CONCLUDING ANALYSIS

SUMMARY OF KEY FINDINGS

This thesis has explored the current legal and policy framework concerning refugees in
Bangladesh, primarily focusing on the Rohingya population. As previous findings indicate,
Bangladesh, despite a long history of hosting refugees, notably the Rohingya from Myanmar,
operates without specific national legislation governing refugee and asylum affairs. This reliance on
ad hoc policies and executive actions creates a precarious situation for refugees, as discussed in
depth in this analysis. While the Constitution of Bangladesh guarantees certain fundamental rights
to all persons within its territory, the lack of a dedicated refugee law leaves a significant protection
gap, particularly concerning non-refoulement and access to essential services. Absence of a
Comprehensive Legal Framework: This necessitates reliance on ad hoc measures, which are often
insufficient to guarantee the rights and well-being of refugees. As Chapter Six puts it, this
"piecemeal approach, relying on Memorandums of Understanding (MOUs) and the often-
inappropriate application of the Foreigners Act 1946, fails to provide the legal certainty and
comprehensive safeguards required to ensure the rights and dignity of refugees."

Rohingya refugees are frequently classified as "undocumented migrants" rather than recognized
refugees, depriving them of essential rights and protections.

While constitutional articles such as 31, 32, and 33 provide certain rights, the Foreigners Act 1946
grants broad discretion to authorities regarding the detention and deportation of non-citizens,
thereby undermining these protections.

Inadequate Implementation of Legal Aid: Although the Legal Aid Act 2000 aims to provide free legal
assistance, practical barriers such as language differences and restrictions on movement limit
refugees' ability to access these services.

Law enforcement agencies are tasked with managing refugees, but the lack of specialized training
and clear legal guidelines can result in practices that compromise the protection and dignity of
refugees.

As detailed in Chapter Six, potential resource constraints, concerns about national security and
increased burden on local communities, and resistance from political groups and public opinion
significantly hinder legislative progress.

These findings reinforce the urgent need for a comprehensive and legally sound framework to
ensure the rights and well-being of refugees in Bangladesh, while also acknowledging the
significant obstacles to achieving this goal.

POLICY RECOMMENDATIONS
Based on the analysis and integrating the proposed framework from Chapter Six, several policy
recommendations emerge for Enacting a Comprehensive Refugee Protection Act & this Act must
include:

1. Clear definitions of refugee status, asylum seekers, and stateless persons in line with
international standard.

2. Enshrined rights and protections, including non-refoulement and access to basic necessities.

3. Provisions to mitigate socio-economic challenges, such as targeted development programs for


host communities.

4. Measures to ensure security for citizens and refugees, balancing rights with responsibilities.

5. Clear laws for repatriation and safeguards to ensure voluntary, dignified, and sustainable
returns.

6. Fair and efficient Refugee Status Determination (RSD) procedures.

7. The creation of a National Refugee Agency to oversee all aspects of refugee protection ;

As highlighted in Chapter Six, securing long-term international funding and technical assistance is
crucial to address resource constraints. Multilateral mechanisms and partnerships with UN
agencies should be expanded to co-fund essential services. The government must actively engage
with local communities, addressing grievances and promoting social cohesion through dialogue
and targeted development programs. Public awareness campaigns that highlight the benefits of
refugee protection and address misinformation are essential to counter xenophobic attitudes.
These policies would provide a more structured and rights-based approach to refugee
management in Bangladesh.

3. FUTURE OUTLOOK

The future outlook for refugee protection in Bangladesh depends on several factors, including the
government's political will, international support, and the ability to address underlying challenges.
As Chapter Six indicates, the adoption of a comprehensive Refugee Protection Act would yield
significant benefits for Bangladesh, both domestically and internationally, including greater
compliance with international standards, clear procedures for managing refugee influxes, and
strengthened collaboration with international organizations. However, the challenges identified in
Chapter Six cannot be ignored. Without sustained international funding, addressing security
concerns, and overcoming resistance from political groups and public opinion, the implementation
of a robust refugee protection framework will remain a distant prospect.

4. CALL TO ACTION

Based on the findings of the current study and the proposed legal framework, there needs to be a
consolidated effort from all state actors and civil society to come together and create a more
sustainable framework. This requires that legislature create proper legislation to address the
problem, the judiciary provide judgement that are aligned with basic human rights and the
executive branch to implement the recommendations of the previous frameworks to create better
protection for refugees. The analysis of various legal and policy frameworks indicates the current
systems lack the capacity to efficiently handle the pressing needs of the refugees.

CONCLUDING REMARKS

The protection of refugees in Bangladesh is a multifaceted challenge that requires a


comprehensive and legally sound approach. As emphasized throughout this study, and particularly
in Chapter Six, the absence of national refugee legislation has created significant gaps and
vulnerabilities within the existing framework. By enacting specific laws, securing international
support, addressing security concerns, and fostering social cohesion, Bangladesh can enhance its
capacity to protect refugees while promoting social stability and upholding human rights.
Ultimately, addressing these challenges requires a commitment to building a more inclusive and
just society for all, including those who have sought refuge within its borders. This can be achieved
through the implementation of policies that are aligned with international standards and adapted
to the unique needs of the country.
