PROGRESS REPORT
TUESDAY 20/05/25:
Attended a live hearing at the Supreme Court in the matter of All India Judges Association v.
Union of India. Took detailed notes on the arguments presented and the judgment delivered
during the session. Back at the firm, I carefully reviewed the annexures attached to the case file
for better understanding. Engaged in a thorough examination of the plaint provided to me,
analysing its legal and factual aspects. This exercise helped enhance my practical
understanding of constitutional law and judicial service matters.
WEDNESDAY 21/05/25:
Studied Order 39 Rules 1 and 2 of the CPC, which deal with temporary injunctions and
interlocutory orders. Alongside, I read Section 12A of the Commercial Courts Act, which
mandates pre-institution mediation in commercial disputes. I was assigned the task of
interpreting these provisions and exploring their interrelation. The focus was on constructing a
harmonious reading of the two legal provisions in light of recent case law. This activity honed
my analytical skills and understanding of procedural law in commercial disputes.
THURSDAY 22/05/25
I was given a U.S. patent number and asked to find its Indian equivalent, including the
application number and publication date. I searched through the Indian Patent Office database
to trace the relevant details. Alongside, I continued researching Order 39 Rules 1 and 2 CPC,
focusing on key judicial precedents. The day involved both IP research and procedural law
analysis.
FRIDAY 23/05/25
Worked on understanding the pre-grant opposition process under Indian Patent Law. I was
specifically asked to identify how such an application is filed and what it must contain. In
addition, I had to trace and review the documents relied upon by the opponent in such cases.
This research helped me understand the grounds and procedural intricacies of opposing a
patent. It was an insightful exposure to patent litigation and procedural safeguards in Indian IP
law.
SATURDAY 24/05/25
Spent the day going through case files thoroughly and preparing detailed written notes. I was
introduced to the Safe Harbour Rule under the Information Technology Act. Studied legal
provisions and precedents where the safe harbour protection was not extended to
intermediaries. This involved examining judicial reasoning behind exceptions to intermediary
liability. It improved my comprehension of digital platform regulations and intermediary
responsibilities in India.
MONDAY 26/05/25
Engaged with the case of Zydus v. Leeford, currently handled by the firm. Went through the
pleadings, facts, and issues involved in the litigation. Prepared structured notes summarizing
the factual background, legal questions, and arguments of both sides. This case provided
exposure to pharmaceutical patent disputes and trademark conflicts. Overall, it offered practical
insight into commercial IP litigation and ongoing case strategy.
