Tutorial Exercise 1: ‘The Rohingyan’

Issue in this question: Whether the fight and the eventual stabbing and slashing done by the accused
which causes the death of the deceased, may fall under any of the exceptions provided under section
300 of the Penal Code.

Probable applicable exception: Grave & Sudden Provocation

Meaning of Grave provocation: An act or behavior of the victim, which may cause a strong emotional
reaction in the accused’s mind, which may in turn cause him to lose his power of self-control. This must
be something that is highly affecting the emotion of the accused – this is analyzed by looking at the
overall scenario as well as the background of the accused’s experience himself.

Meaning of Sudden provocation: The act of provocation must be something that is not pre-planned to
have the effect or constructed in such a way, so as to exact a reaction from the accused. It should also
not be a result of the accused’s own initial provocation. The provocation must come as a surprise to the
accused (not expected).

The question: Whether the causing of death may have fallen under the exception to S. 300

In this situation, we need to assess the state of mind of the accused, under the circumstances he was in.

As an illegal immigrant, a person may naturally be under a constant desperate situation. The continuous
taunting of the victim may have aggravated this underlying emotional state into aggression. Imagine a
person constantly being bullied by threats; the anger he was harboring grew more intense and he may
possibly, at a certain point, explode in emotion. This could be what happened to the accused at the time
in question.

The fact above, coupled by the challenge to a fight, may be considered as a provocation grave enough to
fit in the provision of the exception. As to the issue of the flight of the deceased, prior to the act of
killing in question, it may still be considered as a ‘continuous transaction’ in the course of the fight and
therefore may not be considered as a period of possible cooling down and reconstruction of intent on
the part of the accused. It was very much part and parcel of the initial fight that broke out.
