The Heritage of Vietnam

behind.”
The complex Yet beautiful history of Vietnam can be traced back
to around 20,000 years ago. Vietnam is a vast multi-ethnic country
situated on Mainland Southeast Asia, According to popular legends the
country’s first year name was ‘Xtch Quy’. Among all Asian Countries
Vietnam has one of the oldest and most continuous histories of any
nation spanning through countries. Vietnam’s history was the evolution
of a diverse economy and an advanced civilization brown as the Red
River civilization. Throughout its history, many dynasties ruled over
Vietnam in between periods of Chinese occupation. There are four main
dynasties to note: the LY, the Tran, The Le, and the Nyuger, First, the
Ly Dynasty, out of the Chinese, ending a thousand year rule, and set up
a centralized Government in Hanoi. Then came the Tran Dynasty which
uphelled a Mongol attack in the Red River Delta under the command
of general Tran Hung Dao. These two dynasties helped build the
foundation of Vietnam, as people with long standing line for their land.
Despite multiple invasions and colonization throughout its history,
Vietnam and its people have managed to preserve their rich culture and
heritage. The countries unique architecture is a representation of its rich
heritage. The ancient temples, pagodas, imperial citadels, communal
houses, shrines etc are symbols of Vietnamese style architecture which
is formed according to the needs of living, sheltering from the sun and
rain, and a place to return after work. The Ho Chi Mirh Mausoleum is
one of Haroi’s most important buildings and one of the most popular
tourist attractions in Vietnam’s capital city. The huge granite memorial
is located in the impressive Ba Dinh Square and is watched over Ly
guards.
Along with architecture and history Vietnamese literature plays an
integral part of its culture. Early Vietnamese literature was composed
early rather lining written down. Vietnamese flok literature is an
intermingling of many forms. Flok literature usually exists in many
versions, passed down orally through generations, and have unknown
authors. The earliest surviving literature lay Vietnamese writers is
written in Chu Han Chinese Characters Vietnamese poetry includes
some really unique and complex riddle poems which hold complex
answers.
In love will split the nut in three:
In hate, ten parts there will be more
One piece each, were five score
Seventeen nuts count who adore, who hate
The answer of the above poetic riddle are 30 lovers and 70 haters. The
poem in the mathematical poetic haggle talks about different stages of
love which is decided into 3 part love, 7 part despair. Such complex yet
deep and meaningful poetry is well popular through Vietnamese culture.
In the modern times Vietnam is one of the fastest growing economics of
the world. The country has seen rapid development and modernization
through the last 5 decades. Despite this, Vietnamese people have never
forgotten their core culture consisting of last history, complex yet
meaningful literature and gorgeous architecture. This is an example of
the prural “A tired child always finds the way lack to home, a bird
always finds its way back home and a tree forever stays connected its
roods”. We can all take inspiration from this country and its people who
continue to flourish through centuries with its magnificent heritage and
culture.
REGARDING CANCELLATION /RESUMPTION OF LEASED LAND OF MOUZA BANDALO
SANCTIONED FOR CONSTRUCTION OF BOUNDARY WALL AND OMC STOCKYARD
A. Vide order no-1805/Rev, dtd. 08.11.2004 of Collector, Jajpur.
Village-Bandalo, Khata No-293 (Rakhit), Plot No-563, Area Ac. 5.00 out of Ac. 15.45
dec., Kissam- Gochar has been de-reserved from Kisam Gochar to Patita by the
Collector, Jajpur for sanction of lease in Govt. land in favour of M/s OMC, Jajpur for
construction of boundary wall and OMC stockyard.
B. Vide sanction order no-901/Rev. dtd. 28.03.2005 from Secretary to RDC Cuttack
Tahasil –Darpan, Mouza-Bandalo, Khata no-290 (AJA), Plot No-563 /874, Area-Ac.
5.00, Kissam- Patita has been sanctioned by RDC Cuttack in favour of M/s OMC for
stocking of chrome ore and construction of boundary.
C. Accordingly vide lease deed no-905/2006 has been signed between Collector, Jajpur
Vs. RM, OMC, JK Road after deposit of the dues.
D. Vide sanction order no-909 / 21.03.2006 of Secretary to RDC, Cuttack
Mouza- Bandalo, Khata No-290/AJA, Plot No-563 /877, Area-Ac. 5.00 Kissam- Patita
lease has been sanctioned in favour of OMC for stocking of chrome ore.
E. Accordingly lease deed has been signed on 28.06.2006, Collector, Jajpur Vs. RM,
OMC, JK Road after deposit of the dues.
F. Vide letter no-2046, dtd. 20.07.2011 of ADM, Jajpur
ADM, Jajpur submitted two lease records bearing no- 1 /2005 and 18/2006 to Under
Secretary to RDC, Cuttack after due recommendation by the Collector, Jajpur for
cancellation of the lease of govt. land.
G. Vide Letter no-3864 /OMC, dtd. 17.06.2010 of RM, JK Road
As per the technical committee headed by Prof. G.C Mitra of IIT, Kharagpur Extension
Centre as the said land was not to be suitable for the stockyard purpose since it was
vulnerable to in audition during rain and also very high cost of development of the land
for stockyard purpose takes steps for cancellation of the lease sanction order also the
lease deed executed with OMC and action may also be taken for refund of deposited
amount.
H. Letter no-2471 /Rev., dtd. 06.08.2011 Secretary to RDC, Cuttack addressed to the
Collector, Jajpur
It has been mentioned in the case record that the lesser has violated the condition of the
Clause No-7 of the lease agreement for which lease is to be cancelled, the land shall be
revert to the State Govt. free from all encumbrances if it is not utilized for the purpose for
which it is transferred.
I. Vide Letter no-1984, dtd. 18.05.2012 from Tahasildar, Darpan address to Dy.
Collector (Rev.), Jajpur
Tahasildar Darpan has reported that as per Clause-7 of the lease deed agreement, the
lessee has not utilized the land for which it was leased out. So this is a violation of lease
deed agreement.
J. Vide Letter no-2917/Rev. dtd. 01.03.2013 of Secretary to RDC, Cuttack
Proposal for cancellation of lease sanctioned in favour of OMC suggested by Darpan
Tahasil basis of the lease out land not to be utilized by the lessee. The prayer for refund
of money should be examined at Collector’s level since the lessee has deviated the terms
& conditions, the refund of money in case of cancellation of lease needs to be decided at
govt. level.
K. Vide Letter no-4203/Rev. dtd. 27.10.2017 of Tahasildar, Darpan to Sub-Collector,
Jajpur
As per case record the lessee has violated the terms & conditions at Col. 7 of lease
agreement which read as follows: the land shall revert back to state govt. in Revenue
Deptt. free from all encumbrances if not utilized for the purpose for which it transfer.
But there is no where mentioned to refund the lease amount to the lessee on
violation of Clause-7 of lease agreement.
L. Vide Letter no-928, dtd. 29.03.2018 Sub-Collector, Jajpur to Tahasildar, Darpan
The lessee has violated the terms & conditions within the stipulated period as per Clause-
7, the land shall be reverted to the State Govt. free from all encumbrances if it is not
utilized.
So far as refund of money is concerned there is no such rule / provision available
in OGLS Act /Rules.
