Duties of an Advocate under the Advocates Act, 1961 and Bar Council Rules
Introduction
The legal profession holds a very important position in society. Advocates not only represent their clients but also
assist in the smooth functioning of the justice system. The Advocates Act, 1961 governs the legal profession in
India. It defines who an advocate is and lays down their qualifications, rights, and duties.
To ensure discipline and professionalism, the Bar Council of India (BCI) and State Bar Councils were created.
These bodies regulate the conduct of advocates and ensure they follow proper ethical standards and professional
etiquette. The Bar Council Rules, especially the rules on Standards of Professional Conduct and Etiquette, guide
advocates in their conduct.

Advocates are expected to treat each other with respect and courtesy, report unethical conduct if observed, and support junior advocates by offering mentorship as experienced professionals. These interactions foster a cooperative and ethical environment that not only enhances individual professional growth but also elevates the entire legal profession's standards through mutual respect and shared knowledge .

Continuous learning is essential in the legal profession as laws and regulations frequently change. The Bar Council Rules emphasize that advocates must stay updated with these developments to provide accurate legal advice and remain competent. This commitment to learning not only enhances an advocate’s expertise and reliability but also ensures that they uphold the profession's honor by providing the most current and informed representation to their clients .

Advocates have the responsibility to improve access to justice by assisting the poor and needy, even by providing free legal aid. They should promote legal awareness to enhance citizens' understanding of the law and their rights. Advocates must fight against injustice, corruption, and misuse of power. These responsibilities are crucial as they reinforce the advocate's role in upholding the rule of law and ensuring justice is accessible to all sections of society, supporting a fairer legal system .

It is critical for advocates to refrain from misleading the court or hiding important facts to ensure that justice is served. The court relies on the accurate presentation of facts to make informed decisions. Deceptive practices undermine the integrity of the judicial process, potentially leading to unjust outcomes. Maintaining honesty upholds the court's trust in the legal profession and aids in achieving fair and truthful justice .

The core duties of an advocate towards the court include maintaining respect and decorum in the courtroom, assisting the court by presenting facts truthfully to help reach the right decision, ensuring confidentiality of client information unless legally obliged to reveal it, obeying court orders respectfully even when disagreements arise, being honest by not misleading the court or hiding facts, avoiding unnecessary delays by being prepared, and refraining from personal criticism or attacks on the court’s integrity .

The Act stipulates that advocates should avoid using pressure tactics or tricks to win a case unfairly, behave respectfully towards the opposing counsel, and avoid filing false or unnecessary cases. These rules ensure that legal proceedings are conducted in a manner that respects the judicial process and upholds justice, preventing the legal system from being misused for personal vendettas or obstruction of justice .

The Advocates Act, 1961 emphasizes loyalty and dedication by mandating advocates to prioritize their client’s interests above personal gain. This includes providing skilled representation, regular communication about case progress, ensuring informed consent for important decisions, and avoiding conflicts of interest that could compromise loyalty. This framework ensures that the client's needs and interests are foremost in the advocate's professional conduct .

The ethical standards highlighted include avoiding personal gain from unethical practices, not making false claims, and avoiding misleading advertisements. These standards ensure that advocates conduct themselves in a manner that protects the integrity and dignity of the legal profession. Compliance with these ethics fosters trust in the legal system and ensures that advocates serve as exemplars of honesty and integrity in society .

Advocates must follow the Code of Ethics and comply with the rules set by the Bar Council of India or State Bar Councils, pay dues such as membership fees on time, and actively participate in council elections, seminars, and discussions. These responsibilities help ensure that advocates maintain their professional integrity and are engaged with the legal community's ongoing developments, contributing to both personal professional development and the broader enhancement of the legal system .

The Bar Council of India ensures adherence to ethical standards by setting out the Standards of Professional Conduct and Etiquette, which guide advocates in their professional conduct. The Council also monitors compliance through its regulatory framework, allowing for the reporting of misconduct and pursuing appropriate action against unethical behavior. This system fosters accountability and maintains the high standards of professionalism expected in the legal profession .
