provider shall be responsible for the watch and ward of the material provided
by him against pilferage and breakage during the period of execution and thereafter till
the work is physically handed over to the department.
d) Service provider shall ensure that the person deployed are disciplined and shall enforce
in prohibition of consumption of alcoholic drinks, paan, gutkha, smoking, loitering and
shall not engage in gambling, satta or any immoral act.

e) All staff deployed by service provider shell required to reach duty station before 5
minute of time scheduled for them. And work as per duty time.

f) Service provider is responsible to provide one paid Weekly off to all staff deployed. In
case of leave/off taken(other then weekly off) the service provider shell liable to deploy
alternate staff with its own cost. If staff or alternate staff fail to join the duty on time his

her attendance will be marked as “Not present” and liable to deduct salary.

g) Normal Shift/Duty time for staff is 8 hr., However supervisor staff is required to
maintain the 24 X7 Monitoring /supervision of staff under him.

h) For security deployment is 6:1 i.e., for duty staff and Leve/reliver staff.
i) It will be the responsibility of the service provider to meet transportation, food, medical
and any other requirements in respect of the persons deployed by him.
j) This Office shall not be responsible for any damages, losses, claims, financial or other
injury to any person deployed by the service provider in the course of their performing
the functions/duties, or for payment towards any compensation.
k) Manpower deployed by the service provider shall not have any claim or be entitled to pay,
perks and other facilities admissible to casual, ad-hoc, regular/ confirmed employees of
this Department during the term or after expiry of the contract

14. Deployment of Manpower

 All staff deployed by service provider shell required to reach duty station before 5 minutes of
time scheduled for them. And work as per duty time.

staff with its own cost. If staff or alternate staff fail to join the duty on time her attendance

BSCDCL to the service provider or by any such matter or thing whatsoever, which under the law
relating to the sureties would, but for this provision, have effect of so relieving us.
This guarantee/undertaking shall be in addition to any other guarantee or security whatsoever BSCDCL may
now or at any time have in relation to the performance of the works/equipment and the company shall have
full re-course to or enforce this security in performance to any other security or guarantee which the
BSCDCL may have or obtained and there shall be no forbearance on the part of the company in enforcing or

or change of constitution or insolvency of the supplier/ service provider, but shall in all respects and for all
purposes be binding and operative until payment of all moneys payable to BSCDCL in terms thereof are paid
by the Bank.
The Bank hereby waives all rights at any time inconsistent with the terms of this Guarantee and the
obligations of the bank in terms hereof, shall not be otherwise effected or suspended by reasons of any
dispute or disputes having been raised by the supplier/service provider (whether or not pending before any
Arbitrator, Tribunal or Court) or any denial of liability by the supplier/service provider stopping or
preventing or purporting to stop or prevent any payment by the Bank to BSCDCL in terms hereof.
We, the said Bank, lastly undertake not to revoke this guarantee during its currency except with the previous
consent of BSCDCL in writing. Unless a claim is made in writing within three months from the date of
