INTRODUCTION
Guatemala has a high homicide rate committed with firearms.
fire, it is a problem that is increasingly advancing due to the ease with which it
has when acquiring firearms. There are different reasons why they are committed
these types of crimes, such as extortion and murders of bus drivers,
as well as due to territorial disputes among criminal gangs.
Criminal investigation is supported by sciences that aid in clarification of
the crimes such as forensic ballistics, the science responsible for establishing analysis of
the ballistic elements found at crime scenes. The packaged evidence
and collected are analyzed in different forensic laboratories
depending on the type of evidence being packaged and depending on what it is
aims to find in them.
Therefore, INACIF being an auxiliary institution in Justice and in adherence to the
Law by which it is governed, collaborates to carry out meticulous studies on indications
sent by investigators from the Public Ministry (MP), equipped with
high technology and modern so that the analyses are objective and impartial and
help in the research with scientific foundations so that these are
valued during the Criminal Procedure. Among the inputs available to the
INACIF in the forensic laboratories highlights the Integrated System of
Ballistic Identification (IBIS), a tool that makes use of computer science to
store data and characteristics of casings, projectiles, and firearms,
counting on a database that is used for research everywhere
the country like that of other countries, since it is a season in which those who
they require data that can be easily accessed to obtain them without the need for
carry out procedures so that other places and countries can provide information and
contribute to the research.
For the use of this system, knowledge based on the analyses is necessary.
what can be acquired through it, as well as the type of material it uses
for obtaining the characteristics that a firearm can leave printed
in the ballistic evidence. Therefore, the investigative personnel must inquire and
be informed about the materials that INACIF uses to collaborate in the
investigation, as well as the services that DIGECAM provides so that
to make it easier for them and to make the investigation of crimes committed with weapons more agile
of fire.
Therefore, the research titled: "The use of the Integrated System of
Ballistic Identification (IBIS) for the clarification of events committed with
firearms in Totonicapán" has the general objective: To identify the use of
IBIS system as a tool for ballistic fingerprint analysis and its use
for the clarification of criminal acts committed with firearms in
Totonicapán, from which the specific objectives unfold, the first being:
detail the components, characteristics, and types of firearms that are
used in Guatemala, as a second specific objective is to establish
the studies conducted by INACIF and DIGECAM for the collection of evidence
Ballistics, the third specific objective is:
conceptualize the Integrated Ballistic Identification System IBIS, and as a fourth
The final specific objective is: Analyze cases committed with firearms
and the use given to the IBIS system for the investigation of criminal acts.
For the development of this research, the following question was raised:
What is the use of the Integrated Ballistic Identification System IBIS?
for the clarification of crimes committed with firearms in Guatemala?
which will be answered based on interviews conducted with justice entities,
having as subjects Public Ministry technicians, fiscal assistants, to
forensic doctors and judges of the Judicial Body working in the department
from Totonicapán. Focusing on the use and knowledge they have of the
professionals for the application of IBIS in research.
The research has a spatial scope covering the department of Totonicapán and
as a material scope, it was planned to analyze case files, but
Due to legal regulations, access to them was not achieved, becoming a limitation.
for the investigation of the work, there is also a second limit, which is the lack
of bibliographic material related to IBIS, as it is an identification system
recent, so there are no books and other materials that have information
of its functions and other aspects. And the units of analysis were: the Law of
Weapons and Ammunition, and the INACIF Law. This research aims to
intends to make a contribution to professionals responsible for the administration of justice
in the department of Guatemala so that you have knowledge that the system
IBIS being an almost new instrument in crime research, contributes
means that facilitate the relationship of crimes, whether committed in the same place or
in others, since it is known that organized crime encompasses different
territories and use the same material for the commission of crimes.
