Critical thinking and writing
in legal research
In research, critical thinking is a kind of thinking in which you question,
analyze, interpret, evaluate and make a judgement about what you
read, hear, say, or write.
• In any research, you have to solve a problem, where it needs a critical
thinking.
• We have to analyze, skillfully, evaluating and synthesizing information
to form reasoned judgments and solve problems from the set
research questions.
• Applying critical thinking does not mean being negative or focusing on
faults. It means being able to clarify your thinking so that you can
break down a problem or a piece of information, interpret it and use
that interpretation to arrive at an informed decision or judgment (for
example responding to an opinion piece or understanding a political
motivation).
Major components of critical thinking in
research
1) Analyzing and Evaluating Information
2) Formulating Arguments and Ideas
3) Problem Solving
4) Making Informed Decisions
5) Developing Research Questions
6) Identifying Gaps in Knowledge
7) Improving Research Design
8) Synthesizing Information
Authorship and copyright of the original work
• Copyright is an intellectual property which is received from Copyright
Registrar Office.
• When an author writes a book, he/she has to receive the copyright of
the original work.
• For the copyright of a book, the author has to receive a ISSN number
from T.U. Library. International Standard Serial Number should be
taken for copyright registration.
• For the copyright registration of a journal, ISSN no. is to be received
from Nepal National Library.
Data Fabrication and how to remain ethical
• What is data fabrication?
Fabrication is the construction and/or addition of data, observations, or
characterizations that never occurred in the gathering of data or
running of experiments. Fabrication can occur when “filling out” the
rest of experiment runs, for example. Claims about results need to be
made on complete data sets (as is normally assumed), where claims
made based on incomplete or assumed results is a form of fabrication.
How to remain ethical ?
• To maintain ethical standards in research, researchers should
prioritize principles like informed consent, confidentiality, respect for
participants, honesty, and transparency.
• To remain ethical in research is very important in research.
• Unethical research work provides false research solutions.
• Major components to remain ethical in research
1) Informed consent
2) Protecting confidentiality
3) Respecting for participants
4) Honesty and Transparency
5) Intellectual Property
