CONSUMER PROTECTION – BRIEF NOTES

1. INTRODUCTION

Consumers face issues like adulteration, unsafe products, misleading ads and overpricing.
The Consumer Protection Act 2019 protects their interests through legal rights and a
grievance redressal system.

2. IMPORTANCE OF CONSUMER PROTECTION

A. From Consumers’ View:

• Consumer ignorance – need awareness.

• Unorganised consumers – need support.

• Exploitation – unfair trade practices.

B. From Business View:

• Long-term interest – repeat sales & goodwill.

• Uses society’s resources – responsible behaviour.

• Social responsibility – protect consumers.

• Moral duty – avoid exploitation.

• Avoid government intervention.

3. CONSUMER PROTECTION ACT 2019

Protects consumers from unfair practices; applies to goods, services, and e-commerce.

4. WHO IS A CONSUMER?

One who buys goods or avails services for personal use (paid or partly paid). Excludes
resale or commercial purpose.
5. IMPORTANT TERMS

Complaint – request for relief.

Defect – fault in goods.

Deficiency – fault in service.

Unfair trade practice – false claims.

Product liability – compensation for harm caused by defective goods.

6. CONSUMER RIGHTS

• Right to Safety – protection from hazardous goods.

• Right to be Informed – ingredients, price, dates.

• Right to Choose – variety of options.

• Right to be Heard – grievance redressal.

• Right to Seek Redressal – refund, repair, replacement.

• Right to Consumer Education – awareness.

7. CONSUMER RESPONSIBILITIES

• Be aware of products.

• Buy standardised goods (ISI, AGMARK).

• Follow safety instructions.

• Read labels carefully.

• Assert your rights.

• Avoid illegal goods.

• Ask for cash memo.

• File complaints.

• Join consumer groups.


• Protect environment.

• Self-regulation by business.

• Business associations (FICCI, CII).

• Consumer awareness (Jago Grahak Jago).

• Consumer organisations.

9. REDRESSAL AGENCIES

District Commission – up to ₹50 lakh.

State Commission – ₹50 lakh to ₹2 crore.

National Commission – above ₹2 crore.
