Introduction
Consumer rights refer to the rights given to a consumer to protect them from unfair trade practices.
These rights are defined under the Consumer Protection Act and are aimed at ensuring that
consumers get the right information, are not cheated, and have a mechanism to address
grievances.
Need for Consumer Protection
Consumer protection is necessary to shield buyers from exploitation by sellers. It ensures fair trade
practices, quality products, and the ability to address grievances. With globalization, it has become
even more critical to safeguard consumer interests.
Consumer Rights
There are six major consumer rights:
1. Right to Safety
2. Right to be Informed
3. Right to Choose
4. Right to be Heard
5. Right to Redress
6. Right to Consumer Education
1. Right to Safety
This right protects consumers against products and services that are hazardous to health or life. For
example, buying ISI-marked electrical appliances ensures safety standards are met.
2. Right to be Informed
Consumers should be informed about the product's quality, quantity, price, ingredients, usage, and
risks. Labels and advertisements must be truthful and clear.
3. Right to Choose
Consumers should have access to a variety of products and services at competitive prices. This
promotes healthy competition and freedom of choice.
4. Right to be Heard
Consumers' interests must be considered in policymaking and they must have platforms to voice
their complaints. Consumer forums and helplines help fulfill this right.
5. Right to Redress
Consumers have the right to fair compensation for any loss caused by defective goods or services.
Consumer courts address such grievances.
6. Right to Consumer Education
Consumers should be aware of their rights and responsibilities. Education empowers them to make
informed decisions and take action against exploitation.
Consumer Responsibilities
With rights come responsibilities. Consumers must:
- Be aware of their rights
- Check labels
- Demand bills
- File complaints against malpractices
- Use products responsibly
Consumer Protection Act 2019
This Act replaces the 1986 Act. It introduced new measures like:
- E-filing of complaints
- Establishment of Central Consumer Protection Authority (CCPA)
- Product liability
- Inclusion of e-commerce
Consumer Awareness Campaigns
'Jago Grahak Jago' is a popular campaign by the government to spread awareness. It educates
consumers via media on how to be vigilant and proactive.
Consumer Courts in India
There are three levels of consumer courts:
1. District Forum
2. State Commission
3. National Commission
These provide quick and simple redressal mechanisms.
Case Study Example
A consumer bought a mixer with a 1-year warranty. Within 6 months it stopped working. The seller
refused repair. The consumer approached the district forum and got compensation.
This case shows the importance of being aware and using one's rights.
Conclusion
Consumer rights are essential in today's market-driven economy. Awareness and action are key to
protecting oneself. Every consumer must be vigilant, informed, and assertive.
