Sub: Moving a writ petition as urgent/lunch motion


against your notice dated 27.02.2023 relating to removal of
encroachment – intimation regarding.

1. It is stated that a property in Survey No.159/4 situates at


Thumbalam, Musiri Taluk, Trichy District was originally purchased by
Mallamuthuraja from one Periyanna Chettiar by way of a registered sale
deed in document No.2300/1952. Subsequently, he had executed power
deed in respect of various properties including the subject property in
Survey No.159/4 in favour of his wife Ariyanachiammal and three sons
namely Somu, Kathiresan and Velu. From in the year of 1952 to till
date, the title and possession over the property is vested with the legal
heirs Mallamuthuraja.

2. It is stated that earlier, the major portion of the property in Survey
No.159/4 was used by all the legal heirs and a small portion was used
as private pathway which was used only by his family members alone. It
is specific to mention here that the said portion is situated well within
the property in Survey No.159/4. While being so, when UDR process
was effected in respect of survey No.159/4, the property was sub-
divided as Survey Nos.159/4A-14 & 159/4A-15. In so far as survey
No.159/4A-14 is concerned, there is no dispute at all that the portion
belongs to our family members. But the revenue authorities had wrongly
made entry in respect of survey No.159/4A-15 as a common public
pathway. But actual and real facts remains that the small pathway is a
private pathway used by the family members of Mallamuthuraj.

3. It is stated that in the meanwhile, the adjacent owners


including one Marimuthu had been creating one after another issue in
respect of survey No.159/4A-15. Particularly, the said Marimuthu made
his claim that since the said property is mentioned in the revenue
records as common pathway, he is also entitled to use the property as a
common pathway.

4. It is stated that having aggrieved with such wrong entry in the


revenue records in respect of Survey No.159/4A-15 and in order to
correct the same, the son of Mallamuthuraj namely [Link] preferred an
appeal before your good office and the same was taken on file in Appeal
No.1461/2005. Subsequently, there was no progress.

5. It is stated that having no other way, Mr. Velu filed a civil suit in
[Link].137/2005 on the file of the Principal District Munsif Court,
Musiri against the Marimuthu and two others for permanent injunction
in respect of property in survey No.159/4A-14. An [Link].482/2005 was
also filed for interim injunction restraining the defendants/ respondents
therein. The Hon’ble Trial Court by an order passed in [Link].482/2005

dated 01.06.2005 granted an Ad-interim injunction till the disposal of
the suit.

6. It is stated that another suit was also filed by Velu in


[Link].229/2005 on the file of the Principal District Munsif Court,
Musiri against the Revenue Authorities including your good office. The
suit was filed in respect of both the properties in survey Nos.159/4A-14
(Acre 0.0691 cents) and 159/4A-15 (Acre 0.016 cents). An
[Link].872/2005 was also filed for interim injunction and the Hon’ble
Trial Court by the order dated 26.09.2005 granted interim injunction till
the disposal of the suit.
7. It is stated that it makes clear that both the civil suits are still
pending adjudication on the file of the Learned Trial Court and both the
interim injunctions granted in respect of the scheduled properties are
having effect till the disposal of the civil suits. The Revenue Authorities
well aware of the fact relating the pendency of two civil suits and the
interim injunctions granted therein.

8. It is stated that in those circumstances, the said Marimuthu


filed a writ petition on the file of this Hon’ble Court in
W.P.(MD)No.2646/2021 praying to issue a Writ of Mandamus directing
the respondents to remove the encroachment made in Survey
No.159/4A-15.

9. It is stated that from whole reading of the affidavit, it makes


clear that Marimuthu completely suppressed the pending civil suits in
[Link].137/2005 and 229/2005. More particularly, he also suppressed
the interim injunctions granted in both the civil suits.

10. It is stated that it is necessary to bring to notice of this Hon’ble


Court that during the pendency of the writ petition, Mr.

[Link] against whom allegation of encroachment was made
died.

11. It is stated that in those circumstances, that a final order has


been passed in the said writ petition in W.P.(MD)No.2646/2021 to the
effect that the representation of the petitioner shall be considered by the
respondents 1 and 2 therein and to pass final orders on merits and in
accordance with law. It is further ordered that if there is any
encroachment, after issuing notice, and conducting survey necessary
action has to be taken for removal of encroachment made in survey
No.159/4A-15 at Keelatheru, Thumbalam Village Post, Musiri Taluk,
Trichy District.
12. It is stated that in pursuance of this order, your good office
issued a notice dated 27.02.2023 thereby directed to remove the
encroached building and other properties in [Link].159/4A-15. Against
your notice dated 27.02.2023, one Vanaja wife of [Link] filed
a writ petition on the file of the Hon'ble High Court Madurai Bench of
Madras High Court on 17.03.2023 in W.P.(MD)[Link]. of 2023.
We are moving lunch motion today. The copy of the writ petition is
enclosed herewith.

This is for your kind information. It is hereby expressed that the


family members of Mallamuthuraj have been in peaceful enjoyment and
title over the property for the past 72 years. Hence, your good office may
not be taken any coercive action in respect of subject property in
[Link].159/4A-15 till the writ petition is getting finalized.
