ADDITIONAL INFORMATION REGARDING THE VGM:

In preparation for the new SOLAS requirement coming into force, our
Booking confirmation is now showing VGM relevant information for you.

Submission of a VGM is mandatory for all containers departing on or
after 1st July 2016.
Without a VGM your container cannot be planned for shipment.
A VGM can be submitted for cargo already in transit on or after 6th
June 2016.
4) A number of terminals will require a VGM ahead of the container(s)
arrival making the VGM cut-off date obsolete. Those terminals will
be highlighted on page 1 of this confirmation.
5) In all cases the VGMs should be submitted electronically and
directly to Hapag-Lloyd for example via the online business section
of our website

6) It is recommended to provide the VGM as soon as it is available but
no later than the VGM cut-off date listed on this booking
confirmation.

Hapag-Lloyd AG shall not be responsible for any costs / delays

occurring due to intervention of customs.

Shipper declares and certifies that the cargo does not meet the IMDG
Code nor the Basel Convention criteria to be deemed dangerous cargo or
dangerous waste respectively.

Hapag Lloyd grants 10 free days for dry cargo and 7 free days
for refrigerated cargo.

In accordance with clause 9 of the bill of lading (BL),

considering that in the case that the containers have an order of the
authorities (Customs) to be opened and conduct the inspection
of the goods, the carrier shall not be liable for any
loss or damage incurred as a result of such opening, unboxing,
inspection or the new packaging.

The Carrier shall have the right to recover the costs of such
opening, unpacking, inspections, and any other costs that
can generate.

Legal Terms
A) The Carrier named in this booking confirmation is operating under the terms and conditions of its bill of lading or sea waybill depending on
which document will be issued for the shipment. Our terms and conditions will be provided to you upon request or may be viewed at any office of
Carrier or its agents or [Link] gathers, processes, stores, transmits and uses personal data of its contractual
partners only if and insofar as such data are required for conducting a contractual customer relationship (e.g. conclusion, execution and
management of the contract, accounting purposes). Please take notice that, according to the Carriers bill of lading/sea waybill terms and
conditions, there are limitations of liability which deviate from the statutory German law.
B) All dates and times are given as best reasonable estimates subject to change.
This booking confirmation is subject to sealing of the container with high security seals by the shipper.
D) Stowage of containers on vessels is subject to Carrier's sole discretion (see clause 16. Carrier's bill of lading/sea waybill terms and
conditions). Unless expressly agreed in writing the Carrier does not undertake to accept any particular request, instruction or condition including,
but not limited to stowage request.
E) It is the sole responsibility of the shipper to ensure that any container tendered by it for transportation with Carrier complies with all applicable
laws and regulations of each country that it will transit including without limitations those with regard to cargo weight limitations and declaration
limitations. In particular, but without limitation, it is agreed that in case of cargo moving under merchant haulage at origin or destination, it is the
sole responsibility of the shipper/consignee and its motor carrier to confirm the cargo weight before taking the cargo on public roads and to
ensure that equipment capability and other appropriate measures are taken to provide for safe transport and comply with all applicable laws over
the road weight limitations.
F) Furthermore and without limiting the generality of the foregoing, it is the sole responsibility of the shipper to provide Carrier electronically or by
any other means as agreed by the parties with the Verified Gross Mass (VGM) as required by SOLAS Chapter VI Regulation 2, paragraph 4 of
1974 (as amended from time to time) for each container to be loaded onto a vessel prior to the deadline for submission of such information
stipulated by Carrier (VGM Cut-off Time) in the booking confirmation. If Carrier does not receive VGM in time from shipper or his representative,
The container will not be loaded onto the vessel.
G) Carrier may store/weigh/re-weigh/return the Container to the shipper or its representative at its discretion for the shipper's account if VGM is not
provided in time.
H) Any demurrage and storage fees resulting from breach of these obligations shall be for the shipper's account.
I) Shipper shall also be liable for any resulting expenses, fines, delay, loss or damage.
J) Shipper acknowledges and agrees that submission of VGM by third parties on his behalf shall be deemed authorized if third party message
shows the following mandatory information: a) match of container number and shipment number b) name of responsible party (B/L Shipper) c)
PERSON AUTHORIZED BY SHIPPER IN CAPITAL LETTERS
K) Carrier reserves the right to ask for additional information i.e. due to country specific implementation regulations. Carrier will rely on the
Correctness of the transmitted data, neither authorization nor VGM will be verified by the Carrier.
L) Shipper shall monitor its VGM on Hapag-Lloyd's website [Link]/en/my_shipments.htmland shall notify Carrier
immediately if VGM is not displayed or displayed incorrectly.
