Q. a) Define Lien

FR 9(13)
The right of a [Link] to hold substantively a permanent post including a tenure post in
which he has been appointed substantively.

b) In what circumstances does a [Link] - i) Acquire lien ii) Retain lien

i) Acquire lien- FR 12(A)- A [Link] on substantive appointment to any permanent post


acquires a lien on that post and ceases to hold any lien previously acquired on any other
post i.e a lien on a post is acquired only when the employee has been confirmed and made
permanent on that post but not earlier.

ii) Retain lien- A govt. servant holding substantively a permanent post retains a lien on that
post- a) while performing the duties of that post b) while on foreign service or holding a
temporary post lr officiating in another c) during joining time or transfer to another post d)

FR 53(1) (ii) - Subsistence Allowance

a) Subsistence allowance- monthly grant made to a [Link] who is not in receipt of pay

i) for the first 3 months, to a subsistence allowance equal to leave salary admissible if he/she

ii) On expiry of the first three months of suspension, the subsistence allowance may be
varied/revised by the competent authority
It may be increased upto 50% if the [Link] is not responsible for the prolonged
suspension.
It may be reduced upto 50% if the suspension is prolonged due to reason directly
attributable to the [Link].

iii) in what cases, (i),(ii) above, dearness allowance appropriate to the subsistence allowance
is admissible

iv) Compensatory allowance drawn due to suspension may be continued if the suspending
authority is satisfied that the [Link] continues to meet the expenditure for which they
are granted.
No payment is admissible if the [Link] under suspension is engaged in any other
employment, business, profession or vocation. Hence, the [Link] under suspension is
needed to furnish non engagement certificate for drawal of subsistence allowance. - FR 53

Rs. 7400 w.e.f 01/07/2018 was punished for misconduct by withholding his next increment
for 1 year, passing an order dated 30/05/2019 by the competent authority.

FR 53- Subsistence Allowance

Q. A [Link] drawing basic pay of Rs. 30060 pm in the pay band Rs. 14000….70000
plus GP of Rs. 8700 pm w.e.f. 01-07-2018 was suspended from [Link] w.e.f. 01-01-
2019. Pending finalisation of the departmental proceedings against him, he was reinstated in
[Link] w.e.f. 01-07-2019. The reason for delay in finalisation of the departmental
proceedings(DP) was not attributable to the [Link] under suspension. Calculate the
rates of subsistence allowance payable to the suspended [Link] during the period of
suspension indicating the basic pay on the date of reinstatement along with the date on
which the next increment is due.

Solution:

Suspension period 01-01-2019 to 30-05-2019

Subsistence Allowance (01-01-2019 to 31-03-2019) = Rs. 30060 * 50%


= Rs. 15,030/- pm

Again, subsistence allowance (01-04-2019 to 30-06-2019) = Rs. 15030 + (15030 * 50%)

Earned Leave - Rule 9, Leave Rules 1934. 30 ELs in a year, in two installments (15 days
each on first of January and July)
Max limit of carry forward leaves- 300 days
Rule 9.2: Max EL that can be granted at a time- 180 days
9.4: EL- 2.5 per completed calendar month of service. Credited half yearly.
If retirement/resignation is approaching then only upto the date of retirement resignation.
Removal/dismissal/death- upto month preceding the calendar month in which he is
removed/dismissed/died
If EOL taken in a half year then credit to leave account shall be reduced by 1/10th of period
of EOL availed in previous half year (max 15 days)

Half pay leave- Rule 13, 20 days in a completed year of service. Medical certificate or
private affairs.
Half pay leave account- only if in credit, we can apply for commuted leave on medical
ground. If availed, double to be subtracted

Commuted leave- Rule 13(c)


Completed years of service- One year continuous service (period on duty, on leave including
extraordinary leave)

EOL- on completion of one year, 3 months of EOL

For max leave encashment benefits, try not to avail EL. Instead apply for Commuted half pay
leave on medical ground

Rule 4- ‘Leave cannot be claimed as right’ Discretion is reserved to the authority.
