WHEREAS,
Governmeni Code provides: "section Ig2 * Authority to Gront Tox Exemption
Privileges. Locol Government Units moy, ihrough ordinonces duly CIpproved,
groni tox exemplions, inceniives or reliefs under such ierms ond condilions os
ihey moy deem necessory."
WHEREAS, the formulotion of this code will sirengthen economic activities,
generote employment ond income opportunities, ond increcse revenues;
WHEREAS. this code aims to encouroge locol ond foreign inveslment
especiolly tourism oriented business;
NOW THEREFORE, upon molion of Hon. Potricio A. Pello. seconded by Hon.
Joel B. Tiboyon be it ordqined by the Songguniong Ponlungsod in session

SECTION 1. This ordinCInce sholl be known os the "LOCAL INVESTMENIfa
THE CITY OF TAGAYTAY".

SECTION 2.
Any person or entity which rneeis ihe quolificotions ond requirernents
set forth under Section 3 of this Ordinonce ond which will commence its business
venture in the City of Togoytoy ofter opprovol of this ordinonce, moy opply to
ovoil ihe incentives/privileges provided herein.
SECTION 3. Subject to the provision
of Section I4 hereof, this Ordinonce sholl ;o
opply to cny person, portnership or corporotion, ossociotion ond cooperotive, r

provided thoi they meet the following quolificotions: o
o) Must be quolified to do business under existing notionol lows;
b) Must be duly registered with oppropriote government ogencies, such
Deportment of Trsde ond lndustry {DTl), the securities qnd Exchong
Commission {sECi, the cooperoiive Development {cDA} cnd other
oppropriote ogencies;
c) Must hove on initiol investment of noi less ihon THREE MILLION PESOS
{Php3,000.000.00) in cose of Filipino investors ond not less thon TWO
HUNDRED THoUSAND DoLLARS {9200,000.00} for foreign investors.

lnvestment Boord (LlB) is hereby creoted wiih the following composition, powers
ond functions:

Vice Presidenl: Choirrnon, Commiitee on Commerce ond
Industry
Members: President, Togcrytoy Tourism Council
Choirmon, SP Committee on Tourism
Heod, Tourism & Culturol Development Office

octed upon within Thiriy {30} doys upon receipt ihereof;
5. ln order to give more effect to ihe Locol lnvestment ond lncentive
Progrom of this ordinonce, ihe Locol lnvesiment Boord {LlB} is hereby
empowered io conduct Trode Missions both locol and foreign. for the
purpose of inviting inveslors os well os providing necessory informotion
ond disseminotion io poriies witling to ovoil of ihe lnvesimeni program
of this Ordinonce.
6. Trode Mission involving locol ond foreign lniernotioncrl Trode
orgonizcriions os well os Trode Missions involving Boord of lnvestors
offices, foreign embossies ond consulcrtes in the philippines ond
obrood sholl be heoded by the city Moyor or in hislher obsence, by
ony of his duly outhorized member of the Locol lnvestmeni Boord {LlB};
provided, fhot, in ihe cose of lnlernoiionolTrode orgonizctions. there is
o need for on endorsement or referrol by the Bureou of lnternotionol
Trode Promotions;
7. The Locol lnvesiment Boord is hereby empowered to identify Business
Growth Areo (Tourism Areo) ond oiher investment oreo in lhe City of
Togoytoy in occordCInce with the opproved investment priorities of the
CitY.
SECTION 7.
An onnuol budgetory requiremenis of Five Hundred Thousond Pesos
iPhp500,000.00J sholl be included in the onnuol or supplementol budgei of the
City for the mointenonce ond monogement expendilures ond other operoiionol
expenses of the Locol lnvestment Boord.
SECTION 8.
The City Tourism ond Culturol Development Office sholl serve os ihe
Lioison ond Secreioriot of the Locol lnvesiment Boord ond sholl ossist ihe Boord in
its funciions os well os process ond provide oll oppliconls with ihe opplicotion
forms ond other necessory documents to be lilled up wherein oll informotion ond
doto of the oppliconts ore stoted; the noture of business opplied for, copitol
investmenf omount, locoiion of business, dcrte when the business is to be
estoblished or slorlecJ ond the possible number of workers or employees to be
utilized or hired.
The City Tourism ond Culturol Development Office sholl upon outhority of
the Boqrd initiote investment promotion progrems for the Ciiy.

SECTION 9. The Locol lnvestment Program sholl crpply only to new business
opplicotions duly opproved io commence their business operotion after the
opprovol of this Ordinonce and sholl enjoy the incentives gronted by this
progrom for o period of three {3} yeors.
SECTION I0. Only porticipoting members who hove invested on crmount of more
thon FIVE MILLION PESOS {Php5,000,000.00}, Philippine Currency con be gronted
on extension period of onother two {2} yeors upon the recommendoiion of the
Locol Investment Board {LlB}.
SECTION 1I.
lncentives. All quolified ond qccepted oppliconis sholl enjoy
ond/or ovoil ihese inceniiveslprivlleges for o period siated in Section 9, hereof,
viz:.
oi Exempiion from inspection ond exominotion of Books of Accounts ond
other pertinent records of business by the City Treosurer's Office
except when ollowed by the Boord for three {3} yeors from the siorl of
operction.
b) Will be ossisted personolly by the Chief of the Business Permits ond
License Division ond the City Trecsurer in the processinglpoyment of
Moyor's Permit, Business Permit ond ihe Reol Property Tox, including
opplicotions for woier, eleciricity ond other bosic utilities. I

c) The City Governmenl will help/ossisi in the promoiion of their {
business/esioblishmenis by including in the Audio Video Preseniolion
being showed to Lokboy Arol ond oiher locol/foreign visitors of ihe

lnformction Office ond the City Tourisrn Culturol ond Development

d) The guesi/s of ihe member estoblishment wili be eniitled to a 2A%

Sky cnd other cily-owned fociiiiies.
e) The member is entitled to o 20% discount for the use of the Togoytcry
lnternotionol Convention Cenier (TICC), Togoytoy Sports Center
iTSAC) ond other city-owned focilities.
SECTION 12. Existing businesses of whotever kind or noture thol ceased to
operote upon snd/or sfier the opprovol of this Ordinonce, for the purpose of
ovoiling of this lnvestment lncentive progrom, sholl not be qllowed to opply
under this Ordincnce" However, expcnsion of exisling operationol businesses cre
entitled to incentives stoted in Section I I, hereof.

Boord (LIB| sholl conduct on onnuCIl meeting to ossess the stsius, progress of the
provisions of this Ordinqnce ond the privileges gronted crs stqied in the

SECTION 17. Violqfions. Any participoting member who is found to hove
violoted ony provision of existing city ordinonces, the Locol lnvestment Boord
(LIB) sholl forfeii the incentives ond privileges gronted.
