MOST RESPECTFULLY SHOWETH:

1. That, the present case pending before this Hon’ble Court, and the

same was fixed for 19.12.2024.

2. That, the complainant/aggrieved has filed the present case before this
Hon’ble court on 04.01.2021 and the same was listed on 19.12.2024
and on the same date i.e., 04.01.2021, the complainant/aggrieved not
filed hard copy of the petition before this Hon’ble court.

3. That on 19.02.2021 this hon’ble court issued notice/summons to the

respondents, thereafter the complainant/aggrieved not filed the PF on
serval date of hearings and thereafter the complainant/aggrieved filed
PF and notice were issued to the respondents.

4. That thereafter the process server met with the brother namely Sarfraz
(who is originally Respondent no. 7) of the Respondent no. 2,7,8, who

respondent no. 2,5,6,7,8 they have not contacted with the respondent
no. 1. The process server not enquired about the others respondents
and not informed to respondent no. 7 and your family members also
respondents in the present case.

5. That as per the order dated 02.06.2023, someone appeared on behalf

of the respondent no. 2 to 9, the respondents not approached the
Advocates, or neither to be authorized to any person to appear in this
matter, because the respondents neither the knowledge the above-
mentioned case pending against him. However, who counsel/Person
have been appeared in this matter, the counsel named not on record,
even the enrollment number of the counsel is not mentioned in the
order sheet, no such memo of appearance on record.

6. That on 06.09.2023, this Hon’ble court proceed Ex-parte to the

respondents, the respondent no. 3 and 4 not appeared because the
respondent no. 3 and 4 they are husband and wife, they are not reside
in the given address by the complainant/aggrieved, they reside
separately in last 9 years, in their rented house i.., house no. B-15 7,
OLD SEEMA PURI JHILMIL EAST DELHI- 110095. The copy of
Aadhar’ card of the respondent no.3 is annexed herewith as
Annexure A-1.

7. That thereafter, in year 2020 the respondent no.3 purchased a flat and

they shifted to the own house ie., 4-77, MAIN SHALIMAR

GARDEN 3™ FLOOR GHAZIABAD UTTRA PRADESH. They
had not received the summons/notice, thereafter the respondent no. 1
arrested in the case of FIR no. 595 of 2022, under section 498A, 406,
34 IPC, PS. Neb Sarai, after the arrest of the respondent no.1 the police

official call to the elder brother of the respondent no. 1, 3, 5, 9, the

elder brother informed about the said incident regarding the arrest of
the respondent no. 1.

. That, thereafter the police official produced to the respondent no. 1

before this Hon’ble Court and this Hon’ble court sent to the JC to the
respondent no.1.

. That, the respondents could not appear before the Hon’ble court prior
to 04.11.2024 and did not get the information prior to 04.11.2024, that
present case is pending against the respondents and since they have
not aware/known about the present case is pending before this Hon’ble
Court that’s why the respondent no.3 and 4 could not appear before
this Hon’ble court.

[Link], on 03.11.2024 the respondent no. 3 and 4, they contacted to the

Advocate Mr. Sahil Verma, and very next day the case is listed before
this Hon’ble court on. 04.112024, the counsel of the above
respondents entered his appearance before this Hon’ble Court.

[Link] on 04.11.2024 the lawyers have called for strike and abstaining
from work today i.e., 04.11.2024m the respondent no. 3 appeared in
person.

[Link] thereafter the counsel for the respondent’s advice that you can
file the certified copy of the court file and handover to the counsel.

[Link] respondent counsel received the certify record of the judicial file
in last week of November, and thereafter the counsel prepares the
further proceedings.

[Link] the respondents or his counsel could not appear before this
Hon’ble court due to above mentioned reasons only and the
respondents is having a good case in his favor as the
petitioner/aggrieved had filed a false and frivolous case before this
Hon’ble court against the respondents and the absence of the
respondent or his counsel before this Hon’ble court neither
deliberately nor intentional in the Hon’ble court and the respondents
will suffer great irreparable losses without any cause of her part, in the
ex-parte order dated: 06.09.2023 is not set aside by this Hon’ble Court.

[Link] on 16.10.2018, the father of the applicant/respondent no.3

namely Late Mr. Hakim Ali, filed complaint before the District
Magistrate Ghaziabad and thereafter on 17.10.2018 the father of the
respondent published a notice in the newspapers, that the father
disowned respondent no. 1 and complainant/aggrieved, and thereby
debarred from own property. The copy of the complaint and
newspaper annexed herewith as Annexure A2 & A3.

[Link] on 28.01.2020, the mother of the respondent no. 3 (who is

originally respondent no. 2) filed the complaint against the respondent
no. 1 and complainant/aggrieved. The complainant/aggrieved and
respondent no. 1 not reside with the respondent no. 3 and 4, said fact
also recorded in the complaint which is given by the respondent no. 2,
against the complainant/aggrieved and respondent no.1 The copy
of
the complaint dated 28.01.2020 annexed herewith as Annexure
A4,
