INVITATION TO BID (ITB)
CONSTRUCTION OF SIX DAIRY CENTERS IN YEMEN
CLOSING DATE: 3 March 2025 – 23:59 hours (Sana’a, Yemen time)

The Food and Agriculture Organization of the United Nations (“FAO” or “Organization”) is
an intergovernmental organization with more than 194 member nations. Since its inception, FAO
has worked to alleviate poverty and hunger by promoting agricultural development, improved
nutrition and the pursuit of food security - defined as the access of all people at all times to the
food they need for an active and healthy life.

To achieve its goals, FAO cooperates with thousands of partners worldwide, from farmers’
groups to traders, from non-governmental organizations to other UN agencies, from development
banks to agribusiness firms (further and more detailed information on FAO can be found on the

In preparing your offer, you should take into account the international status and activities
of FAO by submitting your best commercial terms. You should also be aware that FAO enjoys
certain privileges and immunities, which include exemption from payment of Value Added Tax
("VAT" or "IVA"), customs duties and importation restrictions.

FAO intends to award Contract(s) for the Construction of six dairy centers in Yemen,
in the following locations:

Site 1 At Ta'iziyah district - Taizz governorate.


Lot # 1
Site 2 Abs district - Hajjah governorate.
Site 3 Jahran district - Dhamar governorate.
Lot # 2
Site 4 Wusab As Safil district - Dhanar governorate.
Site 5 Mawza district - Taizz governorate.
Lot # 3
Site 6 Sabir Al Mawadim district - Taizz governorate.

The works should be completed within a period of Four (4) months following the
handover of the site(s).

You are hereby invited to submit your best offer in connection with the provision of the
construction work as specified above.

The following procedures have been established by this Organization for the award of this
contract:

1. Procedures

1.1. You are invited to submit an offer for the above-mentioned works. A description of the
requested works is provided in Appendices A & B.

1.2. In submitting your offer, you are supposed to have considered all aspects relevant to the
performance of the proposed contract and to have obtained all necessary information and data
as to risks, contingencies and other circumstances which may influence or affect your offer.

1.3. It is understood that all documents, calculations, etc., which may form part of your offer, will
become the property of the Organization, which will not be required to return them to your
firm.

1.4. The Organization may decide to make a partial award or no award at all should it consider
that the results of this tender and/or any other related circumstance so require.

1.5. The Bill of Quantities (BOQs) pertain to the aforementioned project. The award of the contract will be
contingent upon the qualifications and capacity of the bidder to execute the required works outlined in
this tender, assessed in accordance with the minimum qualification requirements.

1.6. Bidders must quote for the complete quantities of all items required under each single BOQ
within each lot. Bidders are not allowed to participate in one or more Lots partially. However,
FAO reserves the right to award one or more Lots depending on the financial and technical
(personnel, material/equipment) capacities of the bidders to execute the required works.

1.7. All costs incurred to prepare your bid have to be borne by you; FAO will not be liable to
reimburse any or all of such costs.

1.8. The Organization reserves the right to publish the details of awards, including supplier name
and country, total Contract value and a brief description of the services. In all cases,
unsuccessful bidders will be notified.

1.9. Consortium of firms will be accepted, provided that the companies indicate which firm will
be the main Contractor and will be responsible for the signature of the relevant contract.
Bidders adhering to the Consortium will have to notify FAO of their acceptance to participate
in the Consortium.

1.10. Registration as a vendor in the UN Global Marketplace (UNGM), [Link], is a
prerequisite for receiving an award from FAO. Please register your firm with UNGM. If
you have any difficulties registering, please contact UNGM team using the Help button on
the web site [Link].

1.11. The Organization has adopted a zero-tolerance approach to fraud, and it prohibits firms from
engaging in corrupt, fraudulent, collusive, coercive, unethical, and obstructive practices when
participating in procurement activities. As provided by the Vendor Sanctions Procedures
([Link]
Policy_-_Procedures.pdf), if the Organization determines that a firm has engaged in such
conduct, it will impose sanctions and may share information on sanctioned firms with other
Intergovernmental or UN Organizations;

1.12. A firm and its affiliates, agents and subcontractors should not be suspended, debarred, or
otherwise identified as ineligible by any Intergovernmental or UN Organization, including
any organization within the World Bank Group or any multi-lateral development bank, or
by the institutions and bodies of economic integration organizations (e.g., the European
Union). You are therefore required to disclose to the Organization whether your firm, or any
of your affiliates, agents or subcontractors, is subject to any sanction or temporary
suspension imposed by any such organization or National Authority at any time during the
three years prior to the contract or at any time throughout the execution of the contract. You
acknowledge that a breach of this provision will entitle FAO to terminate its contract with
your firm, without any liability for termination charges or any other liability of any kind of
FAO, and that material misrepresentations on your status constitute a fraudulent practice.

1.13. Bidders must certify that their firm is not associated, directly or indirectly, with entities or
individuals (i) that are associated with terrorism, as in the list maintained by the Security
Council Committee established pursuant to its Resolutions 1267 (1999) and 1989 (2011), or
(ii) that are the subject of sanctions or other enforcement measures promulgated by the
United Nations Security Council. Selected bidders also agree to undertake all reasonable
efforts to ensure that none of the funds received from FAO under the awarded contract are
used to provide support to individuals or entities associated with terrorism or that are the
subject of Security Council sanctions. This provision must be included in any subcontracts,
sub-agreements or assignments entered into under the awarded contract. The Bidder
acknowledges and agrees that this provision is an essential term of the awarded contract and
any breach of these obligations and warranties shall entitle FAO to terminate the Contract
immediately upon notice to the Contractor, without any liability for termination charges or
any liability of any kind of FAO.

1.14. Bidders must certify that their company and/or subcontractors are not associated, directly or
indirectly, with the consultant or any other entity who prepared the terms of reference or
other bidding documents for this tender.

1.15. Please note that Bidders who use an independent consultant to assist in the preparation of
offers may risk engaging in unacceptable practices if the same consultant assists another
Bidder to prepare an offer for the same tender. Bidders are reminded that they are fully
responsible for the conduct of any consultant who may be used to prepare offers for FAO
tenders and they should take all measures to ensure that any independent consultant engaged
to assist in the preparation of an offer for an FAO tender has not and will not be involved in
the preparation of an offer for another Bidder for the same tender process.

Bidders are kindly requested to disclose to the best of their knowledge whether their
company has any personal or professional relationships with FAO. The disclosure shall
include all relevant details and should include, but not be limited to:

- ANY current or past employment relationship with FAO of your


company's representatives and employees.
- ANY current or past relationship with any FAO staff member (family members,
spouses, etc.) of your company's representatives and employees.

1.16. Fairness and transparency are fundamental principles for FAO procurement activities. Firms
that believe that the procurement process was not fair and transparent may request feedback
from the office that issued the tender. If a satisfactory response is not received, a firm may
present a protest following the bid protest procedures detailed in the following link:

2.9 FAO General Terms and Conditions for Works.

3. Documents to be Submitted:

Your bid should consist of the following clearly identified items:

3.1 The duly completed and signed "Bid Summary", mentioned in paragraph 2.1 above and
all docs according to Appendix F- Checklist of Forms, along with the Mandatory
Requirements set out below.

3.2 Documents Demonstrating Compliance with the Mandatory Requirements


(Pass/Fail):
Bidders should provide the information/documents listed below for the site works that
are essential to be eligible for participation in the tender and evaluation of the
submitted offer. Failure to provide such information/evidence will result in the
disqualification of the bidder from the tender evaluation process:

3.2.1 CERTIFICATES/DOCUMENTS: Notarized and/or authenticated copies of:


(i) Copy of Legal registration/certificate of registration of the bidder’s firm or company in
Yemen.
(ii) Certificate confirming the category of the construction works. The current license issued by
the Agency for Architecture and Construction of the Republic of Yemen for the relevant civil
works authorities.

3.2.2 PROVEN EXPERIENCE:

i. List of contracts for execution of works of a similar nature and comparable value to the
Works or of a higher value executed by the bidder during the last seven (7) years, and a
statement of the value of each contract and the name and address of the employer in each
case; Reference Appendix ‘C’ – Proven Experience.

ii. Copies of at least two (2) contracts/Purchase Orders for works of a similar nature and
comparable value to the bid submitted, or of a higher value, that have been executed by
the Bidder within the last seven (7) years. At least 2 similar/related contracts of equal or
higher value successfully completed.

3.2.3 QUALIFICATION OF ASSIGNED PERSONNEL: The Bidder will provide CVs of
the proposed company’s key personnel and workers that will be assigned to the
project, along with evidence of academic credentials. The bidder shall submit four
(4) sets of CVs of the below proposed key personnel:

i. One (1) Qualified Chief Engineer/Project Manager for the Site Works: A minimum of five
(5) years’ work experience in the Engineering field & must have handled at least two (2)
projects of similar nature and complexity equivalent to this assignment. He/she must have
a BSc degree in Engineering (CV and academic credentials must be attached);

ii. One (1) Qualified Civil Engineer (Site Engineer) for the Site Works: A minimum of five
(5) years’ work experience in the rehabilitation/construction works & must have handled
at least two (2) projects of similar nature and complexity equivalent to this assignment.
He/she must have a BSc degree in Civil Engineering (CV and academic credentials must
be attached);

iii. One (1) Qualified Electrical Engineer for the Site Works: A minimum of five (5) years’
work experience in the rehabilitation/construction of Electrical works & must have handled
at least two (2) projects of similar nature and complexity equivalent to this assignment.
Should have a degree in Electrical or Civil/Mechanical Engineering. (CV and academic
credentials must be attached);

iv. One (1) Qualified Site foreman for the Site Works: A minimum of five (5) years’ work
experience in the rehabilitation/construction works & must have handled at least two (2)
projects of similar nature and complexity equivalent to this assignment. He/she must have
a Diploma in Civil Engineering (CV and academic credentials must be attached);

3.2.4 EQUIPMENT: Confirmation of the availability of the list of relevant equipment owned
or hired. Please provide details using the table below, as well as the same list provided
in Appendix D. The minimum tools and machinery required for the Site Works
are detailed in Appendix D.

3.2.5 Bidder Financial Information: Bank statement/financial statement/audited


financial accounts for at least five complete fiscal years, demonstrating the
soundness of bidder’s financial position and that it has the financial resources
to perform the proposed contract. It must demonstrate available cash flow
arrangements of at least 50% of its financial offer.

3.2.6 WORK PLAN AND SCHEDULE: The bidder must ensure the completion of all
works within four (4) months from the contract signing date, regardless of
whether the contract is awarded partially or all lots. The bidder is required to
provide a comprehensive work plan and methodology outlining the delivery of
goods, execution of all necessary works, and installation services. A detailed
work plan and schedule, confirming the timeline for completion, must be
submitted in the form of a Gantt Chart, Project Schedule, or MS Project file or
using other similar tools.

3.2.7 BILL OF QUANTITIES: The duly completed BILL OF QUANTITIES is set forth
in Appendix B of the Letter of Invitation.

Other tender conditions

3.2.8 MANDATORY SITE VISIT Statement: The Bidders are encouraged to undertake
a site visit to enhance their understanding of the project's specific requirements,
familiarize themselves with the site conditions, and assess the surrounding
environment. The Bidder is required to submit a mandatory Site Visit Statement
duly signed by the Bidder, certifying that the Bidder inspected the site of work
and obtained all necessary information related to risks, contingencies and other
circumstances, which might influence or affect the provision of the goods or
execution of the works. The Site Visit Statement form is attached to this Letter
of Invitation as detailed in Appendix E below.

4 Evaluation.
The Bids received will be evaluated against the mandatory requirements. Pass/Fail methodology
will be used to evaluate each one of the mandatory requirements. Failure to comply with any of
the mandatory requirements will result in disqualification of the bid. FAO further reserves the right
to consider, and disqualify firms based on, documented prior poor performance, including but not
limited to poor quality of goods or services provided, late delivery and unsatisfactory performance.
FAO further reserves the right to consider, and disqualify firms based on their financial standing.
The contract will be awarded to the most competitive offer that complies with the technical
specifications as laid out by the mandatory requirements.

4.1 Evaluation Methodology


The evaluation process will be undertaken through three main stages as follows: -
a. Verification of eligibility requirements
b. Verification of Technical Capacity
c. Evaluation of Financial Proposal

5 Completeness of Bid
Bids will only be considered if they contain all of the above information and documents and
observe the provisions of the enclosed sample contract as otherwise it will not be possible to
evaluate them on an equal basis. Since this Organization is not allowed to sign contracts, which
do not specify its maximum financial liability, proposals which do not allow us to calculate such
liability may be rejected.

6 Participation by the Organization


You should examine carefully the nature and extent of the participation in the contract performance
by the Organization as set out in Annex II of the enclosed contract since such contract assumes
that all other requirements for its successful completion are provided at the cost of the Contractor.
You should, therefore, state in the appropriate space provided in the "Bid Summary" (Part
II) any additions or modifications of the said Annex II which you suggest for a satisfactory
performance of the contract.

7 Privileges and Immunities


This Organization enjoys certain privileges and immunities, which include exemption from
payment of "IVA" (VAT), customs duties and importation restrictions.

8 Currency of Bid/Contract
Your proposal should be expressed in USD (United States Dollars).

deadline.
It is the exclusive responsibility of the bidders to ensure that the files are uploaded before
the tender deadline. The system will reject any bid received after the deadline.

a) Log in the UNGM website with your e-mail and password;


b) Click on MY TENDERS and select the tender;

10 Communications concerning this Tender

All communications concerning this tender should mention the tender number (TENDER No.
ITB 006-2025) and should be submitted as soon as possible through the UNGM portal under
the “CORRESPONDENCE” tab.

Bidders are responsible for appropriately examining this tender. If the Bidder finds
discrepancies in or omissions from the documents, or if their intent or meaning appear unclear
or ambiguous, or if any other questions arise, the Bidder shall submit any request for
clarification through the aforementioned “CORRESPONDENCE” tab.

In submitting a request for clarification, do not, under any circumstances, submit a copy of
your offer or reveal any information about your intended quotation. This will invalidate your
offer.

Responses to clarification enquiries will be issued by FAO through the UNGM portal
simultaneously to all bidders. The system will send automatic e-mail notifications to all bidders
every time a clarification, or any other change to the tender notice, is made.

All FAO’s responses to bidders’ questions will be uploaded under the “CLARIFICATIONS”
tab of your Tender Management page and made available to all bidders. Please ensure to read

IMPORTANT: The Deadline for technical questions is four (04) days before the tender
closing date.

FAO’s REPLIES TO BIDDERS’ REQUESTS FOR CLARIFICATION

Responses to clarification enquiries will be simultaneously issued by FAO to all bidders through the UNGM.
The system will send automatic e-mail notifications to all bidders every time a clarification or any other
communication related to the tender notice is sent out by FAO.

All responses from the FAO to bidders’ questions will be uploaded under the “CLARIFICATIONS” tab on
your Tender Management page and made accessible to all bidders. Please ensure that you read all the
clarifications, as they constitute part of the technical specifications.

No Advance Payment. Advance Payments are not provided under this contract.

requesting information on previously completed contracts that are comparable in volume and complexity

PART IV: Completeness of Bid

I confirm having obtained all relevant data and information as regards risk, contingencies, and
any other circumstances which may influence or affect the performance of the contract, which
have been duly taken into account in the formulation of this bid.

I understand that the contract resulting from this Tender will be a lump-sum contract based

APPENDIX A1 – SCOPE OF WORK

1. BACKGROUND OF THE PROJECT:


Yemen Food Security Response and Resilience project (FSRRP) OSRO/YEM/206/WBK funded
by the Word Bank group to improve the availability of and access to food and nutritious diets, both
in the short and medium term, for targeted households in the project Areas, and to enhance Yemen’s
capacity to respond to food insecurity. FSRRP will scale-up several activities to increase the focus
on resilience to food crises. increasingly emphasize the climate-resilient restoration of productive
assets to protect livelihoods, focusing on restoration and recovery of agricultural production;
combination of short- and medium-term interventions, and, where possible, targeting areas with
chronic incidence of food insecurity and malnutrition as a priority. FSRRP will scale-up existing
and introduce new capacity-building efforts, particularly to strengthen national institutions relevant
to the implementation of Components 2 and 3, focusing on agricultural extension and animal health.
The FSRRP will finance technical assistance, training, small equipment, and repairs for priority
institutions responsible for the implementation of project activities and critical for public service
delivery.

2. PURPOSE OF THE PROJECT

Overall goal of the project: Crisis affected communities are better able to manage local risks and
shocks for increased resilience and self-reliance.

One of the key activities within the programme is the rehabilitation of the identified existing
premises or construction of new premises to work as a dairy processing centre, which will allow
the targeted beneficiaries from the dairy value chain to process milk into different dairy products,
ensure the hygiene of the produced dairy products, consequently improving their income, and
reducing the food insecurity in the targeted communities.

There shall be six new diary processing centres constructed with the same design in the following
locations/sites:
Site 1: Taizz governorate, At Ta'iziyah district.
Site 2: Hajjah governorate, Abs district.
Site 3: Dhamar governorate, Jahran district.
Site 4: Dhanar governorate, Wusab As Safil district.
Site 5: Taizz governorate, Mawza district.
Site 6: Taizz governorate, Sabir Al Mawadim district.

3. SCOPE OF WORK

The proposed design for the Dairy processing centre will be built in Multi-Governorate within Yemen, and
it will be used as a reference when building similar structure in different locations. This circumstance
implies that for each building derived from the model, some customization must be carried out according
to the conditions of the specific site, and therefore, principles for the site organization are provided.
In addition to that, the project is structured in such a way as to contemplate different alternatives for the
main elements of the construction: this strategy stems from the need to respond as effectively as possible
to the differences among the various locations where the dairy processing centres will be realized as far as
availability of materials and skills are concerned.

The Dairy centres have a fundamental functional role, which is very relevant at the level of the local

APPENDIX A2 – STANDARD SPECIFICATIONS

PRE-CONSTRUCTION WORK

The Contractor will carry out a joint condition-in survey, including soil checking, to record the condition
of the site upon handover to the Contractor and the applicability of applying the design. This will determine
the state of the site that the Contractor must hand back upon completion of the works. The Contractor will
carry out a detailed site set-out survey for the works. A Pre-Construction Meeting will be held between the
Engineer and the Contractor to discuss all related things.

Site Restrictions
Site security limitations: Comply with any restrictions on site area, access, or working times advised by
the Engineer.

The Contractor is to maintain a safe, healthy, and tidy worksite at all times and all work activities are to be
performed with protective and safety equipment appropriate for the task. The Contractor is entirely
responsible for workplace safety, and unsafe work practices will be identified and recommendations made
for revised work methods as appropriate.

Contractor's representative
The contractor must employ a suitably experienced person as the Site Manager. This person must be on-
site during working hours, and fluent in English and technical terminology. The site Manager will have the
authority to make all decisions concerning the project Program of work.

The Contractor is to provide a construction program which has the following information:
- Sequence of work.
- Allowance for holidays.
- Activity inter-relationships: Periods within which various stages or parts of the work are to be executed-

Time scale: Working days.


Site meetings
Hold and attend weekly site meetings throughout the contract and ensure the attendance of appropriate
subcontractors, the Site Manager, and the Engineer. The meeting schedule may be modified by the
Engineer.

The Contractor will provide the following documentation after all site construction has been completed:
- Warranty Statement
- Material Test Certificates
- As-Built Drawings A condition-out survey will be conducted with the Contractor and Engineer at which
damages caused by the contractor will be identified. The Engineer will determine if the Contractor is to
make repairs or if the damage will be deducted from the contractor
- final invoice.

SAFETY MANAGEMENT:
CONSTRUCTION SAFETY
The contractor shall take all necessary steps to provide safety for project workers, the persons residing near
the project, the property of the public, or others from the project activities arising as a consequence of his
methods of operation. The Contractor shall comply with all Safety Legislations and its Subsidiary

Legislations, Regulations which are in force in the Country, and any amendments or re-enactments. The
Contractor shall not permit any person to do anything not in accordance with the generally accepted
principles of safe and sound practices. The Contractor shall ensure a safe environment on-site at all times.
The Contractor shall ensure that necessary and sufficient precautions are taken by his workmen when safety
provisions are used.

STORAGE OF FUELS
Fuels shall be stored in a room/ enclosed space, the room/ enclosed space shall have an impervious platform
and berm along the periphery of the storage area to contain spills of the fuels.

SAFETY OF MACHINERY
The Contractor shall employ only qualified operators for the machinery to be used on the Site. All the
machinery shall be locked when they are parked to avoid the unauthorized operation of the machinery.
FIRST AID
At least two first aid kits shall be kept at the site for attending the emergency treatment of the victims of
accidents or chemical poisoning or excessive exposure to toxic substances. The first aid kit shall include a
leaflet of standard First-Aid procedures in addition to the medicines and medical tools. At least one staff
member who has undergone First Aid training should be posted at the site.

Construction process

Site preparation: This involves clearing the site, excavation, grading, and soil stabilization. Quality
control procedures for site preparation include ensuring that the site is free from debris, checking the
soil quality, and ensuring that the site is stable and can support the proposed structure.
Foundation works: This involves pouring the foundation, installing footings, and reinforcing
steel. Quality control procedures for foundation construction include checking the concrete mix,
ensuring that the foundation is level and plumb, and verifying that the reinforcing steel is properly
installed.
Framing: This involves constructing the steel structure, walls, floors, and roof of the building.
Quality control procedures for framing include ensuring that the framing is properly aligned,
checking for squareness and plumpness, and verifying that the structural components are properly
installed.
Electrical and Plumbing: This involves installing electrical and plumbing systems into the
building. Quality control procedures include ensuring that the systems are installed according to the
design plans, checking for proper alignment and fit, and verifying that the systems are functioning
correctly.
Finishing: This involves installing finishes such as plastering, flooring, and paint. Quality control
procedures for finishing include ensuring that the finishes are properly installed, checking for defects,
and verifying that the finishes comply with the design specifications.
Final Inspection: This involves a final inspection of the completed structure to ensure that it meets
the required quality standards and regulations. Quality control procedures for the final inspection
include checking for defects, verifying that all systems are functioning correctly, and ensuring that
the structure complies with all relevant regulations and codes.

Site supervisions control the on-site work process regarding technical, functional, aesthetic, urban and
environmental aspects
Construction supervision ensures a high level of quality in the project down to the very last detail so that
everything will go according to plan on your construction site. FAO will monitor by field engineers all

b- Iron/Steel works
All materials used in iron works both cast and wrought shall be free from all defects, and first class quality
obtained approved manufacturer comply British Standard.
High tensile structural steel shall be Grade 50B to BS 4360 having minimum yield stress of 355 N/mm2.
Mild structural steel shall be Grade 43A to BS 4360 having minimum yield stress of 275 N/mm2. High
strength Friction Grip Bolt shall be of general grade in accordance with BS 4395
Whenever required, the contractor shall committing to test any of used items according the FAO engineer
instructions.

c- Excavation works.:

Excavate in the soil to reach the required level depending on drawings and supervisor. the price includes
removing the waste outside the site,

Kg/m3 , spraying three times a day for three days at least.

of the Republic of Yemen for the relevant civil works.
Copies of at least two (2) contracts/Purchase Orders for works of a
similar nature and comparable value to the bid submitted, or of a higher
2.3 value, that have been executed by the Bidder within the last seven (7)
years.
At least 2 similar/related contracts of equal or higher value successfully
completed.
Bank statement/financial statement/audited financial accounts for
at least five complete fiscal years, demonstrating the soundness of
2.4 bidder’s financial position and that it has the financial resources to
perform the proposed contract. It must demonstrate available cash
flow arrangements of at least 50% of its financial offer.

Apart from providing additional information, no alterations to its format shall be permitted and no substitutions
shall be accepted.

Failure to provide the required Mandatory information and documents together with your bid
will result in the disqualification of your bid from the tender evaluation process.

FAO RESERVES THE RIGHT TO REJECTS BIDS WHICH DO NOT CONTAIN THE
