3. Marital rape (219.4):
a. Punishment up to 5 yrs imprisonment
b. Marital relation does not sustain if;
 There is proceeding for divorce
 The wife is already separate having partition property
 The wife is living separate to seek legal remedy

In these three conditions if husband makes sexual assault upon her, he is

guilty of rape like other than with his wife.

c. Interim order (219. 5) - the court may issue interim order as

follows

 To give logistic support to the wife

4. Rape under undue influence (221, 222, 223)
a. Strict liability

rape as per the age group of the victim and punished
accordingly. He is also liable additionally 3 yrs

5. Pedophile (indecent assault with children) (sec. 225, 226.3)

a. Indecent assault with children – punishment up to 3 yrs

6. Transmission of AIDS:
a. Intentional Transmission of Aids to the victim - up to 10 yrs

c. Transmission of AIDs with combined with rape activity –
punishment as per the rape law + up to 10 yrs imprisonment and up
to one lakh fine.
d. Transmission of other kind of sexually transmitted diseases
whether intentionally, recklessly or negligently- punishment up to
3 yrs imprisonment and up to 30 thousand fine
e. If the sexual activity with mutual consent without any mens rea –
no liability, no punishment (105.3)

7. Incestuous rape (219.8/220) rape with woman within prohibited degree,

punishable with both laws, i.e. incest + rape law

Prohibited degree connotes those relationships in which marriage is

prohibited. Such relationship includes all the relations as follows;

a. Mother-son; father –daughter: Punishable with mprisonment for

life
b. Step mother –step son; sister-brother; Dewar - Bhauju; Baje
(grandfather) – Natini/panatini (grand daughter): punishable with
4 yrs to 10 yrs imprisonment and 40 thousand to one lakh fine
c. Grand mother – grand son; father’s brother- daughter in law; their
wives and son in law; father in law and daughter in law; mother’s
sisters and son; wife’s mother and son in law (sasu jwai); mama
and bhanji; maiju and bhanij : punishable with 3 yrs to 6 yrs
imprisonment and 30 thousand to 60 thousand fine
d. Other relationship which are within seven degree whether parted or
un-parted family from the male ancestor and sex relationship with
female member of such relationship: punishable with 1 yr to 3 yrs
imprisonment and 10 thousand to 30 thousand fine
[Prohibited degree includes all those relationships which are
connected with blood relation and female member connected with
such relation together with certain relation in mother’s family and
also wife’s family decendence up to 7th degree from male ancestor
has been included within such degree relationship. However, if
there is any custom which permits marriage within such degree has
been made immune from criminal liability.]

13. Procedure

 Rape victim of all types have right to get compensation from

the offender.
 There is no time and limitation to institute suit in respect of
case which relates to incest. It is individual party case.
