ambient temperature evaporates or volatizes.

· Incompatible waste: Those that, when mixed or come into


contact, they can react producing harmful effects that
they threaten human health, the environment, or both.

· Final disposal: It is the action of permanent deposit of the


waste in appropriate sites and conditions to avoid harm to the environment.
· Cleaning entity: It is a natural or legal person, public or
private, in charge or responsible in a municipality for the presentation
of the cleaning service, such as companies, organizations, associations, or municipalities

directly.

· Debris: They are the waste, rubble, and scraps that remain from the creation or
collapse of an engineering work.

· Transfer station: It is the place physical gifted of the


necessary installations, technically established, in which self
transfer the solid waste from the collection vehicles to
the means of transport that take them to the final disposal.

· Generation: Amount of solid waste produced by a given


source in a given time interval.

· Leachate: Contaminated liquid that results from water passing through a


solid waste layer.

· Recycling: The operation of separating and selectively sorting waste

· Sanitary landfill: Method of disposing of solid waste in


the soil that consists of spreading them, arranging them, and compacting them to

the most practical volume possible, cover them daily with soil or another material of
filling and exercising the necessary controls for that purpose.

· Reuse: Action of using a solid waste without prior treatment.


· Treatment: Process of physical, chemical, or biological transformation of the
solid waste to modify its characteristics o
reutilize its potential, and in which new waste can be generated

TITLE II

CHAPTER I

FROM THE COMPETENT ORGANISMS

Article 3.- On the competences.

The application of this Regulation is the responsibility of the Ministry of Public Health.

TITLE III

CHAPTER I

GENERAL PROVISIONS

Article 4.- On the management of solid waste.

The management of solid waste includes the following activities:

Production and storage

Delivery

Collection

Transport

Transfer

Treatment

Final Provision

Sweeping and cleaning of streets and public areas


Recovery

Environmental education.

Article 5.- On the types of service.

For the purposes of this Regulation, the waste management service


solid waste is classified into two categories: a) regular service and b) service
special.

Article 6.- Of the ordinary service.

The provision of the ordinary service will aim at the management of the
following classes of waste:

a) Household waste.

b) Waste that by its nature, composition, size, and volume


they can be incorporated into its management, by the cleaning entity and at its discretion
agreement with your capability.

c) Waste produced in public spaces.

d) Trash not included in the special service.

Art. 7.- Of the special service.


The provision of the special service will aim at the management of the
next trash:

a) Pathogenic, toxic, combustible, flammable waste, explosives,


radioactive and volatile.

b) Waste that by its nature, composition, size, and volume


they should be considered special at the discretion of the cleaning entity in accordance with

its capacity.

c) Pack or containers of chemical products of any


nature, especially from pesticides and agricultural use preparations or
livestock

d) Waste that, due to its location, presents difficulties in its management due to

Article 8.- On the responsibility regarding waste.

terms of service provision and the activity or activities that are

Article 10.- On waste management programs.

Regardless of who carries it out, the management of waste


solids must follow a program that responds to the needs
of the cleaning service and that includes, among others, the following aspects:

a) Establishment of routes and schedules for waste collection, that


will be made known to the users.

b) Maintenance of vehicles and auxiliary equipment intended for service


cleaning.

c) Training of staff engaged in management activities


waste regarding the provision of cleaning services and the measures of
security that must be observed.
d) Activities to develop in events of failures that occurred due to
any circumstances that hinder the provision of cleaning services.

e) Information and education mechanisms for service users,


about the delivery or presentation of the waste regarding
the location, size or capacity of the container and other related aspects
with the proper provision of the service.

Article 11.- On the situations that should be avoided in waste management.

The waste management activities must be carried out in such a way that they
avoid situations like:

a) The continuous presence of waste in public roads and areas or


containers that hold them in a way that causes sanitary problems and
aesthetic.

b) The proliferation of vectors and conditions that promote transmission of


diseases and humans or animals.

c) The risks to cleaning service workers or to the general public.

d) Air, soil, or water pollution.

e) Fires and accidents.

f) The generation of objectionable odors, dust, and other nuisances.

g) The final non-sanitary disposal of waste.


Article 12.- On the management of waste outside the urban perimeter of the
Cantons.

The management of waste generated outside the urban perimeter of


the municipalities will be in charge of sus producers, who they must
comply with the provisions of this Regulation and other related ones
with the protection of the environment.

Article 13.- On garbage disposals.

Article 16.- Regarding the specifications of the equipment for waste management.

The vehicles, machinery, and equipment that are used in the

Article 17.- On the analysis methods for waste.

TITLE IV
OF THE ORDINARY CLEANING SERVICE
CHAPTER I

FROM WASTE STORAGE

Art. 18.- On the obligations of users of the regular service


cleaning

The users of the regular cleaning service will have the


following obligations, regarding waste storage and its
presentation for collection:

a) Store the waste generated in a sanitary manner. compliance


with the provisions established in this Regulation.

b) Do not deposit liquid substances, excreta, or garbage as contemplated.

c) Equipped with a tightly fitting lid that does not hinder the emptying process.

allow the entry of water, insects, or rodents, nor the escape of liquids through

e) Rounded edges and a larger area at the top, so that it

Article 21.- On the characteristics of disposable containers.

garbage in the ordinary service will be bags or pouches made of plastic material or
similar characteristics and must meet at least the following conditions:

Article 36.- On the prohibition of dumps.

The owners of undeveloped land, located in the

CHAPTER II

Article 39.- On the obligations of waste producers.

the conditions established in this Regulation and in the rules of the
cleaning entities.
Article 40.- On joint responsibility for improper waste disposal.

In case the garbage producer delivered them to a person


natural or legal entity that does not have authorization from the cleaning entity, the former and the latter

they will be jointly liable for any damage caused by them and
they will be subject to the imposition of the penalties established by the authorities

Article 41.- On the placement of garbage collection containers.

Art. 57.- On the conditions of the equipment for the transport of garbage.

The equipment, accessories, and aids that they are equipped with

vehicles intended for the transport of garbage must be


permanently in proper conditions for timely provision of
service.

Article 65.- On the location and operation.

The location and operation of the stations


waste transfer must meet, at a minimum, the following
conditions:
a) Facilitate vehicle access;

b) Not being located in areas of influence of establishments


educational, hospital, military, recreational, and others regarding their activities

c) Do not obstruct vehicle or pedestrian traffic, nor cause problems of
aesthetics;
d) Have a defined system for loading and unloading
e) Have an alternate system for operation in cases of failures or emergencies;
f) Having a water supply system with sufficient quality to carry out

g) Have the basic services that allow its operation.

Art. 66.- Regarding the transfer and recovery of waste at stations of


transfer

When transfer and recovery activities are carried out


in the same establishment, they will also be subject to the
provisions of these regulations and should to arrange of systems
alternatives that allow for normal operation in cases of failures or emergencies

c) Having labels and warnings that they identify him as soon as possible a the

operating hours or functioning; prevention measures for cases of

those involved in the activities that take place there.

d) To have the minimum services of supply of water


electricity, telephone line, system according to the complexity of
the activities carried out.

e) To have programs and systems for prevention and control of


accidents and fires, as well as for first aid attention assistance and
comply with regulatory provisions concerning
occupational health, hygiene and industrial safety established by the Ministry of
Public Health and other competent organisms.

f) Keep a record daily, available for the IEOS, in the


related to quantity, volumes, weight, and average composition of the
wastes subject to sanitary disposal.

g) Maintain sanitary conditions to prevent the proliferation of vectors and


other animals that affect human health or the aesthetics of the surroundings.
h) Exercise control over the scattering of garbage, particles, dust.
and other materials that can be transported to Laos by the action of the wind

OF THE SPECIAL CLEANING SERVICE

b) Reduction of the amount of waste produced, for its


final sanitary disposal.

FROM THE ORGANIZATION OF CLEANING SERVICES
CHAPTER I
FROM THE REGISTER OF CLEANING ENTITIES

Article 120.- Of the registration of cleaning entities.

Every cleaning entity, whatever its nature or


characteristic, within a period of twelve 12 months counted a
starting from the effective date of this Regulation, must
register with the Provincial Directions of the IEOS. However,
a priority registration may be demanded before the expiration of the specified deadline, in the
time that the IEOS establishes for the effect.

The entities that are organized after the effective date of this
Regulations must also be registered with the IEOS.

The registration referred to in this article must to be carried out in the

Registration Form

Art. 121.- Of the content of the registry.

a) Objectives of the entity.

b) Technical, administrative, and financial structure.

c) Location, area, and percentage of service coverage.

ON THE OPERATION OF SANITATION ENTITIES

frequencies, schedules, and other service conditions.

d) The prohibitions and sanctions for the violation of the


provisions in accordance with the provisions established in this Regulation.
Art. 127.- On the obligation to provide the necessary personnel and equipment.

Every cleaning entity must assign the appropriate personnel equipped with the necessary tools.

8. Identification of probable effects of occurring as


achievement of the proposed action in its area of influence previously
marked.

9. Identification and inventory of sources of air, soil, and pollution


waters in the area of influence.

10. Population data and projections for 5 and 10 years and socio-economic factors

12. Topographical conditions.

When the Municipalities cease to comply with the provisions


from the Health Code, from the Municipal Regime Law of y this
Regulation, in the field of solid waste management, the IEOS
will temporarily assume those functions in accordance with what is established
Article 206 of the Health Code, and Article 20 of the Regime Law
Municipal.

CHAPTER II
OF THE MEASURES OF ORIENTATION, EDUCATION, PROMOTION AND
RESEARCH

Article 141.- On education orientation and promotion.

The Ministries, the Municipalities, the entities of hygiene y


other Public or Private Institutions, within of sus fields of
competence, will develop and implement plans, campaigns and
other activities aimed at guiding and disseminating what the problem of
solid waste management means, its consequences and, in general, the means
for your solution.
Article 142.- On education.

The Ministry of Education, Culture y Sports will includein sus


educational programs the compulsory teaching of aspects
fundamentals about the proper management of solid waste.

Article 143.- On investigation.

The Universities and Schools Polytechnics y the Advice National


of Science and Technology (CONACYT), will promote and sponsor the
scientific research and appropriate technologies related to
the management of solid waste, its treatment, its recovery and
final disposition, including within its programs the practices and
corresponding courses, as well as dissemination in theses, journals, and other media
the recommendations that may be appropriate.

TITLE IX
CHAPTER I
OF THE SANCTIONS

Article 144.- On the authority to impose sanctions.

The violations of this Regulation will be sanctioned for the


Health Commissioners, in accordance with the Standards of the Code of the
