PROJECT DRAFT 2 : GROUP 1 - The Pune Porsche Case

RESEARCH QUESTION: What are the legal and social implications of crimes committed by
wealthy individuals on road safety, public perception, and justice for high-profile cases in
India?

Gaurvica: Welcome, everyone, to today's episode. It's the Pune Porsche crash-one of those cases you've
been hearing about for the past few months. It's a tale of tragedy, of privilege, of questions of justice.
Joining me in the conversation are Ayaan, Navya, Pratyaksha, Vaasavi, & Aayush.

Ayaan: In May 2024, an 18-year old supposedly drunk was alleged to have been driving a Porsche
through Kalyani Nagar in Pune. He was said to have smashed a motorcycle, killing two young software
engineers on the spot. The shocker? His only punishment was a 300 word essay.

Gaurvica: Hmm.. This reminds me of a similar case that took place in 2019. Aayush, could you please tell
us more about it?

Aayush: Back in 2019, a 16-year-old in Hyderabad drove a Maruti S-Cross without a license, crashing
into an autorickshaw and tragically killing a 14-month-old and his grandmother. The teen also hit two
bikes, injuring three more. Both he and his father were charged, but the father was later acquitted due
to lack of evidence.

Gaurvica: Both cases are outrageous, right? Vaasavi, what do you think was the people's response to the
Pune case?

Vaasavi: People were furious. Two deaths and you'd think the system would let this one slide. The fact
that the boy hails from a rich family made it look as if privilege would shield him.

Navya: And that's when things got messier. There was an accusation that his father, who is a
well-connected businessman, was manipulating proceedings from behind the scene. He was arrested for
trying to tamper with the case and then it became about the Juvenile Justice Board's handling of the
case.

Pratyaksha: Right. An investigation revealed that the Board members who granted the bail overlooked
some important details. 2 were sent back because of protocol mistakes. It became evident that there
were some mistakes in the way they handled the case, especially considering the type of crime it was.
Gaurvica: Influence of money cannot be bypassed. But it was not just about granting [Link], what
were the other notable issues?

Aayush: The tampering of evidence was huge. People were saying that the blood alcohol test results had
been manipulated, which would have been to cover up the minor. Even 11 of the hospital's staff were
taken into custody for tampering with evidence, and that made it even more controversial.

Ayaan: It's wild. Then the public began to say, "so this is how it is when some rich guy commits a crime?
Does the system work differently for them?"

Vaasavi: Exactly. And that the minor had to write an essay in retaliation for causing two deaths sounded
like a gross misunderstanding. It seemed that privilege belittled justice. Though the minor was charged
under the Juvenile Justice Act, the punishment was too lenient as compared to the crime committed.

Gaurvica: Let's talk about the ‘privilege of the rich’ by examining a systemic problem here. Navya, what
does this case tell us about the nature of the justice system?

Navya: It clearly brings out the cracks in the system. It seems that if you have money, or are well
connected, you can bend the rules. Well, the investigation on this case shed light on that. This is really
about the father's influence and the evidence that got tampered with; it is only that money can
manipulate the outcome.

Pratyaksha: And not to forget the juvenile angle. Our legal system is supposed to safeguard minors.
However, what has happened here is exactly how a case leads to an overhaul of the system.

Ayaan: The general public was under the impression that the Juvenile Justice Board was either
influenced by the minor's background or was too nonchalant to treat such a serious case so casually.

Aayush: Now all the pressure is on the system to fix itself. The public backlash has been stiff as has
the investigation. In a desperate attempt to save face, several arrests-of hospital employees and
middlemen were made by the police.

Gaurvica: That's a valid point. This case then affects our ideas of justice, or at least in india. Vaasavi,
do you think?

Vaasavi: I think this is a wake-up call. It has made people lose faith in the idea of equal justice.
However, when the prosecution of a case such as this jumps over all kinds of ethical lines, it only
reinforces the idea that the wealthy get away with it and the average person gets impacted. If this case
hadn't been so huge would there ever have been such an investigation?

Navya: Let’s also remember the Salman Khan hit-and-run case from 2002, where he was accused of
driving under the influence and running over several people sleeping on a Mumbai pavement. The case
dragged on for years, raising questions about the efficiency of the judicial system when high-profile
personalities are involved.

Pratyaksha: The public outrage is not spurious. The whole pampering of the minor and then the
tampering charges show that the system can be worked. However, this case also serves as an opportunity
to advocate for reform within the juvenile justice system and the way we treat cases that involve the
rich and powerful.

Aayush: Ayaan, so you think things will be different from now on?

Ayaan: It's difficult to say. The Government is feeling the pressure of the public, but the system will
not change overnight. What matters is that cases like these keep shining a light on how influence is
capable of undermining justice. That may not alter anything else, but at least this case has sparked talk
of reform.

Navya: And reform is badly needed. Whether it's strengthening the accountability of the Juvenile
Justice Board or ensuring evidence doesn't get tampered with, we need to close all these loopholes

Gaurvica: But let's get to the victims before we go there. Two innocent lives taken and this whole thing
has been going on for months. How do we bring justice to them?

Aayush: It hurts!!!!! The whole point of justice is to correct wrongdoings, even if they are irreversible.
Families of the victims deserve this much. It's not just about penalizing the minor but ensuring that all
those involved in this racket-right from the driver to the people who were tampering with evidence-will
also be brought to book.

Pratyaksha: This whole situation reminds me of the Nanda BMW hit-and-run case from 1999, where
Sanjeev Nanda, the son of a wealthy businessman, was accused of running over and killing six people. The
case dragged on for 10 years, and finally the verdict was passed in 2010, which found him guilty and was
sentenced in prison for just 5 years. Yet, after appealing to the high court, this small sentence was
reduced even further down to just 2 years. This truly displays the effect stature can have on judicial
decisions.
Vaasavi: I wholeheartedly agree with you, Pratyaksha, and I further want to add that if the flip side
were to occur, the situation would be very different. Had essentially a ‘nobody’ hurt someone who was
famous, law enforcement would have a different attitude and the suspect would be detained within a few
hours itself. This can be seen in action in the very recent stabbing of actor Saif Ali Khan, where the
suspect was caught in a day. The police were very active in solving the case, also displaying how privilege
can impact the system in a different manner.

Ayaan: If the police and other players involved in the justice system reacted to all crimes like this, the
world would be a better place to live in. In regards to the innocent lives lost, the best way to provide
justice to their memory would be to change the system. And if this case, in a sense, forces the system
to become more transparent and fair, then so be it, because as they say, even in tragedy, there is
progress.

Gaurvica: Well said. It is not just an issue of a single crash, but of much broader issues of privilege, of
justice, and of how we can possibly make things fair for all. Thanks for listening to today's episode.
