Services provided to you by Mobile
Telecommunications Company Saudi Arabia ‫ وﻳﺸﺎر إﻟﻴﻬﺎ ﻓﻴﻤﺎ‬،("‫اﻟﻤﺘﻨﻘﻠﺔ اﻟﺴﻌﻮدﻳﺔ )"زﻳﻦ‬
(the “Zain”) hereinafter referred to as the ‫وﻓﻲ ﺣﺎل اﻻﺧﺘﻼف ﺑﻴﻦ‬. ("‫ﺑﻌﺪ ﺑــ)"اﻟﺸﺮﻛﺔ‬
“Company”. In case of con ict between the ‫اﻟﺸﺮوط واﻷﺣﻜﺎم اﻟﻮاردة ﻓﻲ ﻫﺬا اﻟﻌﻘﺪ‬
hereunder terms and conditions and the ‫واﻟﺸﺮوط واﻷﺣﻜﺎم اﻟﻮاردة ﻓﻲ أي ﻣﻦ‬
terms and conditions outlined in any of the ‫ ﻓﺈﻧﻪ ﻳﺘﻢ‬،‫أﻧﻈﻤﺔ أو ﻟﻮاﺋﺢ أو ﻗﺮارات اﻟﻬﻴﺌﺔ‬
regulations, bylaws or decisions issued by ‫اﻷﺧﺬ ﺑﻤﺎ ورد ﻓﻲ ﺗﻠﻚ اﻷﻧﻈﻤﺔ واﻟﻠﻮاﺋﺢ‬
the CITC, then the terms and conditions of the
‫ ﺟﺰءا ً ﻻ‬،‫ و ﺗُﻌﺘﺒﺮﻫﺬه اﻟﻤﻘﺪﻣﺔ‬.‫واﻟﻘﺮارات‬
CITC shall prevail. This introduction shall
constitute an integral part of this contract and .‫ﺴﺮ ﻣﻌﻪ‬ّ ‫ وﺗﻘﺮأ وﺗﻔ‬،‫ﻳﺘﺠﺰأ ﻣﻦ اﻟﻌﻘﺪ‬
shall be read and interpreted with it.

Article 2: De nitions ‫ ﻫﻲ ﺷﺮﻛﺔ اﻻﺗﺼﺎﻻت اﻟﻤﺘﻨﻘﻠﺔ‬:‫اﻟﺸﺮﻛﺔ‬.1
1.“Company” refers to the Mobile ‫ ﺷﺮﻛﺔ ﻣﺴﺎﻫﻤﺔ ﻋﺎﻣﺔ‬،(‫اﻟﺴﻌﻮدﻳﺔ )زﻳﻦ‬
Telecommunications Company – Saudi ‫ﻣﺴﺠﻠﺔ ﻓﻲ اﻟﻤﻤﻠﻜﺔ ااﻟﻌﺮﺑﻴﺔ اﻟﺴﻌﻮدﻳﺔ‬
Arabia (Zain), a Saudi public joint stock

telecommunications services. ‫أو اﻟﻤﻔﻮض ﻋﻨﻪ اﻟﺬي ﻳﻄﻠﺐ اﻹﺷﺘﺮاك ﻓﻰ‬
2.“Customer” refers to the natural or legal ‫اﻟﺨﺪﻣﺎت اﻟﺘﻲ ﺗﻮﻓﺮﻫﺎ اﻟﺸﺮﻛﺔ ﻣﻦ ﺧﻼل‬
person or their delegate who request the ‫ واﻟﺬي ﻳﻘﺮ ﻋﻠﻰ ﺑﻘﺮاءﺗﻪ‬،‫ﺗﻄﺒﻴﻖ ﻳﺎﻗﻮت‬
subscription in the Service provided by the
‫وﻓﻬﻤﻪ وﻣﻮاﻓﻘﺘﻪ ﻋﻠﻰ ﻛﺎﻓﺔ اﻟﺸﺮوط‬
Company through Yaqoot’s application. The
Customer acknowledges that he read, .‫واﻷﺣﻜﺎم اﻟﻤﺬﻛﻮرة ﻓﻲ اﻟﻌﻘﺪ‬
understood, and approved all of the ‫ ﻫﻲ ﻫﻴﺌﺔ اﻻﺗﺼﺎﻻت وﺗﻘﻨﻴﺔ‬:‫ اﻟﻬﻴﺌﺔ‬.3

3.“CITC” refers to the Communications and ‫ ﻫﻮ ﺟﻤﻴﻊ اﻟﺸﺮوط واﻷﺣﻜﺎم‬:‫ اﻟﻌﻘﺪ‬.4

4.“Contract” refers to the terms & conditions ‫اﻟﺨﺪﻣﺔ وأي ﻣﺮﻓﻘﺎت أﺧﺮى ﻣﺮﺗﺒﻄﺔ ﺑﻬﺬا‬
outlined hereunder, the Service request form, ‫اﻟﻌﻘﺪ واﻟﺘﻲ ﺗﻌﺘﺒﺮ ﺟﺰءا ً ﻣﻨﻪ وﺗﻘﺮأ ﻣﻌﻪ‬
and any other annexes attached to the
‫ واﻟﺬي ﻳﺤﻜﻢ اﻟﻌﻼﻗﺔ ﺑﻴﻦ‬،‫وﺣﺪة واﺣﺪة‬
contract herein which are considered an
integral part of this Contract and governs the ‫اﻟﺸﺮﻛﺔ واﻟﻌﻤﻴﻞ ﻣﻦ ﺗﺎرﻳﺦ ﺗﻔﻌﻴﻞ اﻟﺨﺪﻣﺔ‬
relation between the Company and the ‫ﺑﻤﺎ ﻳﺘﻮاﻓﻖ ﻣﻊ اﻷﻧﻈﻤﺔ واﻟﻠﻮاﺋﺢ واﻟﻘﺮارات‬
Customer upon activation of the service, and .‫اﻟﺼﺎدرة ﻋﻦ اﻟﻬﻴﺌﺔ‬
subject to the regulations, bylaws and ‫أو ﺧﺪﻣﺔ ﻣﻦ‬/‫ ﻫﻲ أي ﻣﻨﺘﺞ و‬:‫ اﻟﺨﺪﻣﺔ‬.5
decisions issued by the by CITC. ‫اﻟﺨﺪﻣﺎت اﻟﺘﻲ ﺗﻮﻓﺮﻫﺎ اﻟﺸﺮﻛﺔ ﻣﻦ ﺧﻼل‬
5.“Service” refers to any of the products ‫ﺗﻄﺒﻴﻖ ﻳﺎﻗﻮت ﺑﻤﻮﺟﺐ اﻟﺘﺮﺧﻴﺺ اﻟﻤﻤﻨﻮح ﻟﻬﺎ‬
and/or services requested by the Customer
‫ واﻟﻤﻮﺿﺤﺔ ﻓﻲ‬،‫ﺑﻨﺎءً ﻋﻠﻰ ﻃﻠﺐ اﻟﻌﻤﻴﻞ‬
and provided by the Company as stipulated
in the Service request form. .‫ﻃﻠﺐ اﻟﺨﺪﻣﺔ‬
6."Taxes” refers to the value added tax which ‫ ﻫﻲ ﺿﺮﻳﺒﺔ اﻟﻘﻴﻤﺔ اﻟﻤﻀﺎﻓﺔ‬:‫ اﻟﻀﺮﻳﺒﺔ‬.6
shall be added to the Customer bill in ‫اﻟﺘﻲ ﺳﻴﺘﻢ إﺿﺎﻓﺘﻬﺎ ﻟﻔﺎﺗﻮرة اﻟﻌﻤﻴﻞ وﻓﻖ‬
accordance with the prevailing laws of the ‫اﻷﻧﻈﻤﺔ اﻟﻤﺘﻌﻠﻘﺔ اﻟﻤﻌﻤﻮل ﺑﻬﺎ ﻓﻲ اﻟﻤﻤﻠﻜﺔ‬
KSA in addition to any other applicable taxes. ‫اﻟﻌﺮﺑﻴﺔ اﻟﺴﻌﻮدﻳﺔ و أي ﺿﺮﻳﺒﺔ أﺧﺮى‬
7.“Yaqoot” refers to the mobile phones app .‫ﻣﻄﺒﻘﺔ‬
from which the Customer can purchase and ‫ ﺗﻄﺒﻴﻖ ﺧﺎص ﺑﺎﻟﻬﻮاﺗﻒ اﻟﻤﺘﻨﻘﻠﺔ‬:‫ ﻳﺎﻗﻮت‬.7
subscribe to different packages and gifts
cards in addition to any other services ‫ﻳﺘﻴﺢ ﻟﻠﻌﻤﻴﻞ ﺷﺮاء واﻻﺷﺘﺮاك ﻓﻲ اﻟﺒﺎﻗﺎت‬
provided via the app from time to time. ‫ ﺑﺎﻹﺿﺎﻓﺔ إﻟﻰ ﺷﺮاء ﺑﻄﺎﻗﺎت‬،‫اﻟﻤﺨﺘﻠﻘﺔ‬
‫ وأي ﺧﺪﻣﺎت أﺧﺮى ﻳﺘﻢ‬،‫اﻟﻬﺪاﻳﺎ إﻟﻜﺘﺮوﻧﻴﺔ‬
Article 3: Customer’s Obligations .‫ﺗﻮﻓﻴﺮﻫﺎ ﻣﻦ ﺧﻼل اﻟﺘﻄﺒﻴﻖ ﻣﻦ وﻗﺖ ﻵﺧﺮ‬
[Link] Customer shall not use or allow the use ‫ اﻟﺘﺰاﻣﺎت اﻟﻌﻤﻴﻞ‬:‫اﻟﺒﻨﺪ اﻟﺜﺎﻟﺚ‬
of the Service or make any modi cations to ‫ ﻻ ﻳﺠﻮز ﻟﻠﻌﻤﻴﻞ اﺳﺘﺨﺪام اﻟﺨﺪﻣﺔ أو‬.1
the related software in violation of the laws
‫اﻟﺴﻤﺎح ﺑﺎﺳﺘﺨﺪاﻣﻬﺎ ﺑﻤﺎ ﻳﺨﺎﻟﻒ ﻟﻸﻧﻈﻤﺔ‬
and regulations of the Kingdom of the Saudi
Arabia or in violation of the terms and ‫أو‬،‫اﻟﻤﻄﺒﻘﺔ ﻓﻲ اﻟﻤﻤﻠﻜﺔ اﻟﻌﺮﺑﻴﺔ اﻟﺴﻌﻮدﻳﺔ‬
conditions of this Contract or for the purposes ‫أﺣﻜﺎم وﺷﺮوط ﻫﺬا اﻟﻌﻘﺪ أو أﻳﺔ ﺗﻌﻠﻴﻤﺎت‬
for which it has been allocated or any ‫ أو‬، ‫ﻣﻦ ﻗﺒﻞ اﻟﺸﺮﻛﺔ ﻣﻦ وﻗﺖ ﻵﺧﺮ‬
directives by the Company. The Customer ‫اﺳﺘﻌﻤﺎﻟﻬﺎ ﻟﻐﻴﺮ اﻷﻏﺮاض اﻟﺘﻲ ﺧﺼﺼﺖ ﻣﻦ‬
shall be responsible for any unlawful use of ‫ وﻳﻌﺪ ﻣﺴﺆوﻻ ً ﻋﻦ اﻻﺳﺘﺨﺪام اﻟﻐﻴﺮ‬،‫أﺟﻠﻬﺎ‬
the Service and all related consequences ‫ﻣﺸﺮوع وﻣﺎ ﻳﺘﺮﺗﺐ ﻋﻠﻴﻪ ﻣﻦ أﺿﺮاردون‬
such as the damages. ‫ﺣﺼﺮ‬
[Link] Customer warrants that all information
provided to register the account is correct and ‫ اﻟﻌﻤﻴﻞ ﻳﻀﻤﻦ ﺑﺄن ﺟﻤﻴﻊ اﻟﻤﻌﻠﻮﻣﺎت اﻟﺘﻲ‬.2
accurate. ‫ﻗﺎم ﺑﺘﺰوﻳﺪﻫﺎ ﻟﻠﺸﺮﻛﺔ ﻓﻲ ﺑﻴﺎﻧﺎت ﺗﺴﺠﻴﻞ‬
[Link] the mobile phone is lost, stolen or used .‫اﻟﺤﺴﺎب وﻫﺬا اﻟﻌﻘﺪ ﺻﺤﻴﺤﺔ ودﻗﻴﻘﺔ‬
without the Customer’s authorization, the ‫ إذا ﺗﻢ ﻓﻘﺪان اﻟﻬﺎﺗﻒ اﻟﻤﺤﻤﻮل أو ﺳﺮﻗﺘﻪ‬.3
Customers agrees to the following: ،‫أو اﺳﺘﺨﺪاﻣﻪ دون ﺗﻔﻮﻳﺾ ﻣﻦ ﻗﺒﻞ اﻟﻌﻤﻴﻞ‬
a)To immediately inform Yaqoot’s Customer :‫ﻓﺎﻟﻌﻤﻴﻞ ﻳﺘﻌﻬﺪ ﺑﺎﻵﺗﻲ‬
Care. .‫أ(ﺑﺈﺑﻼغ ﺧﺪﻣﺔ ﻋﻤﻼء ﺗﻄﺒﻴﻖ ﻳﺎﻗﻮت‬
b)The Company is under no obligation to
issue a refund to the Customer of the credits ‫ب(اﺑﺄن ﻟﺸﺮﻛﺔ ﻟﻴﺴﺖ ﻣﻠﺰﻣﺔ ﺑﺘﻌﻮﻳﺾ ﻋﻦ‬
in the account. .‫أي رﺻﻴﺪ ﻟﻠﺤﺴﺎب اﻟﻤﻌﻨﻲ‬
[Link] Customer shall comply obtaining the ‫ ﻳﻠﺘﺰم اﻟﻌﻤﻴﻞ ﺑﺎﻟﺤﺼﻮل ﻋﻠﻰ اﻟﺘﺮاﺧﻴﺺ‬.4
required licenses for the used application in ‫اﻟﻤﻄﻠﻮﺑﺔ ﻟﻠﺒﺮاﻣﺞ اﻟﻤﺴﺘﺨﺪﻣﺔ ﻓﻲ اﻷﺟﻬﺰة‬
the devises and tools with the obligation to ‫ ﻣﺮاﻋﺎة ﺣﻘﻮق‬،‫ ﺑﻤﺎ ﻓﻲ ذﻟﻚ‬،‫واﻟﻤﻌﺪات‬
preserve any intellectual property rights or ‫ أو أي ﺣﻘﻮق أﺧﺮى‬،‫اﻟﻤﻠﻜﻴﺔ اﻟﻔﻜﺮﻳﺔ‬
any other rights required to provide any
‫ أو‬،‫ﻣﻄﻠﻮﺑﺔ ﺗﺮﺗﺒﻂ ﺑﺘﻘﺪﻳﻢ أي ﺧﺪﻣﺎت‬
services during the entire Service provision
duration by the Company.
‫ﺗﺮﻛﻴﺐ أو اﺳﺘﺨﺪام أي ﻣﻌﺪات ﻓﻲ ﻣﻮﻗﻌﻪ‬
[Link] Customer may not rent, resell or assign ‫وذﻟﻚ ﻃﻴﻠﺔ ﻣﺪة ﺗﻘﺪﻳﻢ اﻟﺨﺪﻣﺔ أو إﺗﺎﺣﺘﻬﺎ ﻟﻪ‬
the Service without the prior written consent .‫ﻣﻦ ﻗﺒﻞ اﻟﺸﺮﻛﺔ‬
of the Company. ‫ ﻻ ﻳﺠﻮز ﻟﻠﻌﻤﻴﻞ ﺗﺄﺟﻴﺮ أو إﻋﺎدة ﺑﻴﻊ أو‬.5
[Link] Customer shall notify the Company of ‫اﻟﺘﻨﺎزل ﻋﻦ اﻟﺨﺪﻣـﺔ ﺑﺪون ﻣﻮاﻓﻘـﺔ ﻛﺘﺎﺑﻴﺔ‬
any changes in the information provided by .‫ﻣﺴﺒﻘـﺔ ﻣﻦ اﻟﺸﺮﻛـﺔ ﻋﻠﻰ ذﻟﻚ‬
him or by its authorized representatives. In
‫ ﻳﻠﺘﺰم اﻟﻌﻤﻴﻞ ﺑﺈﺷﻌﺎر اﻟﺸﺮﻛﺔ ﻋﻦ أي‬.6
addition, the Company shall not be
responsible for any for any acts that was ‫ﺗﻐﻴﻴﺮات ﺗﻄﺮأ ﻋﻠﻰ اﻟﻤﻌﻠﻮﻣﺎت اﻟﻤﻘﺪﻣﺔ ﻣﻦ‬
taking in reliance on the information provided ‫ وﻻ ﺗﻌﺘﺒﺮ‬،‫ﻗﺒﻠﻪ أو ﻣﻦ ﻗﺒﻞ اﻟﻤﻔﻮﺿﻴﻦ‬
by the Customer which was later proven to be ‫اﻟﺸﺮﻛﺔ ﻣﺴﺆوﻟﺔﺣﻴﺎل ﻗﻴﺎﻣﻬﺎ ﺑﺄي ﺗﻌﺎﻣﻼت‬
wrong. ‫ﺑﻨﻴﺖ ﻋﻠﻰ أﺳﺎس اﻟﻤﻌﻠﻮﻣﺎت اﻟﻤﻘﺪﻣﺔ إﻟﻴﻬﺎ‬
‫واﻟﺘﻲ اﺗﻀﺢ ﻋﺪم ﺻﺤﺘﻬﺎﻣﺎ ﻟﻢ ﺗﻌﻠﻢ ﻋﻦ‬
The customer who obtained the eSIM agrees .‫ﺗﻐﻴﺮﻫﺎ‬
and acknowledges that when the digital offers ‫ﻳﻮاﻓﻖ وﻳﻘﺮ ﺑﻌﻠﻤﻪ اﻟﻌﻤﻴﻞ اﻟﺤﺎﺻﻞ ﻋﻠﻰ‬
added or requesting any telecom services, all
services will be provided to him exclusively ‫( ﺑﺄﻧﻪ ﻋﻨﺪ إﺿﺎﻓﺔ‬eSIM) ‫اﻟﺸﺮﻳﺤﺔ اﻟﻤﺪﻣﺠﺔ‬

Article 4: Payment for the Service and the
nancial obligations:

and in accordance with the regulations ‫ ﻳﺘﺤﻤﻞ اﻟﻌﻤﻴﻞ ﻗﻴﻤﺔ اﻟﻀﺮﻳﺒﺔ إﻟﻰ اﻟﺤﺪ‬.5

The Customer shall be liable to compensate ‫وﺗﻀﺎف ﻗﻴﻤﺘﻬﺎ إﻟﻰ أﺟﻮر اﻟﺨﺪﻣﺎت ﻣﻮﺿﻮع‬

bills issued by the Company in accordance ‫ﻣﻬﻤﺎ ﻛﺎﻧﺖ ﻃﺒﻴﻌﺘﻬﺎ وﺳﺒﺒﻬﺎ وﻗﻴﻤﺘﻬﺎ ﻗﺪ‬
with the terms of payment determined by it in ‫ﺗﺘﻜﺒﺪﻫﺎ اﻟﺸﺮﻛﺔ ﻧﺘﻴﺠﺔ ﻟﻌﺪم ﻗﻴﺎم اﻟﻌﻤﻴﻞ‬

conditions of this Contract and the ‫ﺗﻄﺒﻴﻖ أي ﺗﻌﺪﻳﻞ ﻋﻠﻰ ﻫﺬه اﻷﺟﻮر وذﻟﻚ‬
regulations, bylaws and decisions of the ‫ وأﻧﻈﻤﺔ‬،‫وﻓﻘﺎ ً ﻟﺸﺮوط وأﺣﻜﺎم ﻫﺬا اﻟﻌﻘﺪ‬

payment of all the fees related to the
Service(s) generated from his mobile device,
‫ ﺑﻐﺾ‬،‫اﻟﺨﺪﻣﺎت اﻟﺼﺎدرة ﻣﻦ ﻫﺎﺗﻔﻪ‬/‫اﻟﺨﺪﻣﺔ‬
regardless of the way the Service was used ‫اﻟﻨﻈﺮ ﻋﻦ اﻟﻄﺮﻳﻘﺔ اﻟﺘﻲ ﺗﻤﺖ ﺑﻬﺎ اﻟﺨﺪﻣﺔ‬
or by whom. ‫ أو ﻫﻮﻳﺔ ﻣﻦ ﻗﺎم ﺑﺎﻻﺳﺘﺨﺪام‬،‫ﻣﻦ ﻫﺎﺗﻔﻪ‬
Article 5: Contract Period and Termination

enforceable from the date on which the SIM
card is activated by the Customer for the
duration of the activated package, according
to the Customers usage of the data. This
Contract shall be automatically renewed ‫ ﻣﺪة اﻟﻌﻘﺪ وإﻧﻬﺎءه‬:‫اﻟﺒﻨﺪ اﻟﺨﺎﻣﺲ‬
upon renewal of the package or by ‫ ﻳﻌﺘﺒﺮ ﻫﺬا اﻟﻌﻘﺪ ﺳﺎري وﻧﺎﻓﺬ اﻟﻤﻔﻌﻮل ﻣﻦ‬.1
purchasing new packages, unless the ‫ﺗﺎرﻳﺦ ﺗﻔﻌﻴﻞ اﻟﺨﺪﻣﺔ وﺣﺘﻰ ﻧﻬﺎﻳﺔ ﻣﺪة ﺳﺮﻳﺎن‬
Customer requests to change and/or cancel ‫ و ﻣﻦ ﺛﻢ ﻳﺘﻢ ﺗﺠﺪﻳﺪ ﻫﺬا‬، ،‫اﻟﺒﺎﻗﻪ اﻟﻤﻔﻌﻠﺔ‬
some or all of the services requested under ‫اﻟﻌﻘﺪ ﺗﻠﻘﺎﺋﻴﺎ ً ﻋﻨﺪ إﻋﺎدة ﺗﺠﺪﻳﺪ اﻟﺒﺎﻗﺔ أو‬
this Contract. Furthermore, the Customer will ‫ ﻣﺎﻟﻢ ﻳﻄﻠﺐ اﻟﻌﻤﻴﻞ‬.‫ﺑﺘﻔﻌﻴﻞ ﺑﺎﻗﺔ ﺟﺪﻳﺪة‬
lose the right of any unused balance or

2. Termination of the Service by the Customer ‫ﺗﻢ ﻃﻠﺒﻬﺎ ﺑﻤﻮﺟﺐ ﻫﺬا اﻟﻌﻘﺪ وﻓﻲ ﻫﺬه اﻟﺤﺎﻟﺔ‬
shall include porting the number to another ‫ﺳﻴﺴﻘﻂ ﺣﻖ اﻟﻌﻤﻴﻞ ﻓﻲ أي رﺻﻴﺪ أو‬
operator, or transferring the number to . ‫ﺧﺪﻣﺎت ﻏﻴﺮ ﻣﺴﺘﺨﺪﻣﺔ‬
another customer, and the Customer will lose ،‫ ﻓﻲ ﺣﺎل ﺗﻢ ﻧﻘﻞ اﻟﺮﻗﻢ إﻟﻰ ﻣﺸﻐﻞ آﺧﺮ‬.2

Article 6: Suspension or Termination of the
Service
‫اﻟﻌﻤﻴﻞ وﺳﻴﺴﻘﻂ ﺣﻖ اﻟﻌﻤﻴﻞ ﻓﻲ أي رﺻﻴﺪ‬
[Link] Customer shall have the right to .. ‫أو ﺧﺪﻣﺎت ﻏﻴﺮ ﻣﺴﺘﺨﺪﻣﺔ‬
request the termination or suspension of the
Service at any time in accordance with CITC’s ‫ ﺗﻌﻠﻴﻖ أو إﻟﻐﺎء اﻟﺨﺪﻣﺔ‬:‫اﻟﺒﻨﺪ اﻟﺴﺎدس‬
regulations, bylaws, and regulations. ‫ ﻳﺤﻖ ﻟﻠﻌﻤﻴﻞ أن ﻳﻄﻠﺐ إﻟﻐﺎء أو ﺗﻌﻠﻴﻖ‬.1

may suspend or terminate the Service. (90) ‫ ﺧﻼل ﻓﺘﺮة ﺗﺴﻌﻴﻦ‬،‫اﻟﻌﻤﻠﻴﺎت اﻟﺘﺎﻟﻴﺔ‬
[Link] Company at its sole discretion may ‫ ﺷﺮاء ﺑﺎﻗﺔ‬،‫ ﺗﺠﺪﻳﺪ اﻟﺒﺎﻗﺔ‬:‫ﻳﻮﻣﺎ ً ﻣﺘﻮاﺻﻠﺔ‬
suspend or terminate the Service in ‫ إرﺳﺎل رﺳﺎﻟﺔ ﻧﺼﻴﺔ‬،‫ إﺟﺮاء ﻣﻜﺎﻟﻤﺔ‬،‫ﺟﺪﻳﺪة‬
accordance with the regulations, bylaws and ‫ ﻳﺤﻖ ﻟﻠﺸﺮﻛﺔ ﺗﻌﻠﻴﻖ أو‬،‫أو ﺗﺼﻔﺢ اﻻﻧﺘﺮﻧﺖ‬
decisions issued by the CITC in any of the .‫إﻟﻐﺎء اﻟﺨﺪﻣﺔ‬
following cases: ‫ ﻛﻤﺎ وﻳﺤﻖ ﻟﻠﺸﺮﻛﺔﺣﺴﺐ ﺳﻠﻄﺘﻬﺎ‬.3
•The Customer’s violation of any of the terms
and conditions listed herein or in the
‫اﻟﺘﻘﺪﻳﺮﻳﺔ اﻟﻤﻄﻠﻘﺔ ﺗﻌﻠﻴﻖ أو إﻟﻐﺎء اﻟﺨﺪﻣﺔ‬
regulations, bylaws and decisions issued by ‫وﻓﻘﺎ ً ﻷﻧﻈﻤﺔ وﻟﻮاﺋﺢ وﻗﺮارت اﻟﻬﻴﺌﺔ ﻓﻰ أي‬
the CITC; :‫ﻣﻦ اﻟﺤﺎﻻت اﻟﺘﺎﻟﻴﺔ‬
•The Customer reports that SIM card or the ‫• ﻣﺨﺎﻟﻔﺔ اﻟﻌﻤﻴﻞ ﻷي ﻣﻦ اﻷﺣﻜﺎم أو‬
mobile device to be lost or stolen. ‫اﻟﺸﺮوط اﻟﻮاردة ﻓﻰ ﻫﺬا اﻟﻌﻘﺪ أو اﻷﻧﻈﻤﺔ‬
•The service was used without the Customer’s .‫واﻟﻠﻮاﺋﺢ واﻟﻘﺮارات اﻟﺼﺎدرة ﻋﻦ اﻟﻬﻴﺌﺔ‬
knowledge to make calls or send data that is
‫• ﻋﻨﺪ ﺑﻼغ اﻟﻌﻤﻴﻞ ﻋﻦ ﻓﻘﺪان أو ﺳﺮﻗﺔ‬
offensive.
•The Customer’s failure to update his/her .‫اﻟﺸﺮﻳﺤﺔ أو اﻟﺠﻬﺎز اﻟﻤﺤﻤﻮل‬
information, or if the Company found that the ‫• ﺗﻢ اﺳﺘﺨﺪام اﻟﺨﺪﻣﺔ ﺑﺪون ﻣﻌﺮﻓﺔ اﻟﻌﻤﻴﻞ‬
Customer has provided false or misleading .‫ﻹﺟﺮاء ﻣﻜﺎﻟﻤﺎت أو ارﺳﺎل ﺑﻴﺎﻧﺎت ﻣﺴﻴﺌﺔ‬
documents or information; ‫• ﻋﺪم ﺗﺠﺎوب اﻟﻌﻤﻴﻞ ﺑﺘﺤﺪﻳﺚ ﺑﻴﺎﻧﺎﺗﻪ ﻋﻨﺪ‬
•After thirty (30) days of the Customer’s death ‫ أو ﺛﺒﻮت ﺗﻘﺪﻳﻤﻪ ﺑﻴﺎﻧﺎت أو‬،‫ﻣﻄﺎﻟﺒﺘﻪ ﺑﺬﻟﻚ‬
where the heirs do not decide their position to .‫ﻣﻌﻠﻮﻣﺎت ﻣﻐﻠﻮﻃﺔ أو ﻣﺰورة ﻟﻠﺸﺮﻛﺔ‬
transfer or terminate the Service that was ‫( ﻳﻮﻣﺎ ً ﻣﻦ ﺗﺎرﻳﺦ ﻋﻠﻢ‬30) ‫• ﺑﻌﺪ ﻣﻀﻲ ﺛﻼﺛﻴﻦ‬
provided to the Customer;
•At CITC’s or any other governmental bodies’ ‫ وﻟﻢ ﻳﺤﺪد‬،‫أو إﺑﻼغ اﻟﺸﺮﻛﺔ ﺑﻮﻓﺎة اﻟﻌﻤﻴﻞ‬
request for such suspension or termination of ‫اﻟﻮرﺛﺔ ﻣﻮﻗﻔﻬﻢ ﺑﺨﺼﻮص ﻧﻘﻞ اﻟﺨﺪﻣﺔ أو‬
Service. .‫إﻧﻬﺎؤﻫﺎ‬
‫• ورود ﻃﻠﺐ اﻟﺘﻌﻠﻴﻖ أو اﻹﻟﻐﺎء ﻣﻦ اﻟﻬﻴﺌﺔ او‬
Article 7: Service’s Termination and .‫اﻳﺔ ﺟﻬﺔ ﺣﻜﻮﻣﻴﺔ اﺧﺮى‬
suspension procedures
Before the Company terminates or suspends :‫ آﻟﻴﺔ إﻟﻐﺎء وﺗﻌﻠﻴﻖ اﻟﺨﺪﻣﺔ‬:‫اﻟﺒﻨﺪ اﻟﺴﺎﺑﻊ‬
the Service, in any events other than the ones
in accordance with CITC’s discretion or any ‫ﺑﺎﺳﺘﺜﻨﺎء اﻟﺤﺎﻻت اﻟﺘﻲ ﺗﻘﺮرﻫﺎ ﻫﻴﺌﺔ اﻻﺗﺼﺎﻻت‬
other applicable laws, the following ‫وﺗﻘﻨﻴﺔ اﻟﻤﻌﻠﻮﻣﺎت او اﻳﺔ أﻧﻈﻤﺔ أﺧﺮى‬
procedure shall apply: :‫ﺳﺘﻘﻮم ﺑﻤﺎ ﻳﻠﻲ‬
a) Sending a noti cation to the Customer at ‫أ( إرﺳﺎل إﺷﻌﺎر إﻟﻰ اﻟﻤﺴﺘﺨﺪم ﻗﺒﻞ ﻋﻤﻠﻴﺔ‬
least ve days before any termination or ‫اﻟﺘﻌﻠﻴﻖ أو اﻹﻟﻐﺎء ﺑﺨﻤﺴﺔ أﻳﺎم ﻋﻠﻰ اﻷﻗﻞ‬
suspension via an SMS by the Company, and ‫( وﺳﻴﻮﺟﻪ ﻓﻴﻬﺎ‬SMS) ‫ﻋﺒﺮ رﺳﺎﻟﺔ ﻧﺼﻴﺔ‬
the Customer shall be directed how to avoid
‫اﻟﻌﻤﻴﻞ ﺑﻜﻴﻔﻴﺔ ﺗﺠﻨﺐ ﺳﺒﺐ اﻟﺘﻌﻠﻴﻖ أو‬
such termination or suspension in addition to
the termination or suspension’s dates. .‫ وﺗﺎرﻳﺦ ﺗﻌﻠﻴﻖ أو إﻟﻐﺎء اﻟﺨﺪﻣﺔ‬،‫اﻹﻟﻐﺎء‬
b) Sending another noti cation one day ‫ب( إرﺳﺎل رﺳﺎﻟﺔ أﺧﺮى ﻗﺒﻞ ﻋﻤﻠﻴﺔ اﻟﺘﻌﻠﻴﻖ‬
before any termination or suspension, in case ‫ ﻓﻲ ﺣﺎل اﺳﺘﻤﺮار‬،‫أو اﻹﻟﻐﺎء ﺑﻴﻮم واﺣﺪ‬
the reason for the termination or suspension ‫ﺳﺒﺐ اﻟﺘﻌﻠﻴﻖ واﻹﻟﻐﺎء‬
continues.

Article 8: Exclusion of Liability

The Company is not liable towards the
Customer for:
a)any increased costs or expenses;
b)for any loss of pro t, ravenous, business or :‫ إﺧﻼء اﻟﻤﺴﺆوﻟﻴﺔ‬:‫اﻟﺒﻨﺪ اﻟﺜﺎﻣﻦ‬
property; ‫اﻟﺸﺮﻛﺔ ﻏﻴﺮ ﻣﺴﺆوﻟﺔ أﻣﺎم اﻟﻌﻤﻴﻞ ﻋﻦ‬
c)any suspension or non-availability of any of :‫اﻵﺗﻲ‬
the Services; .‫( اﻟﺰﻳﺎدة ﻓﻲ اﻟﺮﺳﻮم واﻟﺘﻜﺎﻟﻴﻒ‬1
d)third party claims or damages; ‫( ﺧـﺴـﺎرة ﻓـﻲ اﻻرﺑـﺎح أو اﻷﻋﻤـﺎل‬2
e)any calls made or equipment being

‫ﻓﻲ ﺣﺎل ﻃﻠﺐ اﻟﻬﻴﺌﺔ أو أﺣﺪ اﻟﺠﻬﺎت اﻟﻤﻌﻨﻴﺔ‬
conditions of this Contract, the Arabic text
shall prevail. .‫ﻓﻲ اﻟﻤﻤﻠﻜﺔ اﻟﻌﺮﺑﻴﺔ اﻟﺴﻌﻮدﻳﺔ‬

approving the Service through Yaqoot’s app. I ‫وﻗﺒﻮﻟﻲ ﻷﺣﻜﺎم وﺷﺮوط اﻟﺸﺮﻛﺔ اﻟﻤﻨﺼﻮص‬
agree to the subscription fees of the data ‫ وﻋﻠﻤﻲ ﺑﺎﻟﻤﺨﺎﻃﺮ‬،‫ﻋﻠﻴﻬﺎ ﻓﻲ ﻫﺬا اﻟﻌﻘﺪ‬
bene ts based on the usage of the Service. I ‫اﻟﻤﺘﻌﻠﻖ ﺑﺈﻟﻤﻮاﻓﻘﺔ ﻋﻠﻰ اﻟﺨﺪﻣﺔ واﻟﺤﺼﻮل‬
also agree to authorize Zain to obtain my
‫ أواﻓﻖ ﻋﻠﻰ‬.‫ﻋﻠﻴﻬﺎ ﻣﻦ ﺧﻼل ﺗﻄﺒﻴﻖ ﻳﺎﻗﻮت‬
information from SIMAH if such action is
required, or any other company conducting ‫اﻹﺷﺘﺮاك ﻓﻲ ﺧﺪﻣﺔ اﻟﺪﻓﻊ ﺣﺴﺐ‬
the same commercial activity and share it with ‫اﻻﺳﺘﺨﺪام ﻟﻠﺒﻴﺎﻧﺎت ﺑﻌﺪ اﻹﻧﺘﻬﺎء ﻣﻦ اﻟﺤﺰﻣﺔ‬
any third party without any exceptions, and ‫اﻟﻤﺠﺎﻧﻴﺔ ﺑﻨﺎءا ﻋﻠﻰ اﻟﺘﻌﺮﻓﺔ اﻻﺳﺎﺳﻴﺔ‬
that will not be a breach of my privacy. ‫ ﻛﻤﺎ أﻗﺮ ﺑﻤﻮاﻓﻘﺘﻲ ﻋﻠﻰ ﺗﻔﻮﻳﺾ‬،‫ﻟﻠﺒﺎﻗﺔ‬
‫اﻟﺸﺮﻛﺔ ﻓﻲ اﻟﺤﺼﻮل ﻋﻠﻰ ﻣﻌﻠﻮﻣﺎﺗﻲ ﻣﻦ‬
‫ﺳﻤﺔ إن ﻟﺰم اﻷﻣﺮ ذﻟﻚ أو أي ﺷﺮﻛﺔ أﺧﺮى‬
‫ﺗﻤﺎرس ﻧـﻔﺲ اﻟﻨﺸﺎط وﻣﺸﺎرﻛﺘﻬﺎ ﻣﻊ أﻳـﺔ‬
‫اﻃﺮاف أﺧﺮى دون اﺳﺘﺜﻨﺎء وﻻ ﻳﻌﺘﺒﺮ ذﻟﻚ‬
