Conditions of validity
-1. Neither the Society nor any of its officers, directors, employees, agents or sub-contractors shall be liable for any loss, damage or expense of whatever nature sustained by
any person, in tort or in contract or otherwise, due to any act or omission or error of whatever nature whether or not negligent howsoever caused in the provision of services,
information or advice given in any way whatsoever by or on behalf of the Society. In providing services, information or advice, neither the Society nor any of its officers,
directors, employees, agents or subcontractors warrant the accuracy of any information or advice provided.
-2. Notwithstanding the above 1., if any ship owner or any client of the Society suffers loss, damage or expense arising from the provision by the Society’s services, information
or advice which is proved to have been caused by any negligent act, omission or error of the Society or any of its officers, directors, employees, agents or sub-contractors,
or from any inaccuracy in the information or advice given by or on behalf of the Society, the Society will pay compensation for any proved loss, damage or expense up to
but not exceeding the amount of any fee charged and collected by the Society for the particular service, information or advice.
-3. This certificate is issued within the scope of “Conditions of Service for Classification of Ships and Registration of Installations” of the Society. It shall become invalid and
the ship’s classification is automatically suspended in accordance with the Rules, if;
i) the Annual Survey has not been completed within three (3) months of the due date of the annual survey; or
ii) the Intermediate Survey has not been completed within three (3) months of the due date of the third annual survey in each periodic survey cycle,
unless the vessel is under attendance for completion of the relevant survey.
