APPLICATION/PETITION TO WIRETAP

I, Police Lieutenant John D. Santos, Badge No. 123456, of the Philippine


National Police (PNP), Anti-Cybercrime Group, following the proper administration
of an oath as per legal requirements, I solemnly affirm and declare the subsequent
information:

1. That I am a law enforcement officer duly authorized to conduct


investigations and enforce the law under the Cybercrime Prevention Act of 2012
and other relevant Philippine laws.

2. That there is an ongoing investigation into the crime of online fraud


and identity theft, in violation of Republic Act No. 10175, the Cybercrime
Prevention Act of 2012.

3. That I have reason to believe, based on probable cause, that


intercepting and recording private communications through electronic means
between Juan R. Cruz, the suspect, and other individuals involved in this fraudulent
activity is necessary to gather evidence related to the aforementioned investigation.

4. That the probable cause is based on the following facts and


circumstances:

a. A complaint filed by multiple victims stating that they have been


defrauded through fake online transactions;

b. Evidence recovered from the victims' communication records showing


contact with the suspect through email and social media platforms;

c. Verified identification of Juan R. Cruz as the individual receiving


payments from the victims through various bank transfers and online wallets;

d. Testimony from a confidential informant who revealed the suspect's


ongoing involvement in a larger online fraud syndicate.

5. That I am requesting the issuance of an order authorizing the


interception and recording of private communications through electronic means,
specifically email correspondences, phone calls, and social media messages
involving Juan R. Cruz, for a period of 30 days, as allowed by law.

6. That I am executing this Application/Petition to Wiretap in good faith


and without any intent to harass or oppress any person, and for the sole purpose of
obtaining evidence necessary for the investigation and prosecution of the offense
mentioned above.
As a testament to this, I have hereunto affixed my signature this 14thday of
November 2024, in Butuan City, Philippines.
