● You must provide reasonable accommodations for any person with a disability. You should do
everything you can within reason, but you are not required to make changes that would
dramatically alter the community or create a financial burden.
● Housing specifically designed for 55+, solely 62 years and older or housing to assist the elderly
under a federal or state program are exempt from prohibiting familial discrimination.
● You may impose reasonable occupancy standards to prevent overcrowding.
● In 1988 Handicap & Familial Status were the last protected classes to be added to the seven
protected classes.
● In 2017, a federal judge in Denver ruled that the federal law barring housing discrimination
protects LGBT people. This judge ruled that they shall be protected under “sex” and they are
included.
● In 2021, Bidens administration ordered all agencies across the federal government to review
existing regulations and policies and revise them to expand “sex” to include sexual orientation
and gender identity.
● HUD announced the Fair Housing Act’s sex discrimination provisions are comparable to Title VII of
the Civil Rights act on this and announced that the Fair Housing act, when it comes to fair housing
laws, “sex” now includes sexual orientation and gender identity.
● Although, Sexual Orientation & Gender Identity are not protected classes themselves, they are
protected under the Fair Housing Act now under “sex.” One of the seven protected classes.
● As of 2021, Sexual Orientation & Gender Identity are protected under the Fair Housing Act now
under “Sex.”
