Formal Mediation Script
Setting:
The mediation is conducted in a formal, neutral, and calm environment within the mediation center at the
Family Court premises in Secunderabad. The mediator facilitates the discussion between Ms. Shweta
(Petitioner) aka AISHWARYA and Mr. Rajasekhar (Respondent) to address their marital dispute and reach a
resolution.
Dialogs Starting:-
Mediator:
"Good morning, Mr. Rajasekhar and Ms. Shweta. Thank you for attending this mediation session. My role as a
mediator is to assist both parties in communicating effectively and working towards a mutually acceptable
resolution. This process is confidential and voluntary. Ms. Shweta, please present your concerns first."
Ms. Shweta (Petitioner) aka AISHWARYA aka AISHWARYA:
"Thank you. After our marriage in May 2010, we lived together for two months in a rented house in Kurnool.
The house was small and inadequate, and the income of Mr. Rajasekhar was insufficient to meet our daily needs.
I returned to my parental home due to the lack of financial and emotional support.
Later, Mr. Rajasekhar moved to Coimbatore for his business, sold it, and returned to Kurnool. However, he
made no attempt to bring me back to the matrimonial home or provide any maintenance. For the last two years, I
have been living separately and have not received any financial support. I have filed for divorce and
maintenance."
Mediator:
"Thank you, Ms. Shweta. Mr. Rajasekhar, you may now present your response."
Mr. Rajasekhar (Respondent):
"Ms. Shweta left the matrimonial home without my consent. While I acknowledge that the house in Kurnool
was small, it was what I could afford at the time. I was working to improve our living conditions. I did not bring
her back as I felt that her decision to leave was unjustified. I do not believe I should be held responsible for
paying maintenance since she left voluntarily."
Mediator:
"Thank you, Mr. Rajasekhar. Ms. Shweta, can you clarify why you believed it was necessary to leave the
matrimonial home?"
Ms. Shweta (Petitioner) aka AISHWARYA:
"The living conditions were inadequate, and there was no financial support. I felt I had no option but to return to
my parental home."
Mediator:
"Mr. Rajasekhar, do you acknowledge that the living conditions at the time may not have been sufficient for
both parties? Do you have anything to say regarding Ms. Shweta’s concerns?"
Mr. Rajasekhar (Respondent):
"I acknowledge that the house was small and that my financial situation was not strong at that time. However, I
was working to improve it. I believe Ms. Shweta could have stayed and addressed these concerns with me
directly."
Mediator:
"Mr. Rajasekhar, are you willing to address the financial concerns raised by Ms. Shweta, including providing
maintenance and ensuring better living conditions if reconciliation is an option?"
Mr. Rajasekhar (Respondent):
"Yes, I am willing to provide maintenance and improve living arrangements."
Mediator:
"Ms. Shweta, are you willing to consider reconciliation if Mr. Rajasekhar provides consistent financial support
and takes steps to improve living arrangements?"
Ms. Shweta (Petitioner) aka AISHWARYA:
"I am willing to consider reconciliation if there is a clear plan and commitment to address financial and living
arrangements."
Mediator:
"To summarize, both parties have expressed their willingness to resolve the issues. Mr. Rajasekhar agrees to
provide monthly maintenance and arrange for better accommodation. Ms. Shweta has agreed to consider
reconciliation under these conditions. I will draft an agreement outlining the following terms:
1. Mr. Rajasekhar will provide monthly maintenance to Ms. Shweta, effective immediately.
2. Mr. Rajasekhar will arrange for suitable living accommodations in Kurnool.
3. Both parties will engage in open communication to work towards reconciliation.
The draft will be provided for your review before signing. Follow-up sessions will be scheduled to monitor
