Mr. Jagadish , aged about 26 years is a native of Hyderabad and is an
Engineering graduate . He joined a software development company by name
‘Montek Soft Solutions’ and was drawing a salary of Rs. 12 Lakhs per anum .
While working in the company he came across Ms. Maya aged 27 years working
as a team manager in the same company. Ms. Maya is a Computer Science
engineering graduate from Delhi University and hails from Assam. She is drawing
a salary of Rs. 20 Laks per anum.
Both of them fell in love and wanted to marry. There were some reservations and
objections from the parents of both Mr. Jagadish and Ms. Maya on cultural and
linguistic differences as well as the difference in their ages. Though both are
Hindus, Mr. Jagadish is a Telugu speaking person, and born and brought up in
Hyderabad and Ms. Maya is from Assam girl, born and brought up in Gauhathi.
But both after persuading their respective parents got married on 2-3-2023 at
Hyderabad under Special Marriage Act, 19554. Since then, they have been living
in rented flat within the vicinity of their workplace ie. Shaikpet. They have been
living happily. In April 2024 April, Mr. Jagadish lost his job because of recession.
He has been trying for new job but he could not get a similar job because of the
Market conditions prevailing during the period.
After that , they lived together with the single salary i.e on the salary of Ms.
Maya. After a period of nearly 10 months, in February, 2025 some differences
cropped up between the spouses. On 11-6- 2025 , Mr. Jagadish left Ms. Maya
alone and started living with his bachelor friends in Kukatpally and has been in
search of a new job After 3 months Mr. Jagdish got a job as a data entry operator

in a Pharam Outsourcing company in Kukatpally for a salary of Rs.42,000 per
month. Ms. Maya requested him to come back and to live with her. Ms. Maya also
tried a lot through common friends to persuade him to join Mr. Jagdish to join
her, but she was unsuccessful in her attempt in convincing Mr. Jagdish. On 6-10-
2025, Ms. Maya filed a matrimonial petition for the decree of Restitution of
Conjugal Rights against Mr. Jagdish under S. 22 of the Special Marriage Act, 1954
in the Hyderabad Family Court. Meantime, Ms. Maya begat a female child and the
child was one month old on the date of filing the matrimonial petition.
The Family Court on the appearance of the parties refereed the parities to a
conciliator under S. 9 of the Family courts Act, 1984. Conciliate between the
parties and submit a report.
