Governing Rule:

Competitive Bidding is subject to the provisions of Rules VI to XI of the IRR (Implementing


Rules and Regulations).

Section 28. Limited Source Bidding


*Limited Source Bidding is a special procurement method where the government directly invites
only a few pre-selected suppliers, contractors, or consultants to submit bids.
*These entities must have:
Proven experience
Demonstrated capability
Limited Source Bidding can only be used in specific situations:
-Highly Specialized Goods/Services
-Major Plant Components
-Infrastructure Involving National Security
Entities on the pre-selected list must meet certain criteria:
a) Past performance and relevant experience​
b) Sufficient resources like staff, equipment, or facilities​
c) Good financial condition​
d) Good standing – not connected to criminal or questionable groups, either locally or
internationally

Section 29. Competitive Dialogue


Competitive Dialogue is only allowed in special cases, including:
a) Complex or Innovative Solutions
b) Need for Negotiation
c) Unclear Technical Specifications

BAC - Bids and Awards Committee
LCRB - Lowest Calculated Responsive Bid
MEARB - Most Economically Advantageous Responsive Bid
MARB - Most Advantageous Responsive Bid
HRRB - Highest Rated Responsive Bid

Section 31. Direct Contracting


Direct Contracting is a mode of procuring goods without elaborate bidding documents. The
supplier only submits a price quotation or pro-forma invoice with conditions of sale, which may
be accepted immediately or after negotiation.
