An Application U/S 151, CPC seeking implementation
of interim order dated 20.10.2021 through Police
Authorities i.e. SHO Police Station Gharota Jammu.
May it please your Honour;-
The applicant/ Plaintiff most respectfully submit as under:
1/- That the applicant/plaintiff has filed the above titled suit for
decree of permanent prohibitory injunction for restraining the
defendants, their agents, successors, assigns etc from
interfering into the peaceful ownership and possession of
Plaintiff over the land measuring 07 Kanals 18 Marlas falling
under Khasra No’s. 5643 (03 Kanal 18 Marlas) and 5644 (04
Kanal), situated at Revenue Village Bhalwal, Tehsil Bhalwal,
District Jammu.
2/- That upon considering the matter the Hon’ble Court was
pleased to pass ad-interim direction dated 20.10.2021whereby
the defendants/non-applicants are restrained from interfering
into the peaceful possession of the suit property. Copy of
order dated 20.10.2021 is enclosed herewith and marked as
Annexure-“A”.
3/- That the orders of the Hon’ble Court was duly served upon the
defendants/non-applicants and Defendant No.5 have been
appeared on 09.11.2021 before the Hon’ble Court and next
date of hearing is fixed for 28.03.2022.
4/- That in order to defeat the suit, the non-applicants on
11.03.2022 has voluntary defied the directions of the Hon’ble
Court and tried to start interfering the above titled suit land, in
order to demonstrate his possession over the suit land but the
said attempt was thwarted by the plaintiffs. The
defendants/non-applicants has threatened the plaintiff.
5/ That the defendants are influential persons and has money and
muscle power. As such it is imperative that SHO Police Station
Gharota Jammu be directed to get the interim order dated
20.10.2021 implemented in its letter and spirit, failing which
the suit of applicants/plaintiffs may become infractuous.
An affidavit in support of application is enclosed.
IN THE PREMISES:
It is, therefore, most respectfully prayed that keeping in
view the submissions made hereinabove and those to be urged
at the time of hearing, the Hon’ble Court be pleased to direct
SHO Police Station Gharota Jammu to get the interim order
dated 20.10.2021 implemented in its letter and spirit, in the
interest of justice.
