developers need complete understanding of these complex legal matters to prevent development problems. The
following article examines real estate development legal problems through agency rules and intellectual
property law and negotiable instruments and business structure principles described in the course materials.
1. Land Acquisition and Zoning Issues
The initial essential step for real estate development begins with acquiring the land. A developer needs to
verify that the acquired land title remains unencumbered by liens or mortgages or any other ownership claims
that would block the sale. The process to buy land under the law demands extensive investigations which
include title examinations and confirmation of ownership records. The process of buying land faces a significant
challenge because of zoning regulations. Real estate developers need to verify that the acquired land has proper
zoning permissions which match their planned development purpose between residential and commercial or
