APPLICATION FOR GRANT OF BAIL UNDER SECTION 478 OF THE BHARTIYA
NAGARIK SURAKSHA SANHITA, 2023
MOST RESPECTFULLY SHOWETH:
That the petitioner is a law-abiding citizen with strong roots in the local
community. He has a permanent residence at No.44, H-Block
Apartments, 6th cross, Shankara nagar, Bengaluru 560100 and has
deep family and social ties, ensuring his presence during the trial.
That the petitioner, Mr. Ramesh Kumar, has been accused of an offence
punishable under Section 115 of the Bhartiya Nyaya Sanhita, 2023 for
allegedly causing voluntary hurt to his neighbour, Mr. Shyam Verma,
during a heated altercation on August 2nd 2025.
That the petitioner was arrested on August 4 th 2025 and is presently in
judicial custody at [name of jail/police station].
That the alleged offence under Section 115 of the Bhartiya Nyaya Sanhita
is bailable in nature, and hence, the petitioner is statutorily entitled to bail
under Section 478 of the Bhartiya Nagarik Suraksha Sanhita, 2023.
That the nature of the allegations does not disclose any grave injury or
use of any deadly weapon. The injuries sustained by the complainant, as
per the medical report, are minor and not life-threatening.
That the petitioner has cooperated fully with the investigation and has
made himself available to the investigating authorities whenever required.
He has not attempted to tamper with any evidence or influence any
witness.
That the petitioner is the sole breadwinner of his family, supporting his
aged parents, wife, and two minor children. His continued detention would
cause undue hardship to his dependents.
That the petitioner undertakes to abide by all conditions the Hon’ble Court
may impose while granting bail, including appearing before the Court as
and when required and not engaging in any act prejudicial to the
proceedings of the case.
That the petitioner further undertakes not to leave the jurisdiction of this
Hon’ble Court without prior permission and to maintain peace and good
behaviour throughout the pendency of the trial.
PRAYER
In view of the facts and circumstances stated hereinabove, it is most
respectfully prayed that this Hon’ble Court may kindly be pleased to:
a) Grant bail to the petitioner under Section 478 of the Bhartiya Nagarik
Suraksha Sanhita, 2023, in connection with the case registered under
Section 115 of the Bhartiya Nyaya Sanhita, 2023; and
b) Pass such other and further orders as may be deemed just and proper
in the interest of justice.
