The insurer's liability for pollution or contamination is restricted to events deemed to have occurred during one insurance period and limited by the schedule's specified limits. Incidents causing direct injury loss or damage are covered, but costs for cleanup or remediation expenses imposed by authorities due to pollution or contamination are excluded by the policy .
The liability period for speculative buildings is limited to 180 calendar days for domestic buildings and 90 days for commercial buildings following Practical Completion, or until the date of sale, occupation, or handover, whichever is earlier. 'Practical Completion' is defined as completing construction apart from decorations and fitments chosen by a purchaser or tenant .
Under Cover One extensions, the policy includes coverage for necessary professional fees incurred from architects, surveyors, and consulting engineers for reinstating contract works after damage, as long as insurers admit liability for the damage. Costs associated with claim preparation are not covered .
Offsite storage coverage applies to contract works stored within the territorial limits for a period not exceeding six months, provided that the works are prepared for delivery to the contract site and can be allocated to an insured contract. Moreover, the value of works at any one location must not exceed the specified amount in the schedule, unless prior consent is obtained from the insurers .
Cover Four excludes liability for consequential losses not specifically provided for, losses recoverable under contractor agreements, wear and tear, gradual deterioration, redesigning, improving, or accelerating completion of non-damaged parts of the contract works, insufficient funds for repair, and idle time costs .
The insured may temporarily occupy contract works with insurer permission before contract completion for personal utilization. Income gained during this occupation is factored into the calculation of the indemnity provided under the policy, potentially reducing the claim payout .
The policy excludes liabilities for financial loss claims arising from events known to the insured at the policy's inception. This applies especially when such events or circumstances might reasonably be expected to give rise to future claims .
The policy excludes liabilities related to delays or damage arising from the need to make good repaired or replaced supplied products, diminution in value, non-completion, or strikes. It also excludes financial defaults, insolvency, or non-delivery of products .
An 'Act of Terrorism' is defined as acts of force or violence for political, religious, or ideological purposes intended to influence government or instill public fear. The policy limits liability for such acts to a maximum of either the scheduled liability limit or £5,000,000, whichever is lesser .
The policy provides coverage for 'Additional Costs of Completion of Unbuilt Works', incurred due to damage for which liability has been admitted. However, it excludes costs that would have been incurred regardless of the damage, costs solely for expediting contract completion, and costs for redesigning or improving contract works post-damage. The insurer's liability is capped at the amount specified in the Schedule .
