Judge: Let the proceeding begin! *bangs gavel*
Prosecutor: Your honour, for the past 7 years, 57
immigrants had encroached on a piece of land in the
Alwar district of Rajasthan, ma’am, these people were
refused to be taken back by their home country. The land
which the people had encroached was originally going to
be used for making a government hospital . So, my client
here, Mr Shantanu Bakshi sent a show-cause notice two
months prior to the immigrants for vacating the
government land.
Defence Lawyer: Did you hand-in-hand present the show
notice to the migrants Ms. Prosecutor?
Prosecutor: Your honour, the immigrants started
retaliating and created a mob which was led by Ms. Khan
as we can see in this video which was recorded in the
dashcam of the police car. This led to a police
involvement. In the process some cops were heavily
injured, the property was vandalised, and the bulldozing
equipment was destroyed. This calls for a lawful action
against them.
Defence Lawyer: Your honour, the prosecution forgot
about the part where due to the negligence of the IAS, and
the police, caused 6 immigrants to be heavily injured.
Prosecutor: Your honour, I would like your permission to
call upon Mr. Shantanu Bakshi.
Judge: Granted.
Prosecutor: Mr. Bakshi, could you please elucidate on
this incident?
IAS: 2 months prior, on June 29th, a show cause notice
was sent to these immigrants on behalf of the govt, to
inform them to vacate their houses within the given time
frame of 2 months. However, on the day of the incident,
the workers who were bulldozing the houses were
attacked, and equipment and property were destroyed.
The situation was totally getting out of hand, which called
for the interference of the police. While trying to calm the
situation down, the officers were injured.
Prosecutor: Thank you, Mr. Bakshi. Your honour, he has
been a faithful servant to the government, and has always
been looking out for the betterment of society which
includes the public healthcare facilities he has opened for
all the citizens.
Judge: Does the defence have anything to say?
Defence lawyer: Yes your honour. I have a few questions
to ask Mr. Bakshi. If I am not wrong,a government hospital
was supposed to be constructed on this land as suggested
by this master plan *showing the master plan to the
audience and the judge*
IAS: Yes. The land was originally going to be used for a
government hospital.
Defence Lawyer: *Amusing/it’s absurd* Hmm… But Mr.
Bakshi, I have heard something different from what you’re
saying. After contacting the contractor of this project, who
supposedly flew away to Switzerland, said that you, the mr
“opening public healthcare for all“ THE I.A.S” sold him this
government property for making a mall instead of the
following original idea of building a government hospital.
IAS: *panics*: What proof do you have? On what grounds
are you accusing me of?! I have always been an honest
man, I have done everything for the betterment of the
society.. how-how dare you–
(interrupts) Judge: *bangs gavel*: Order, Order!
Defence Lawyer: Proof? Oh yes, I surely do have proof.
Here is the contract between You *emphasis* Mr. Bakshi
and the Maurya Organisation, which clearly states that this
land has been sold to them. *passes the paper to the
judge* .
Your honour, as you can clearly see *points finger at the
stamp* the assent of the IAS. Judge *notes things*
IAS: This is not true! I have done no such thing! How dare
you put such vile and preposterous accusations on me?!
Your honour I am nothing but a devoted servant of this
Nation.. I-I-I have always been faithful to my duty!
*Nervously looks at the Prosecutor*
Judge *bangs gavel*: Order, Order!
Defence Lawyer: You may take your seat, Mr. Bakshi.
Prosecutor: Permission to call upon the officer Pragya
Singh who was present on the day of the incident, your
honour?
Judge: Granted.
Prosecutor: On whose orders were you called to the
place of the incident? Also explain what exactly you did
there.
Officer: On behalf of the orders of the IAS, we were called
to the place of the incident to calm the situation down. Our
officers were brutally attacked by the illegal immigrants.
This led to an FIR being lodged against these illegal
immigrants on account of attacking the police on duty,
destroying Government property and damaging
equipment.
Defence Lawyer: Your honour, may I present you the first
hand copy of the FIR the officers launched? *passes the
copy*
This FIR had been launched two days after the incident
took place. Would you mind telling us what caused this
delay of two days, Officer Pragya?
Police Officer: *hesitation* Since our officers, who were
brutally attacked on the scene, we were quite
preoccupied.. With.. *stuttering* ..
Defence Lawyer: *sarcastically* Officer, I’m sure in your 3
years of service, you must be knowing that an FIR, as the
name suggests, has to be lodged within 24 hours of the
incident. Can you kindly show us the picture you took
while giving the eviction notice, Officer?
Judge *looks at the officer in an interrogating tone*
Police Officer: *stuttering* We were in a hurry, so we
could not note everything down... *IAS officer, Police
officer and prosecutor look at each other*
Defence Lawyer: Thank you, Officer Pragya.
Your honour, permission to call upon the victim, Ms.
Tabassum Khan?
Judge: Granted.
*victim comes to the stand*
Defence Lawyer: Ms. Tabassum, was the eviction notice
handed to you?
Judge *focused on Ms Tabassum*
(VERY IMP- A LOT OF EMOTIONS)
Victim: *flustered* Eviction notice? What notice? I haven't
heard of anything like this.
Defence Lawyer :- Can you tell us what happened in
detail ?
Victim:- These people here are blatantly lying to your
faces. I have seen no such thing. I only know that I and my
people have been wronged. NO- NO NOTICE WAS
HANDED TO ME! I work 24X7, trying to make both ends
meet… I lost my family and close ones. I have nowhere to
go, no roof over my head. My house was crumbled into
pieces in a span of mere seconds and now.. I have been
declared an antisocial element, a threat to this society?
We are the sufferers of this society, the bearers of this
society. We are just a few powerless people with no
money,no land and no supporters and you say we are a
threat, a menace to this society? Oh lord life couldn’t be
more cruel.. I shall come to you lord. Your honour, I have
no reason to continue living… let me die ( x2).
Defence Lawyer *holding the victim* : As you may see,
your honour, the victim has been duly wronged in the first
place. Firstly the show-notice wasn't even handed to the
inhabitants nor did it actually exist. Secondly, the FIR that
needs to be lodged on the time of the incident was
delayed by 2 days and so called nuisance that the
immigrants created was a perfectly concocted plan of the
IAS and the officers to hide their negligence towards their
duty, and this is not the first time such a thing has
happened.
(The integrity and…..?) . That is all my lord, I rest my case.
Judge: Does the Prosecutor have anything to say?
Prosecutor: *hopeless* *Sighs* No, your honour.
Judge *writes things down*:(fixes glasses) (faintly) Alright.
*writes more things down* *5-7 seconds later*-
Having heard all the arguments for and against the case
and keeping in mind the provisions of the law, attracted in
each issue, I shall now pronounce my judgement. The
immigrants are hereby declared innocent, receiving a
compensation of_________ .
Due to the false case lodged by the IAS and the officer
and due to the sheer lack of their responsibilities which led
to the immigrants receiving grievous injuries, a new case
shall be lodged. Court is adjourned.
